SAN DIEGO (CNS) - Three San Diego County sheriff's deputies were justified in fatally shooting an Alpine man who charged at them with a knife in his hand last fall, according to a report released Wednesday by the District Attorney's Office.Daniel Ayala, 31, was shot 10 times outside his apartment in the 2600 block of Alpine Boulevard last Nov. 12.Sgt. Chris Katra, Cpl. Sean McGillicuddy and Deputy Kevin Nulton responded to that address around 2:50 p.m. following reports that a man was screaming, talking about killing himself and others, and throwing items, according to a letter prepared by District Attorney Summer Stephan and addressed to San Diego County Sheriff Bill Gore.Body camera footage from two of the lawmen was also released by the D.A.'s office.RELATED: Man who was fatally shot by deputies in Alpine identifiedAs the deputies approached the front door of Ayala's unit and knocked, announcing ``Sheriff's Department'' three times, Ayala opened the door, said ``What's up!'' and jabbed a knife twice through his metal screen door, the body-worn camera footage shows.The deputies backed up from the door as Nulton alerted the others by saying ``Knife, knife, knife.''Ayala then opened the screen door and advanced towards the lawmen, who opened fire, striking him mostly in the upper body, according to Stephan's letter.Ayala died at the scene. His 5-year-old son was inside the apartment during the entire encounter, but was physically unharmed, according to the district attorney.Toxicology results showed Ayala had methamphetamine, heroin, cannabis and alcohol in his system.Stephan's letter concludes that the deputies ``were in a confined space when Ayala advanced on them quickly with a knife in his hand.'' SAN DIEGO (CNS) - The state Supreme Court Thursday ruled that a San Diego citizens' initiative that cut back city employee pensions was illegally placed on the ballot, and ordered an appeal court to consider a remedy.Proposition B, initially approved by voters in 2012, eliminated guaranteed pensions for new city employees, except police officers, and replaced those benefits with 401(k)-style retirement plans.In 2015, one of the city's largest public sector unions challenged the benefit system, alleging former Mayor Jerry Sanders and other officials illegally placed the measure on the ballot without conferring with labor groups. The Public Employees Relations Board ruled with the union, but the Fourth District Court of Appeal reversed the decision in April 2017.Now, the appeal court's decision is overturned."We reverse the Court of Appeal's judgment and remand for further proceedings to resolve issues beyond the scope of this opinion," wrote Associate Justice Carol A. Corrigan in Thursday's decision, in agreement with the other five justices.A city spokesperson couldn't be reached for comment.The court ruled that although it was a citizens' initiative, Sanders' support of Prob B as policy warranted engagement with the unions under the Meyers-Milias-Brown Act, which gave city and county employees the right to collective bargaining in 1968.Governing bodies "or other representatives as may be properly designated" need to engage with unions "prior to arriving at a determination of policy or course of action," according to the act.Sanders had said he supported the measure as a private citizen, not a public employee. The Supreme Court ruled that Sanders did use the power of his office to push the initiative, however."He consistently invoked his position as mayor and used city resources and employees to draft, promote and support the Initiative. The city's assertion that his support was merely that of a private citizen does not withstand objective scrutiny," Corrigan wrote.In overturning the Public Employees Relations Board ruling in 2017, the appeal court took an "unduly constricted view of the duty to meet and confer," according to the Supreme Court ruling.The Supreme Court ruled that the appeal court address an "appropriate judicial remedy" for the illegal placement of the initiative on the ballot.The Public Employees Relations Board had previously ruled the city must pay employees "for all lost compensation" related to lost pension benefits, which would cost millions of dollars.The 401(k)-style system was originally intended to save taxpayers money by reducing future pension liabilities. SAN DIEGO (KGTV) - A bluff that overlooks Beacon’s Beach in Encinitas is on the brink of collapsing, which could mean changes for the walking trail that leads visitors down to the beach. The City of Encinitas says the bluff is at risk. There is a low-lying failure and the bluff could fall, taking the walking trail with it.“We’ve been told by our experts that there is a chance that the slide could happen at any time,”says Brenda Wisneski, Developmental Services Director for the City of Encinitas. Visitors at Beacon’s Beach say they feel the walking trail makes the beach different from others. “It’s one of my favorite beaches in all of San Diego. A part of that is because of the access, this trail is highly unique and it's not stairs,” says Mark Tayer. The city has a proposal to add a staircase south of the entry to the trail.“That is the most safe, the most secure. It requires a minimal amount of stability at the base of it,” says Wisneski.Wisneski says the city also has plans to move the parking lot back from the failure area. This could mean fewer parking spaces for visitors. The city hopes to begin construction in the fall of 2019. The proposal will go to the planning commission next. The trail will stay there until it poses a safety issue to visitors. On Wednesday, the City of Encinitas will have an open house where members of the community can voice their concerns. SAN DIEGO (KGTV) - A body washed ashore in Ocean Beach early Monday morning a few hours after a man was seen diving off the Ocean Beach Pier.At about 1 a.m., someone called 911 to report seeing a man jumping off the OB Pier into the ocean. A witness said the man was seen on his back being pulled out to sea.When authorities arrived, they found the man's belongings on the pier but could not locate him in the water. Lifeguards and Coast Guard personnel launched a search, but the man was nowhere to be found.Shortly after 4 a.m., authorities responded to the discovery of a body on the beach nearby. Authorities said it was too soon to determine if the body is that of the man who dove off the pier. 708
