SAN DIEGO (KGTV) -- A La Jolla store in an upscale mall is facing scrutiny from customers who told Team 10 they were misled after buying hundreds—even thousands—of dollars worth of skin care products.Team 10 spoke to at least two customers who had similar complaints. When they tried to return unopened products, they said they were sold lies.Christianna Ortiz regrets walking into Gold Elements at the UTC mall on La Jolla Village Drive.“I’m honestly very embarrassed I fell for it,” Ortiz said.Last summer, she said Gold Elements employees encouraged her to purchase products, including a skin care regiment.“He wanted me to buy it for 0. I said yeah, that's not going to work. He said I'll tell you what, I'll throw in a facial and I was like, now that sounds interesting, but I don't want to come here alone. I'll throw in two facials,” Ortiz said the employee told her.When she went to her appointment, she said employees would not give her the facials she paid for.“I said, I want to return the stuff then and he said no return.I said I paid for something that was an outright lie,” Ortiz said.Ortiz said they never told her there was a no refund policy.She disputed the charge with her credit card and could not believe what happened next.“They sent me back the copy of my receipt along with another sheet of paper that listed the refund policy. I had never seen that sheet of paper, didn't exist!” Ortiz said.“You’re hustled,” said Sharon Garrow, another Gold Elements customer.Garrow spent nearly ,500 on products in September. She admits spending more than she should. When she tried to return the products the following morning—less than 24 hours later—she said she was not allowed to.She went to the store Saturday, where she said an employee told her there was nobody who could help her. She went again on Monday. “He [said] there’s no return on [these] products,” Garrow said.It was on her receipt, but like Ortiz, she signed on a computer and said the policy was not visible on the screen. She said nobody told her anything in person and there were no signs in the store that customers could see.A Team 10 investigative photojournalist also visited the store. He also did not see any return policies in the store.On the California Attorney General’s website, it says: “Stores that do not accept returns must clearly display their policy.”The California Civil code states that retail sellers shall display their policy “either on signs posted at each cash register and sales counter, at each public entrance, on tags attached to each item sold under that policy, or on the retail seller’s order form, if any.”Goods that cannot be resold due to “health considerations” are an exception. Both women said they never opened the Gold Elements boxes before trying to return the items.When Team 10 visited the store to get answers, there were no managers available to talk to us. An independent esthetician told Team 10 to contact a Gold Elements promoter. That person did not call back.Less than an hour later, a man who claimed he was the owner called Team 10 and said they always give the best help to customers and have not had problems with refunds. The man would not agree to an in-person interview, saying that he was not in town.He told Team 10 all future communication would be with his lawyer, but would not give his lawyer’s name.It was a different story on the Better Business Bureau website, where the store has an F rating. A 2017 class action lawsuit filed in Northern California against Gold Elements products and affiliated companies.Part of the complaint was that “complimentary facials” were not honored when customers tried to use them.““If I got taken, so many other people are probably getting taken. Somebody has to stop it,” Ortiz said.Team 10 discovered the La Jolla store could also be violating different state code.On Gold Elements’ wall is a price list for facials. The Board of Barbering and Cosmetology, under the California State Department of Consumer Affairs, said a business that charges for facials should have an establishment license.The store has no record of that license.The women have a warning for others.“It’s not like I’m a dummy,” Ortiz said. “Do what I usually do. Check reviews ahead of time.”The Attorney General’s office said if any customers have concerns about a return policy, or lack of one, you can file a complaint with their office. 4419
