A federal judge ruled Monday Pennsylvania’s Governor Tom Wolf’s COVID-19 pandemic restrictions are unconstitutional.Four counties in the state filed a lawsuit claiming the governor’s orders closing non-life-sustaining businesses and limiting outdoor gatherings, and stay-at-home orders were unconstitutional. They stated the orders were "arbitrary, capricious and interfered with the concept of 'ordered liberty' as protected by the Fourteenth Amendment."Plaintiffs included hair salons, a drive-in theater, other businesses, as well as state representatives and congressman Mike Kelly.In his ruling, the judge says the governor’s actions likely had good intentions, “to protect Pennsylvanians from the virus," but that "even in an emergency, the authority of government is not unfettered."U.S. District Judge William Stickman IV ruling reads, “"(1) that the congregate gathering limits imposed by defendants' mitigation orders violate the right of assembly enshrined in the First Amendment; (2) that the stay-at-home and business closure components of defendants' orders violate the due process clause of the Fourteenth Amendment; and (3) that the business closure components of Defendants' orders violate the Equal Protection Clause of the Fourteenth Amendment."In his written opinion, Judge Stickman continued his explanation of his ruling."There is no question that this country has faced, and will face, emergencies of every sort. But the solution to a national crisis can never be permitted to supersede the commitment to individual liberty that stands as the foundation of the American experiment. The constitution cannot accept the concept of a 'new normal' where the basic liberties of the people can be subordinated to open-ended emergency mitigation measures,” Stickman wrote."Rather, the Constitution sets certain lines that may not be crossed, even in an emergency. Actions taken by defendants crossed those lines. It is the duty of the court to declare those actions unconstitutional." 2007

A former Texas police officer was sentenced to 15 years in prison Wednesday for the shooting death of an unarmed black teen last year in the Dallas suburbs.A jury convicted former Balch Springs Officer Roy Oliver, 38, of murder on Tuesday for killing 15-year-old Jordan Edwards. A former student and three current students have been arrested and charged for their involvement in a prank that sent a student riding a dirt bike down a hallway at GlenOak High School in Canton, Ohio.According to officials at the Stark County Jail, all four were arrested for taking part in the prank that allowed a student to zoom through the hall on a dirt bike. The prank sent the school into a lockdown.The school said the incident has raised security concerns. One person involved, Eloy Lopes, 18, isn't a student at the school anymore."Our staff at GlenOak acted swiftly in addressing the immediate safety concerns as a result of the prank," a school representative school said in an email.Lopes was criminally charged with inducing panic with a reckless disregard for others, according to the sheriff. The sheriff's report said he was charged with criminal trespassing because he is not a current student at GlenOak. According to authorities, he held a door open for the dirt bike rider. The three students involved, a 17-year-old male and two 18-year-old males, were also arrested and charged with inducing panic with a reckless disregard for others for their involvement in the prank, according to authorities.The school has not addressed the status of the three current students, nor has it said whether or not security policies will change moving forward. 1515

A Glendale, Arizona mother is speaking out after her daughter’s class was subject to an odd punishment. Brittany Trofy says her 7-year-old daughter and classmates were forced to walk in a circle on the Luke Elementary School playground last week as punishment. It was around noon that day and temperatures were likely in the high 90’s or even warmer.Trofy claims the march lasted anywhere from 20 to 30 minutes. She says her daughter told her about the punishment when she came home that day.According to Trofy’s daughter, several kids complained of headaches and cramps. "The school stripped me of my right to nurture my child when she didn't feel good by not letting me know she didn't feel good,” Trofy said. The Dysart Unified School District confirmed to KNXV that they are reviewing the teacher’s actions that day. We’re told that the practice is not “district approved.” However, a spokesperson says it only lasted around five minutes. Students were checked by a school nurse and none displayed any signs of heat exhaustion. The Dysart Unified School District would not elaborate if the teacher would be facing punishment or has a history of questionable decision making. A spokesperson told us they cannot discuss personnel matters. "My daughter is right now scared to go back to school for fear of seeing the teacher that got frustrated with them,” Trofy said. A police officer was informed of the incident.
