San Diego will seek to invalidate its landmark pension law, a citizens' initiative 65 percent of voters approved in 2012.The City Council voted 6-3 Monday to go to court to invalidate 2012's Proposition B, which switched most new hires from a pension to a 401(k) style plan. The decision came after multiple courts ruled the city skipped a key step in the campaign. The courts said then-Mayor Jerry Sanders' involvement meant the city needed to meet and confer with unions, but didn't. The courts required the city to make employees whole plus a seven percent penalty, but didn't invalidate the law. The city will now to go to court along side its employee associations to get it off the books. "It's illogical for the city to believe that having broken the law in order to get Prop B into the charter that you should be allowed to keep it in there," said attorney Ann Smith, representing the Municipal Employees Association. Firefighter John Hernandez II said he's seen a number of his colleagues leave for other departments, which offer better benefits - namely a pension."In my line of work, we can't work as long as most people, and that's why we need pensions," he said. But Councilman Scott Sherman, who voted to protect Prop B, said ultimately going back to pensions could cripple the city. "Every single year we make a 0 million minimum payment on our pension debt from the old system that too us to that point, and now they're asking us to go right back to that system," he said.Sherman said it's low unemployment, not a lack of benefits, leading to the city's worker retention issues. (KGTV) - A couple in San Diego are spending the holiday telling everyone they know to register as an organ donor."People don't like to talk about their death, but rather than bury these organs or burn them up, you can save lives," says Nancy Marlin, who is recovering from a kidney transplant.Marlin had a genetic kidney disease and would have needed dialysis if not for the donation. Her new kidney came from a co-worker."I was so fortunate," says says. "Someone gave me the most amazing gift."It's a gift her family knows well. Marlin's husband, Fred Kolkhorst, had a heart transplant just 18 months ago after being diagnoses with heart failure."It changes you immensely in ways that are difficult to describe," he says.Kolkhorst and Marlin are rare in that they're a married couple who have both received donated organs. Sharp Memorial Hospital Transplant Coordinator Tammy Wright says she can't think of any couples in her 25 years in the field.Wright says the holidays are the perfect time for families to talk about their wishes in regards to organ donations."It's a time of giving," she says. "The simple thing is to tell your family what your wishes are. SAN DIEGO, Calif. (KGTV) - Assemblywoman Lorena Gonzalez announced she will introduce two new housing bills in the state assembly this week.One of them aims to prohibit developers from separating affordable housing units from market rate units in the same building.The bill came in response to a fight last summer between Canadian developer, Pinnacle and Civic San Diego, the city agency that was responsible for overseeing design approval.Pinnacle had submitted plans for a building on 11th Avenue between A & B Streets. The main tower was 32 stories tall and would be available at market rates. The tower was attached to an eight-story building that would house 58 affordable units, in order to satisfy the density bonus granted to Pinnacle for this and two other projects in the area.But Civic San Diego rejected the plan on the grounds that the affordable housing units had a separate entrance and restricted access to amenities in the 32-story tower, including the pool.“We can’t create a system that allows developers to separate out folks,” said Gonzalez at a press conference on Monday.A draft summary of the bill, AB 2344, stated it will “prohibit the owner or agent of an owner from isolation the affordable housing units within that structure to a specific floor or area within the structure.”After Civic San Diego rejected the proposal from Pinnacle, the developer came back with a new plan that eliminated the eight-story affordable housing section entirely. SAN FRANCISCO — Verizon is joining an escalating movement to siphon advertising away from Facebook in an effort to pressure the company into doing more to prevent racist and violent information from being shared on its social networking service.The decision announced Thursday by one of the world's biggest telecommunications companies is part of a boycott organized by civil rights and other advocacy groups under the rallying cry of "#StopHateforProfit."The NAACP and the ADL are among the organizations behind the movement.The protest was spurred by last month's killing of George Floyd by Minneapolis police.Facebook says it is in talks with the boycott organizers in an effort to become a "force for good."Verizon is by far the largest company to join the movement. SAN DIEGO (KGTV)-- As of today, it is illegal to live in your car in the city of San Diego. This controversial law took effect right after yesterday night's City Council vote. Homeowners in many San Diego neighborhoods said it is about some regulation is enforced. But homeless advocates called it a human rights violation. 10News met with two "van-lifers," as they called themselves. One of them was 39-year-old Jason Thorwegen. He said he is a Southern California native, who has been homeless since childhood."I started being homeless at the age of 8 years old," Thorwegen said. He admitted, it has not been easy, and that he is not perfect. But he never thought he would be in trouble, while trying to stay out of trouble, inside his van. Tuesday night, San Diego City Council approved the updated the Vehicle Habitation Ordinance, after residents complained about health and safety. "People who live in my neighborhood are defecating and urinating on the street, I see it. and I live it," one lady said at the Council meeting Tuesday.RELATED: San Diego City Council passes restrictions on living in vehiclesStarting Wednesday, living in a vehicle is illegal on city streets between 9 pm and 6 am unless parked in a designated Safe Parking Zone. "It's kind of disheartening, to be honest, to see that it's not as comprehensive as it could have should have been," Teresa Smith said. Smith runs the non-profit organization, "Dreams For Change," which provides 60 safe parking spaces throughout the city. The city currently has 120 spaces, with plans to offer more this year. "Even though as much as they try to say it was not around criminalization, I do not see how it is not," Smith said.10News also spoke to "van-lifer," Maria Ennis. She plans to get the ACLU on her side, to fight that the untimely law, is a human rights violation. "If they are making more parking lots, why don't they make the parking lots first? And then try to make that law?" Ennis asked.Thorwegen said the new lots would not change his lifestyle."I have anxieties that prevent me from living inside," Thorwegen said. He said he has non-combat-related PTSD and other illnesses. That is why started "Van for a Plan."The Go-Fund-me campaign asks people to donate old vans. He then converts them to be provided to clean, homeless veterans. "We want them to do the work, and that way, they can earn the vans," Thrrwegen said. He is working on his second van now. But now with this new ordinance, he is worried his efforts will become mute."What didn't help was when people made it illegal for me to be. You know, illegal for me, to be," Thorwegen said.The city said officers would first have to be trained about the new ordinance before issuing tickets. But Smith anticipated people would likely find other ways to avoid the consequences."So one of the issues we suspect is going to start, is people will start moving right outside the city limits. So the surrounding communities will start seeing the impact of the city ordinance," Smith said. 3028