SAN DIEGO (KGTV) - A San Carlos woman's trip to the San Carlos library turned into nightmare after she was bitten by a dog.A large bruise and two puncture marks remain stamped on Tricia Erler's left thigh."I was in total shock," said Erler.On Tuesday afternoon, she had just finished a mind-and-body class inside the library, grabbed some magazines, and was headed into a lounge area to read."I was behind this woman's chair, and she got up abruptly and swung around in one movement ... she sort of fell into me, and I fell into the books. I felt a stabbing pain in my leg. I thought something had stabbed me from her backpack," said Erler.RELATED: Service dog or pet? You're bleeding and there are teeth marks on your leg," said Erler.Nearby, she saw what bit her: a leashed white dog, possibly an Australian Shepard, with black markings on its head. Next to the dog was the woman who had bumped into her. She was in her 20s or 30s with a stocky build. The woman walked out and never came back."I was upset and shaking. You would think you'd be totally safe in a public library," said Erler.Erler just received her second of four shots for a rabies regimen. Definitely feel dogs should be checked," said Erler.Under federal law, dog owners can be asked if the animal is a service dog, but can't be asked for documentation. A city spokesperson says their policy is to ask every animal that enters a library. SAN DIEGO (KGTV) -- A heat advisory went into effect Saturday morning for a large swath of San Diego County as temperatures are expected to soar this weekend.According to the National Weather Service, the advisory started at 10 a.m. and lasts through 8 p.m. Sunday. The agency says temperatures in the San Diego County mountains are expected to reach up to 100 degrees.Further east, an excessive heat warning also went into effect at 10 a.m. Saturday through 8 p.m. Monday for the San Diego County deserts. Forecasters say temperatures there could reach 114 to 118 degrees in the deserts.RELATED: Check your local forecastBy 1 p.m. Saturday, Ramona reached 101 degrees, passing a previous record of 100 set in 1983, according to the National Weather Service. SAN DIEGO (KGTV) - A Mesa College professor has pulled thousands of World War II-era letters out of the archives at San Diego State University and written a new book highlighting the Aztecs' contributions to the war effort."No Forgotten Fronts" tells the story of Dr. Loren Post, a professor at SDSU during the war. He asked students to write him letters so he could keep in touch. He then took their letters and created "The Aztec News Letter" so students and families could keep in touch with each other during the war."The letters are very compelling," said Lisa Shapiro, who wrote the book. "They're inspirational and emotional."As a professor at Mesa College, Shapiro wanted a way to understand what some of her Veteran students had gone through. She heard about the letters and started reading them."Once I started, I couldn't stop," she said. "Little by little, what happens is you start to find the stories."Shapiro decided to turn those stories into a book, so more people could learn about the contributions SDSU students made during the war."That was the promise that Dr. Post made," she said. "No one would ever be forgotten."Shapiro said the newsletters that Dr. Post wrote became must-reads around campus. Over time they evolved from simple type-written pages to full-fledged publications."He didn't sugar-coat things," said Shapiro, noting that the newsletters had information about who had died, went missing or been injured. But they also had good news from campus to keep the soldiers connected to their home."By taking their words and sending them back out and showing them they weren't forgotten, this one professor made such an incredible difference in the lives of his students."Shapiro also noted that, through the letters, you get an excellent history of the entire war."You have eyewitness accounts of battles, this is what it feels like to jump out of an airplane. And you have these very touching, moving letters where people talk about grief."The book, "No Forgotten Fronts," is published by the Naval Institute Press and is available online and in stores around San Diego. SAN DIEGO (KGTV) — A local woman is suing the Greyhound bus company after an unscheduled stop allowed border agents to come on the bus and question the citizenship of passengers. Rocio Cordova was traveling from San Diego to Phoenix in November 2017 when her bus was stopped.Her lawyer, Darren Robbins, tells 10News, “Well this practice was brought to our attention and our client was one of the people subjected to these warrantless searches conducted without probable cause.”RELATED: 'Minutemen' wants troops at border gaps near CampoHe continued to say these immigration raids have been happening on multiple different Greyhound buses. Cordova is accusing Greyhound of violating state consumer protection laws by allegedly consenting to racial profiling by law enforcement officers. Cordova is a United States citizen, however, watched people on the bus around her questioned based on their race, according to her lawyer, “it is highly invasive and inappropriate to facilitate such action of law enforcement officials against its own passengers”. The complaint was served to Greyhound on Friday.Robbins is now waiting for their response, “the best response would be they'll refrain from any additional illegal behavior and stop allowing this kind of warrantless searches to take place on greyhound facilities or Greyhound buses,” he tells 10News. 1388
