SAN DIEGO (KGTV) - A former Yuma Police officer testified Tuesday in his trial for the rape of a woman in Kensington.Jared Elkins, 34, raped his wife’s cousin after a family gathering at her home on Marlborough Drive last year, prosecutors said. The group had been out to dinner, then watched a movie while drinking beer and wine at home.She testified last week, saying she didn’t yell during the alleged attack because Elkins threatened to kill her. His wife was asleep across the hall at the time.After the encounter, the woman said she ran into her mother’s room for help, and they both escaped out a window.At a hospital, the alleged victim's blood-alcohol level was determined to be .09 percent, according to witness testimony.Police said Elkins told them that the sex was consensual and the rape charges were made out of guilt.Elkins told the jury the alleged victim started flirting with him after everyone else went to sleep.“There was mutual flirtations between the two of us and we were being adults,” said Elkins, who testified the woman was “cuddling, almost snuggling” with him.“She said yeah, it was surprising to me; I was excited a younger attractive woman, you know, it kind of confirmed everything on the couch,” Elkins said.Elkins resigned from the Yuma Police Department in 2017. He is facing nine felony counts including forcible rape and could serve 14 years in prison if convicted.City News Service contributed to this report. 1462

SAN DIEGO (KGTV) — A group of Brightwood employees have sued the for-profit’s parent company, alleging they did not receive the legally required 60-days notice before the school abruptly shut down Wednesday.The suit, filed in Delaware, location of Educational Corporation of America, says the company violated the Worker Adjustment and Retraining Notification Act. SAN DIEGO (KGTV) - A 13-year-old Tierrasanta boy is battling for his life after family members say he was diagnosed with bacterial meningitis.A week ago Sunday, Grant Eyles started throwing up while his mother drove him and his siblings back from Los Angeles.  He quickly developed a fever, but didn't get worse until Thursday, when he lost mobility on his right side and became confused.His mother says a battery of tests pointed to bacterial meningitis, where membranes around the brain and spinal cord become inflamed, and it started with a common ailment."It was a complication essentially from a sinus infection.  The infection breached the sinus cavity and went into the brain," said family friend Vanessa Bredehoft.Over the weekend, seizures forced doctors to place Grant in a medically induced coma.  Grant remains in critical condition.County health officials say many strains of bacterial meningitis do not require an alert for person-to-person prevention, and this appears to be one of those cases.A fundraiser dubbed "Dance for Grant" is scheduled for March 3rd from 8 a.m. to 11 a.m. at Studio K Dance and Fitness.A Gofundme campaign has been set up to help with the family's expenses. 1221

SAN DIEGO (KGTV) -- A fire destroyed an abandoned building in Barrio Logan early Wednesday morning, but no injuries were reported.According to the San Diego Fire-Rescue Department, crews were called to the structure fire in the 3500 block of Dalbergia Street at around 2:50 a.m.By the time firefighters arrived, the flames had already consumed much of the building. It took at least an hour to stop the fire from spreading.A deputy fire chief at the scene told 10News that crews have battled fires at this same address multiple times in the past.10News learned a fire occurred at the same location on April 14, and before that on Dec. 26, 2019.Additionally, on Oct. 25, 2019, a fire erupted inside of the same building; a trash can fire was reported on the property six days earlier.The cause of Wednesday’s fire is under investigation, and there is no immediate word on whether the fire is somehow connected to any of the previous incidents. No injuries were reported in any of those incidents.No one was inside at the time of Wednesday's fire. 1053
