SAN DIEGO (KGTV) -- The Sweetwater Union High School District Board of Trustees on Thursday responded to a scathing audit that alleged evidence of fraud or misappropriation of funds leading to a multi-million dollar deficit.In their response to the audit, the district’s Board of Trustees acknowledged the importance of an independent state agency’s audit and said they “intend to cooperate fully with these agencies should they require additional information.”“We acknowledge that, as required, you notified the local district attorney, State Superintendent of Public Instruction, and State Controller that the FCMAT AB 139 report found there is sufficient evidence to demonstrate that fraud, misappropriation of funds, or other illegal fiscal activities may have occurred," the Board of Trustees said."We understand the importance of having these agencies review the report and intend to cooperate fully with these agencies should they require additional information," said the board.The 79-page audit, conducted by the independent state agency Fiscal Crisis Management Assistance Team (FCMAT), was made public June 22. According to the report, the district’s school board relied on inaccurate financial information when they approved salary increases for district employees, resulting in pay raises they could not afford.The audit also reportedly found the district kept borrowing from capital projects in the South Bay, such as Mello-Roos funds, to pay for operations without a method of repaying that money back into the fund.The board said that individuals and outside entities identified by FCMAT as having enough evidence to suggest they were engaged in illegal acts are "either no longer employed by the District or are removed from all involvement in the District’s current operations."RELATED: SUHSD: 90 bus drivers paid over 0K in overtime during 2017, database saysThe board also said that since the audit, they’ve taken other actions based on recommendations from the FCMAT, including:The district will be implementing the INFOR financial module in the 12 to 18 months. The new system replaces the one the FMCAT said said led to accounting errors and will interface with the County Office of Education for monitoring.The District will provide Board and leadership training to enhance awareness of fraud, including detection and prevention. An anonymous hotline for reporting fraud will continue to be available internally and to the public.The District staff will ensure that the Board and County receive updates on the progress to address the recommendations set forth in this report.“As a Board and as acting superintendent, we are committed to ensuring we implement and improve our systems and supports to best serve our community and understand that this process starts with the superintendent and the Board,” said the board.The response was signed by current trustees Nicholas Segura, Board Vice President; Arturo Solis, Board Member; Paula Hall, Board Member; Kevin J. The board also voted 4-1 to place its beleaguered superintendent Dr. Karen Janney on paid administrative leave.Janney had been under public pressure to step down following a multi-million dollar budget shortfall in 2018 which prompted an investigation. Since then, the district's budget crisis spiraled into teachers and programs being cut, bus routes eliminated, and increased class sizes. The board previously said its action against Janney is not disciplinary but it is to support and ensure an efficient investigation of the concerns raised in the FCMAT audit.With the release of the FCMAT audit, it will be up to the District Attorney, State Superintendent of Public Instruction, and State Controller to determine if fraud did in fact occur within the Sweetwater District.The San Diego County District Attorney's office said they are reviewing the audit. There is also an investigation into the district by the Securities and Exchange Commission. SAN DIEGO (KGTV) -- The retrial began Thursday for Constantino Banda Acosta, the man prosecutors say was drunk and angry from a fight when he caused a hit-and-run crash that severely injured a 6-year-old returning from a family trip to Disneyland. The jury was deadlocked Thursday on whether or not Banda was even at the wheel. Throughout the trial, Banda sat quietly in the courtroom and could be seen smiling at the jury as attorneys laid out their case.The central question in the retrial is whether Banda or an employee of his construction company, Jorge Adame Ariza, was the one driving.RELATED: Verdict reached in trial for driver accused in hit-and-run crash that injured boyAriza was captured in security footage driving the truck from a restaurant where the two men were drinking.Ariza claims he turned the wheel over to Banda before the accident happened, which severely injured 6-year-old Lennox Lake of San Ysidro. Authorities say Banda had also been deported at least 17 times before the crash.Prosecution in the case say the two men were heatedly searching for a man who beat up Banda. SAN DIEGO (KGTV) -- The San Diego County Sheriff’s Department is warning residents about drinking and driving ahead of the busy Fourth of July holiday weekend.The department says it will be conducting increased DUI patrols on Saturday, July 4 and over the course of the weekend.The department also plans to hold an impaired driving checkpoint in North County Friday night.Last year, deputies arrested more than 1,300 people for impaired driving. So far in 2020, 387 drivers have been arrested for driving under the influence, the department says. "No one should ever drive under the influence," said Sheriff Bill Gore. "Throughout the pandemic, deputies have continued to enforce impaired driving laws. Don't drink and drive." 734

SAN DIEGO (KGTV) - There is a memorial of candles, notes, and flowers along 4th Avenue near Main Street in Chula Vista.They are in memory of 23-year-old Christina Garcia, who was found dead at a nearby field on Aug. 5th. Chula Vista police say they were called out to 3100 block of Main Street after someone found her body. They say she had an apparent gunshot wound and opened a homicide case.“That afternoon, she wanted to see her daughter and pick up the truck, so it was a brief encounter,” her mother, Lisa Garcia, said. “I expected her to come back, and I wish I took advantage of that situation longer.”Lisa says Christina leaves behind a two-year-old daughter.“I think the saddest thing for me is that her daughter is only going to know her through pictures because she’s so young,” She said. “She’s never going to remember her mom’s touch, her kiss, her voice.”Lisa says her daughter was very likable and smart.“She tested out in the 10th grade and started southwestern college and finished her classes there,” Lisa said. She was also a skilled welder and liked working with her hands. Most recently, they bought a home and worked on remodeling it.“She’s very hands-on, like her mom,” Lisa said, “you know, taking the popcorn ceiling down, remodeling the walls.”She says it’s been tough knowing Christina’s killer has not been caught. Lisa says she has many questions and is cannot find any closure without finding answers.“Was she dumped there? Was she shot there?
