Three Democratic senators on Monday filed a lawsuit challenging the appointment of acting Attorney General Matt Whitaker, ratcheting up the court effort to declare his placement atop the Justice Department as unconstitutional.Sens. His appointment leap-frogged Deputy Attorney General Rod Rosenstein, which also gave Whitaker control over the Mueller investigation that had previously been supervised by Rosenstein.Democrats had previously urged Whitaker to recuse himself from supervising the Mueller investigation, in addition to questioning the constitutionality of his appointment.Last week, the Justice Department issued a memo defending Whitaker's appointment, concluding that it was legally justified under the Vacancies Reform Act because it's a temporary appointment and "he had been serving in the Department of Justice at a sufficiently senior pay level for over a year."The Senate Democrats' lawsuit, however, argues that his appointment is unconstitutional under the Constitution's Appointments Clause requiring Senate confirmation of high-level federal appointees.In addition to the lawsuit filed Monday, Maryland's attorney general filed suit last week asking a federal judge to replace Whitaker with Rosenstein. Attorney Tom Goldstein, who is representing Maryland in that case, also filed a separate motion asking the Supreme Court to declare Rosenstein as acting attorney general.Whitaker has also come under scrutiny from House Democrats, who will take control of the chamber in January. There's a new program aimed at helping Black and Latinx students succeed.The Equity in Education Initiative was built through a partnership between Walmart and North Carolina A&T State University.The program acknowledges many of these students start at a disadvantage, because they go through under-funded school districts.“These students are coming in sometimes with academic gaps that are due to no fault of their own. It's not a difference in ability, it's just a difference in their zip code,” said Kevin James, Dean of the Deese College of Business and Economics at North Carolina A&T.The program is broken up into four focus areas, addressing specific needs of different students. They include financial resources and mentorship while in school, and then network building to create career opportunities their white counterparts may already have.“So many people actually obtain their jobs through networks, because they know someone who knows someone, and many of these students, most of them come in without those built in networks and their families don't have those networks,” said James.The hope is that the positive effects of the program will extend outside of school, allowing successful students to invest and give back.“It's not just about the impact on the student. It's about multi-generational impact on families and about extending those impacts into communities that often times have been under resourced,” said James.Some parts of the program, like the Black Male Initiative, will make resources automatically available to students.There will be an application process for the Leadership Cohort and scholarships.The program starts early next year. 1683

Ticketmaster is reportedly exploring ways for concertgoers to return to shows safely amid the coronavirus pandemic.According to Billboard, one way is to verify that they've been vaccinated or tested negative for the virus before attending a show.The ticket-selling company said they'd set up a way for the customers' test results to be sent to third-party health companies. Through its digital app, Ticketmaster would tie those test results or vaccination status to a ticket digitally that'd be used to enter events, Ticketmaster president Mark Yovich told the outlet.According to Yovich, concertgoers would be required to get tested approximately 24 to 72 hours before a show.Billboard reported that Ticketmaster would not have access to users' medical records nor store their results or medical information.The company added that they'd only receive notification that fans have been OK'd to attend an event on a specific date. 936

TONGANOXIE, Kan. -- A small piece of fabric kept near a classroom door could help protect students in the event of an active shooter. It was three months ago that kindergarten teacher Tiffany Parker was sitting on her living room floor cutting up a fire hose. "One fire hose makes about 100-110 sections, and I had three hoses donated," said Parker, who teaches at Tonganoxie Elementary School in Kansas.Parker used to be the volleyball coach at Tonganoxie High School. She would use old fire hoses to line her practice drills. Now, the fire hose is keeping her classroom safe and secure when it's not just a drill. "We've always done the typical, you know, cover your window, lock your door, move away, but that never seemed to give us enough security," said Parker. On February 14, 2018, 17 students were killed in a school shooting in Parkland, Florida. "You know, seeing my kids' faces when they were first told, 'OK, if somebody comes in, here's what we're going to do,' before I had the Safety Sleeve, and they were still a little fearful," said Parker. Now, in her classroom of 21 students, Parker keeps the 6-inch piece of fire hose hanging by a magnet near the top of her classroom door. In a matter of seconds, the "Safety Sleeve" can be in place."All you do with it is you place it over the door hanger arm, as far as it will go and then they can't get in the door, it won't open," said Parker. The day after the Parkland shooting, Parker brought the Safety Sleeve into her classroom at Tonganoxie Elementary School. After showing her students how it works, Parker said her students felt more secure. "There was such a sense of relief and a sense of security by my kids and a sense of, 'OK, this isn't going to be it,'" said Parker. Parker presented the DIY device to her school principal. Now, she's made hundreds of them for the entire Tonganoxie School District. While she's created a low-cost safety device, Parker said she has no plans to make any money off of the Safety Sleeve. "So many people have asked me, 'Are you going to patent it? You should sell it.' I am not looking to make a dime on kids' lives," said Parker. California, Ohio and South Dakota have already picked up on the idea.
