SAN DIEGO (KGTV) — A San Diego veteran is suing 3M Company alleging earplugs he wore while in the military were defective. He’s the latest in a series of lawsuits that have been filed against the company by service members across the country.Kevin Alicie filed a lawsuit on Wednesday claiming he “used Defendant’s dangerously defective Dual-ended Combat Arms? earplugs during tank firing, training firing, other live fire training, vehicle maintenance, and during other training and combat exercises.” According to the lawsuit Alicie wore the earplugs while at Camp Pendleton and was first diagnosed with hearing loss in California. Alicie tells 10News during his military carrier he started having problems with his hearing. He’d hear ringing. He says he didn’t think much about it until the ringing started to become more frequent.“I mentioned it to the doctor when I was doing my final physical, and sure enough when they did that last hearing test they found that there was hearing loss,” Alicie said.The lawsuit says 3M did not inform the military or Alicie that the earplugs were defective and failed to adequately warn that the earplugs did not meet the military’s sound requirements."The biggest defect is they don't do what they are advertised to do,” said Alicie’s attorney John Gomez. “Essentially they are supposed to protect your ears and your hearing in proximity to loud sounds that can cause hearing loss or damage.”Attorney John Gomez says the earplugs were standard issue in certain branches of the military between 2003 and 2015.“Without question, I think tons of users-consumers and potential victims reside right here in San Diego County,” Gomez said.According to a July 2018 press release from the United States Department of Justice, 3M agreed to pay .1 million to resolve allegations that it supplied the United States with defective dual-ended combat arms earplugs.The release says, “the United States alleged that 3M, and its predecessor, Aearo Technologies, Inc., knew the CAEv2 was too short for proper insertion into users’ ears and that the earplugs could loosen imperceptibly and therefore did not perform well for certain individuals. SAN DIEGO (KGTV) — After getting approved by voters, San Diego State is moving forward with its SDSU Mission Valley Plan. As they are still working out the finishing touches, community members are offering their suggestions to organizers. SDSU Mission Valley still calls for a stadium, housing for students and the public, retail space, offices and a river park. Local land use and design professionals met in Balboa Park this morning to offer their ideas on how to enhance and improve the existing plans."They want to make sure that this very large development... isn't like an island in the middle of Mission Valley," says Cary Lowe, with C3 San Diego. Community members want to ensure the project "connects fluidly with the surrounding community."There are other concerns, as well. Once construction begins, crews may have to remediate a gas plume that once sat under the site."A number of people have raised the issue of the subsurface contamination of the site," says Lowe. This has "been a long time issue because of a leak from fuel tanks in Murphy Canyon."Lowe says there is an elaborate plan for the possible contamination removal. But as negotiations continue, it is unclear if the city or university will be paying for it. Land use and design professionals estimate the project to begin towards the beginning of next year. SAN DIEGO (KGTV) — A sea lion pup in Encinitas was saved Tuesday from a diver's mask that was tightly wrapped around its neck.The year-old sea lion pup was found at Swami's Beach with a diver's mask wrapped around its neck. The sea lion, which only weighed about 32 pounds, appeared malnourished and dehydrated, according to SeaWorld rescue team members.The mask had been wrapped around the sea lion's neck for weeks, preventing the pup from foraging and eating.RELATED: Sea lion lies down in front of San Diego hotel's sign, refuses to budgeHad the mask remained on the pup, the animal would likely have eventually starved to death or been strangled by the mask, crews said.Rescue team members cut the mask off the sea lion, but found that a wound caused by the mask had become infected. Crews took the pup to SeaWorld’s Animal Health and Rescue Center, where officials treated the sea lion's wound.Officials say other than the wound and undernourishment, the sea lion was in good health. They hope to release the pup back into the wild in the next few months after rehabilitation. 1090

SAN DIEGO (KGTV) - A teen in San Diego has written a children's book, which she hopes can help in the fight against cancer.Sophia Namazy, 14, wrote "Pigtails, Ponytails, and Fairytales" after seeing her little sister wake up every morning with messy hair. In the book, a pair of fairies come at night and play with it. Sophia says it's loosely based on her sister, Poppy."Her hair was really crazy and frizzy in the morning," says Sophia. "So every morning it would be like that, and I would sketch about it. And I thought I might as well make it into a book."Now that it's published, she's decided to donate all the money from sales to the Dana Farber Cancer Institute in Boston.Namazy picked that location because it's where her twin brother, Max, goes every year for treatment.Max has a rare blood disorder called Schwachman-Diamond syndrome. His body doesn't produce enough white blood cells."I want other kids to know they're not alone, and they're not going through this alone," Sophia says."I'm really proud of Sophia, writing a book," says Max. "It just makes me happy that she's writing a book for me, to me, and helping support the cancer institute."Their mother, Jennifer Namazy, says the book has helped the family support each other."It's very emotional, but it really helps us all think about how a medical disorder in a family can affect everybody," she says. "We're taking what could be negative and making it a positive and helping other kids. That is really the most important message."The book is available on Amazon. 1545

SAN DIEGO (KGTV) -- A woman died and her son was hospitalized after a shooting at a Linda Vista home early Monday morning.According to San Diego police, officers were called to the 2200 block of Crandall Drive at around 3:15 a.m. in response to a report of gunfire in a home.Officers arrived to find a male and female down with gunshot wounds to their upper bodies.The victims were taken to the hospital, but the woman -- identified by police as a 46-year-old Vietnamese female -- died from her injuries.The injured man -- described by police as a 28-year-old Vietnamese male -- is on life support, but police noted that he is not expected to survive his injuries.Police said they were not actively searching for a suspect, as they believe one of the victims was the shooter. 783
