The San Francisco 49ers released linebacker Reuben Foster on Sunday morning, hours after he was arrested on a domestic violence charge at a Tampa, Florida, hotel.Foster, 24, was arrested after Tampa Police officers responded to the Grand Hyatt hotel shortly after 9 p.m. Saturday, according to a release from the City of Tampa. The former first-round NFL draft pick was charged with one count of first-degree misdemeanor domestic violence and booked into the Hillsborough County Jail, the release says.Police said Foster's 28-year-old female companion reported that he "slapped her phone out of her hand, pushed her in the chest area, and slapped her with an open hand on the right side of her face."Officers observed a one-inch scratch on the woman's left collarbone, the release states. Investigating officers learned that Foster and the woman had lived together in the past and were in an on-again, off-again relationship over the past three years, the release says.The 49ers released Foster just hours before their scheduled game against the Tampa Bay Buccaneers.It was unclear Sunday morning whether Foster has retained an attorney.A college star at Alabama, Foster was the 31st overall pick in last year's NFL draft but has had several arrests since.He was charged with felony domestic violence in April for allegedly attacking his girflriend in February at their home, leaving her bruised and with a ruptured eardrum, the Santa Clara County District Attorney said. The charges were dismissed after the victim recanted her story, although the Santa Clara DA's office said the evidence demonstrated he "seriously hurt his girlfriend."The NFL had suspended him without pay for the first two games of this season in relation to a weapons offense and a misdemeanor drug offense which were resolved earlier this year, the 49ers said in a statement on its website."I accept the League's decision and am sorry that my mistakes have hurt my team," Foster said in July when the suspension was announced. "I have a responsibility to the 49ers, our fans and our community, and I am committed to learning from this situation and making better choices in the future. The support I have received over the last five months has been humbling, and I do not take it for granted."49ers General Manager John Lynch said at the time that they supported the league's decision to suspend Foster and hoped he had learned his lesson."Although we are disappointed that Reuben will not be with our team for the first two games of the season, we will continue to work with him on making better decisions and eliminating unnecessary distractions," Lynch said. "The second part of this is their ability to travel and to move and to move people and money and weapons, oftentimes drugs and other illicit goods, internationally. So part of the strategy must be to interdict these networks, interdict them from how they use information, and communicate, but how they move physically, as well.The Supreme Court is set to hear?oral arguments in the travel ban case early next month.The President's executive order would suspend travel from six Muslim-majority countries (Iran, Libya, Somalia, Sudan, Syria and Yemen) for 90 days while the secretary of homeland security and others submit a report on the results of a worldwide review to identify what additional information will be needed from each country to make sure an individual seeking entrance is not a public-safety threat.Responding to a lawsuits from states challenging the ban, the Supreme Court let much of the ban take effect in late June, meaning the 90-day clock started and will hit on or around September 24.Administration officials have not divulged the specifics of their future plans.At a recent homeland security conference in Washington DC, acting Customs and Border Protection Deputy Commissioner Ronald Vitiello said, "We are in the process of action planning about each of the opportunities that the US government has to interview and/or vet potential inbound travelers."That could include "looking at things like social media, looking at things like smart phones, those kinds of windows, if you will, into people's backgrounds and their activity," he said.The-CNN-Wire 2771

The Trump administration asked the Supreme Court on Monday to put on hold a federal appeals court ruling from last week that narrowed the scope of the travel ban as it applies to a certain class of refugees.In a brief filed with the Supreme Court, Justice Department lawyers said that a three-judge panel from the 9th US Circuit Court of Appeals was wrong to exempt those refugees who have a contractual commitment from resettlement organizations.In a one-sentence order issued Monday afternoon, Justice Anthony Kennedy -- who has jurisdiction over the 9th circuit -- granted the government a temporary stay until Tuesday in order to give the challengers time to respond to the government's petition.The travel ban bars people from Iran, Libya, Somalia, Sudan, Syria and Yemen from entering the US.Last week, the lower court narrowed the scope of the travel ban for extended family members such as grandparents and refugees.In his filing, acting Solicitor General Jeff Wall said DOJ was only asking for a stay for the lower court ruling as it applies to the refugees. Wall said the administration has already been allowing in close family members, but allowing in the refugees would "upend the status quo and do far greater harm to the national interest."The issue of the scope of the ban has been playing out in the lower courts, but the Supreme Court is set to hear the larger issues concerning the merits of the case on October 11. 1442
