VISTA, CA (KGTV) — The man accused of intentionally driving a U-Haul van into a crowd of people outside of an Encinitas bar, pleaded not guilty to serious charges in a Vista courtroom Wednesday.Christian Davis, 28, stood next to an attorney with his head down as he was formally charged with two counts of attempted premeditated murder, three counts of assault with a deadly weapon, and one count of felony driving under the influence of alcohol.Deputy District Attorney, Kim Coulter, said the incident early Sunday morning started at the Saloon and Shelter bar when Davis was kicked out.RELATED: Video shows driver slamming into crowd outside Encinitas bar"He was asked to leave because he was highly intoxicated and it was time for him to go," said Coulter.Once he was kicked out, Coulter said he got into a verbal argument with two bouncers, then threatened them."It escalated and culminated with Davis telling the security guards 'you're going to regret doing this, I’m going to come back and I’m going to kill you,'" she said.Moments later, witnesses saw the U-Haul heading for a crowd of people standing outside of the bars.RELATED: Man arrested after driving into crowd outside Encinitas barThe incident was captured on a passerby's dash cam video."He reversed out of a 7-Eleven and he came barreling down a sidewalk in front of Shelter bar, right into a crowd of people," said Coulter. "It’s our position that he used the U-Haul passenger van as a deadly weapon."Good Samaritans rushed to hold Davis in place until deputies arrived and arrested him. Sadly, two men who were outside of the bar at the wrong time were seriously hurt."A 25-year-old victim has had a severe injury to his leg, he’s had his third surgery today," said Coulter.The other victim, a 24-year-old, was also left hospitalized with severe injuries."He has two collapsed lungs, fractured ribs, a broken arm and he did spend time in the ICU," she said.Bail was set at million. If Davis is released on bail, he will wear an alcohol monitoring bracelet.He is due in court for a preliminary hearing on March 17. 2095

VISTA (CNS) — A man who beat his mother to death with a claw hammer in their Escondido apartment last year was sentenced Wednesday to 26 years to life in state prison.David Noel McGee Jr., 26, was convicted in May of first-degree murder for killing 55-year-old Rebecca "Becky" Apodaca.Deputy District Attorney Keith Watanabe said Apodaca failed to log in for her at-home medical billing job on Feb. 1, 2017, and failed to respond to messages left by her supervisor, family and friends. Apodaca's adult daughter went by the victim's apartment on North Hickory Street about 6:30 p.m. and found her mother unconscious on her blood-soaked bed.RELATED: Son accused of killing mom with claw hammerThe defendant -- naked and covered in blood -- was found hiding in a closet. He had self-inflicted knife wounds on his wrists and forearms and a self-inflicted knife wound across his neck, Watanabe said. A bloody toaster was plugged in and was sitting on the bathroom sink and an empty bottle of Benadryl was found in the bathroom.Levels of an over-the-counter antihistamine found in Benadryl were so high in the defendant's blood that he could have ingested 100 or more 25mg pills, the prosecutor said.Deputy Public Defender Lindsay Itzhaki said McGee's attack on his mother happened "in a fog of Benadryl," and that there was a difference between "killing and murder."RELATED: Man arrested, accused of killing mother in Escondido apartmentAfter his release from the hospital, McGee told police that he was depressed and blamed his mother for bringing him into the world. VISTA, Calif. (KGTV) -- Jury selection is expected to take all week in the trial of former NFL tight end Kellen Winslow II. The San Diego football star and son of Chargers Hall of Famer Kellen Winslow Senior pleaded not guilty to charges that he raped two homeless women in Encinitas last year. He's also charged with raping an unconscious seventeen-year-old girl back when Winslow was nineteen. Prosecutors say he was out of custody on million bail in connection with the felony case when he got in trouble again. Prosecutors say he fondled himself in front of a 77- year-old woman at a Carlsbad gym, asked her if she liked it, and groped her while she was in a hot tub at the same gym.Jan Ronis is a San Diego defense attorney not affiliated with the case, but watching it closely. "From what I've seen at the preliminary examination, everyone that testified seemed to have a lot of credibility. These were older women, you would extend the greatest credibility to that kind of witness," said Ronis. Winslow played ten seasons with the NFL. His defense team is reportedly planning to call two psychiatrists to testify. It's unclear if CTE, or Chronic traumatic encephalopathy will play a role in that defense. Ronis says it might not make a difference. "You can still be responsible for your conduct , criminally responsible, after having sustained a traumatic brain injury or something of that nature. It's different than say, your mental health issue was such that rendered you incapable of understanding the nature of your conduct that you couldn't understand the difference between right and wrong, " said Ronis. (KGTV) — It was a heart-pounding moment at a North County gas station after a homeless woman gave birth inside the bathroom. “I just seen some lady come out with a baby saying 'we need help this lady just gave birth',” said clerk Alex Ascencio. Ascencio had just started his shift Wednesday when the woman came inside of the store. When Ascencio saw the baby, he jumped into action, tending to the baby and dialing 911. “I just sat her down and make sure she had a pulse and that she was breathing; she was perfectly fine.”Ascencio says the woman tried to leave the store without the baby, but he convinced her to stay until paramedics arrived. Ascencio says he aspires to be a paramedic and his co-workers are praising him for his quick thinking. 770

(KGTV) -- San Diego County Crime Stoppers along with investigators from the San Diego County Sheriff’s Department’s Homicide Detail are asking for the public’s help searching for a person who went missing in October.Authorities say Maria Elena Guzman-Cordova is missing under suspicious circumstances.Deputies say Guzman-Cordova left her home on the 1600 block of North Santa Fe Avenue around 9 p.m. on October 13.
