Jerry Brown ordered new DNA tests that a condemned inmate says could clear him in a 35-year-old quadruple murder case, which has drawn national attention.On Monday, Brown ordered new testing on four pieces of evidence that Kevin Cooper and his attorneys say will show he was framed for the 1983 Chino Hills hatchet and knife killings of four people. The items that will be tested are a tan T-shirt and orange towel found near the scene and the hatchet handle and sheath.Brown also appointed a retired Los Angeles County Superior Court judge to serve as a special master overseeing the case.Cooper was convicted in 1985 of killing Doug and Peggy Ryen, their 10-year-old daughter Jessica and 11-year-old neighbor Christopher Hughes. Prosecutors say Cooper's claims of innocence have been disproven multiple times, including by prior DNA testing, but Cooper and his attorney argue evidence against him was planted."I take no position as to Mr. Cooper's guilt or innocence at this time, but colorable factual questions have been raised about whether advances in DNA technology warrant limited retesting of certain physical evidence in this case," Brown wrote in his executive order.New York Times' columnist Nicholas Kristof, U.S. Sen. Kamala Harris, state Treasurer John Chiang and reality television star Kim Kardashian are among people who called for Brown to order new DNA tests. Cooper had his execution stayed in 2004, which drew national attention at the time.The purpose of the new testing, he wrote, is to determine whether another suspect's DNA or the DNA of any other identifiable suspect is on the items. If the tests reveal no new DNA or DNA that cannot be traced to a person, "this matter should be closed," Brown wrote.Two previous tests showed Cooper, 60, was the killer, argued San Bernardino County District Attorney Mike Ramos. He previously said the tests proved Cooper had been in the home of the Ryens, smoked cigarettes in their stolen station wagon, and that Cooper's blood and the blood of at least one victim was on a T-shirt found by the side of a road leading away from the murders.Cooper's attorney, Norman Hile, said his client's blood was planted on the T-shirt, and that more sensitive DNA testing would show who wore it. He contends that investigators also planted other evidence to frame his client, a young black man who escaped from a nearby prison east of Los Angeles two days before the murders.Other evidence points to the killers being white or Hispanic, Cooper's supporters say.A San Diego judge in 2011 blocked Cooper's request for a third round of DNA testing.Cooper's scheduled execution in 2004 was stayed when a federal appellate court in San Francisco called for further review of the scientific evidence, but his appeals have been rejected by both the California and U.S. supreme courts. Former Gov. Arnold Schwarzenegger twice denied Cooper's clemency petitions.California hasn't executed anyone since 2006.Brown issued his Christmas Eve order alongside 143 pardons and 131 commutations. (AP) — The California Democratic Party is investigating allegations of sexual misconduct against chairman Eric Bauman.A party vice chairman, Daraka Larimore-Hall, brought the charges against Bauman last week on behalf of anonymous accusers and called for Bauman's resignation. Larimore-Hall alleged that Bauman sexually harassed and assaulted people during party functions.Larimore-Hall spoke to two accusers and a witness, the Sacramento Bee newspaper reported."I take seriously any allegation brought forward by anyone who believes they have been caused pain," Bauman said Saturday in a statement announcing the investigation. "I look forward to putting these allegations behind us and moving forward as unified Democrats."An outside investigator is looking into the claims. Other California Democrats have already called for Bauman to be replaced, including U.S. Rep. Ro Khanna and the Orange County Young Democrats.A series of sexual misconduct allegations against lawmakers, lobbyists and others in politics rocked California's political world late last year, at the height of the #MeToo movement. Three Democratic men resigned as state lawmakers after investigators hired by the Legislature found they likely engaged in inappropriate behavior.In a letter to the party last week calling for Bauman's removal, Larimore-Hall said stories from Bauman's accusers illustrate a "clear and escalating pattern" of inappropriate behavior.Larimore-Hall did not respond to a request for comment Monday from The Associated Press.Bauman narrowly won the party chairmanship last year against Kimberly Ellis after a contentious battle between establishment Democrats and progressive activists.During that fight, Bauman said he was falsely targeted by rumors he engaged in inappropriate behavior with teenage boys. Bauman is the party's first openly gay chairman.Bauman called the rumors "despicable lies," and Ellis denounced them.Party officers can be removed from office by a vote of the executive board. Russell Crowe is sharing mementos from his marriage -- for a price.The actor hosted a divorce-themed auction in Sydney on