The filing made Tuesday largely focuses on what Cosby believes was a binding promise from a district attorney that he wouldn't be charged in the case. A spokeswoman for the Montgomery County district attorney's office isn't commenting but says prosecutors will file a response within a month. PHOENIX, Arizona — A Phoenix-based American Airlines flight attendant was sentenced to five years of probation for taking videos of men and boys using public restrooms. Special Agents with ICE’s Homeland Security Investigations (HSI) say that on December 30, 2017, they detained Gordon Harold Nobriga, 50, as he was trying to leave the country through El Paso, Texas. Officials searched Nobriga's cell phone and found "numerous videos of men and boys using a public restroom." Investigators say the videos appeared they were produced through a 'peephole' in a bathroom stall. When questioned about the videos, Nobriga reportedly told HSI that the videos were produced in a store, but he refused to give the store's location. Since Nobriga is from Phoenix, the phone was sent to the Homeland Security Office in Phoenix where investigators were able to determine that the videos came from a Walmart store in Phoenix. They say surveillance video from the store shows Nobriga entering the bathroom several times over a two-month period and spending hours in the bathroom each time he went in. Investigators were able to identify two victims, a man, and a 14-year-old boy, both who do not know Nobriga. Nobriga was arrested on May 25 at Sky Harbor Airport as he exited a flight. On August 16 of this year, Nobriga pleaded guilty to two counts of attempted voyeurism and was sentenced to five years of supervised probation. Nobriga said he's been a flight attendant with American Airlines for sixteen years. Nobriga allegedly admitted to taking the videos, but he denies any distribution of them. He's was initially charged with 11 counts of voyeurism. American Airlines sent this statement at the time of Nobriga’s arrest: “We take this matter very seriously and have been cooperating with law enforcement throughout their investigation. Since this case is a pending criminal matter, we must refer all questions to Homeland Security Investigations (HSI) and the U.S. Attorney’s Office in Phoenix.” 2070

  

PALM BEACH GARDENS, Florida — A heroic act caught on video.A baby nearly choked to death at a Florida mall but quick-thinking officers who just happened to be nearby stepped up to save her life. The incident unfolded nearly two weeks ago. One-year old Lucia Graham was rescued by two Palm Beach Gardens, Florida officers who happened to be eating lunch nearby when she started choking."They were there for a reason and that reason was to save her life," said Ana Jaramillo de Graham, Lucia's mother.In the surveillance video, Jaramillo de Graham can be seen with her two kids, including Lucia's toddler brother, enjoying Kid's Day at Palm Beach Gardens Mall."We got hungry, and like we always do, we went to Chick-fil-A," she said.Lucia then started choking on a chicken nugget."She looked at me with her eyes wide open. She tried to do something with her mouth — she couldn't cough, couldn't do anything," said Jaramillo de Graham.The mother tried a technique taught to her by her pediatrician, which involved sharp blows to the baby's back to dislodge the object. She said in a panic she must not have been performing the technique hard enough, so she started screaming for help.Officer Robert Ayala and Officer Rafael Guadelupe rushed over right away."Officer Ayala stepped in, I handed her to him. He sat down and so quickly started performing what he needed to do to make sure she was OK. And I sat on the floor panicked. I just wanted to make sure she was OK," she said.Finally, the chicken was removed and Lucia was able to breathe again."They're our heroes. They are the best, best angels we could've had that day at the mall," Jaramillo de Graham said.Lucia was immediately checked by EMT staff at the mall. Despite the close call, baby Lucia is 100 percent healthy."They knew exactly what to do to save her life," Lucia's mother said. "So, thank you so much officers because if it wasn't for you guys, we probably, definitely wouldn't be here with our Lucia."Jaramillo de Graham recommends all parents take classes so they can properly administer CPR or life saving techniques to children if they are choking.On Thursday night, those officers were honored by city council and Lucia's parents. 2260

  

OTAY MESA, Calif. (KGTV) -- The piercing sound of a high-powered drill could be heard coming from the Otay Mesa border wall prototypes Tuesday morning. Journalist Jorge Neito captured the images from a neighborhood in Tijuana. Construction workers could be seen drilling more than a dozen holes into the concrete barriers.Customs and Border Protection officials confirmed to 10News last week that the prototypes were coming down to make space for a secondary border fence. That fence will strech 14 miles from the beach to Otay Mountain. Officials never specified when the prototype demolition would happen.The prototypes are 30 feet high and were built in last September of 2017. President Trump toured the barriers in 2018. Out of the eight designs there wasn't one specifically picked for the border wall. "There was never an intent to pick one and copy that along the entire U.S. border. The entire concept literally was how can we do this better," San Diego Sector Border Patrol Chief Rodney Scott told 10News in 2018. "But we're not picking one of these walls over the other walls, and we never planned on doing that. So, depending on the terrain or the environment, it could be any one of these? Correct."10News reached out to Border Patrol locally to find out if today's work is part of the prototypes' demolition and a spokesperson referred us to Washington D.C., so far we have not heard back. 1413