Saturday, which also happens to be his birthday and wedding anniversary.As part of the auction by Sotheby's Australia, Crowe parted with an eclectic mix of items and movie souvenirs collected during his nine-year marriage to Danielle Spencer. The couple called it quits in 2012.Items on sale included his leather jockstrap and midnight blue satin boxers, along with art, watches, diamond rings and a Mercedes Benz. The jockstrap sold for ,000, according to Sotheby's Australia.The auction, aptly titled "The Art of Divorce," featured a poster of a tuxedo-clad Crowe, holding a cocktail glass in a toast. SACRAMENTO (AP) — California on Thursday temporarily banned insurance companies from dropping customers in areas affected by more than a dozen recent blazes, invoking a new law for the first time as homeowners in the wildfire-plagued state struggle to find coverage while carriers seek to shed risk.The order from Insurance Commissioner Ricardo Lara will last for one year, and it only covers people who live inside or next to the perimeter of 16 different wildfires that burned across the state in October. The Department of Insurance estimates the moratorium will affect 800,000 policies covering millions of people in portions of Los Angeles and Riverside counties in Southern California and Sonoma County in the northern part of the state.The move comes as regulators are aggressively trying to assist homeowners in wildfire-prone areas who say they are being pushed out of the commercial insurance market as climate change makes fires larger and more frequent.RELATED: Cal Fire: Acres burned across the state is much lower in 2019 than 2018Seven of the 10 most destructive wildfires in California history have happened in the last five years — including 2018′s Camp Fire, which destroyed roughly 19,000 buildings and killed 85 people in and around the Northern California town of Paradise. That blaze alone generated more than billion in insurance claims, according to the Department of Insurance.Since 2015, state officials say insurance companies have declined to renew nearly 350,000 policies in areas at high risk for wildfires. That data does not include information on how many people were able to find coverage elsewhere or at what price.One of those homeowners is Sean Coffey, who said he and his wife have struggled to maintain fire insurance on their home in Oakland.“The pattern repeated itself almost every year since we bought our house. We would have (coverage) for 10 months. In the fall, we would get a notice we are being dropped,” he said.RELATED: Study: Alien grasses are making more frequent US wildfiresCoffey now buys fire insurance from the California Fair Access to Insurance Requirements Plan, an insurance pool mandated by state law that is required to sell policies to people who can’t buy them through no fault of their own. He must purchase a second policy to cover risks other than fire.FAIR Plan policies in wildfire-prone areas have grown an average of 8% each year since 2016, according to the Department of Insurance. Last month, Lara ordered the FAIR Plan to begin selling comprehensive policies next year that cover more than just fire damage. FAIR Plan Association President Anneliese Jivan called that order “a misguided approach,” saying it will make all of the plans more expensive.Lara has the authority to order the moratorium under a bill he authored while in the state Senate last year that was signed into law by former Gov. Jerry Brown. The law took effect in January, and this is the first time regulators have used it.In addition to ordering the moratorium, Lara called on insurance companies to voluntarily stop dropping customers solely because of wildfire risk.RELATED: Bigger, longer blackouts could lie ahead in California“I believe everyone in the state deserves this same breathing room,” Lara said.A spokeswoman for the American Property Casualty Insurance Association did not immediately respond to a request for comment.While state officials rush to assist homeowners, a new report from California Auditor Elaine Howle said the state did not do enough to protect non-English speaking, elderly and other vulnerable residents during three of the state’s most devastating fires in recent years.The audit covered Butte County, site of 2018′s Camp fire, plus the 2017 Thomas Fire that burned more than 281,000 acres in Ventura County and 2017 fires in Sonoma County that killed 24 people. The audit found none of the three counties had assessed its residents to determine who might need extra help and whether resources were available to help such people, such as transportation, during a natural disaster.The audit also scolds the state oversight agency, the Governor’s Office of Emergency Services, for failing to assist counties in developing such plans and reviewing any plans in place.Howle says it was impossible to determine whether lives could have been saved “if the counties had planned differently or more fully implemented the best practices”her office recommends in the report.” But she noted that “inadequate plans and insufficient planning are proven contributors to failure.” 4561
