SAN DIEGO (KGTV) - The father accused of causing a condo fire in Rancho Bernardo that killed his two children appeared in court Tuesday afternoon for a preliminary hearing.Henry Lopez is accused of passing out drunk with a lit cigarette, setting his condo on fire last October.His children, 10-year-old Cristos and 7-year-old Isabella, were in the home at the time and suffered smoke inhalation. Both children died as a result of their injuries.Lopez was also burned in the fire and hospitalized for some time.One witness told the court Tuesday he heard a female screaming at the scene, but the screaming stopped.RELATED: Father charged after children killed in fireHenry Lopez' ex-wife Nikia Lopez testified the two were in the midst of a divorce. They shared joint custody of their children.  Lopez told the judge her former husband was an abusive alcoholic.She claims she had warned him previously not to smoke in the house around the children."He drank a lot. My goal was to keep it from the kids.  I would wake up in the middle of the night and throw away the bottles in the trash. I would pull him upstairs before the kids woke in the morning... sometimes I would have to clean up his throw up."  He’s not in custody because his defense attorney says he needs to be out to receive medical treatment for the burns he sustained during the fire.Prosecutors believe the fire started in his bed and ultimately spread to the rest of the home.  Investigators found discarded smoking materials and alcohol near the start of the fire.If there’s enough evidence against Lopez and the case goes to trial, he faces up to 14 years in prison for several felony counts including involuntary manslaughter and child endangerment.Lopez is not charged with intentionally starting the fire. 1809

SAN DIEGO (KGTV) -- The Del Mar Thoroughbred Club has canceled its racing program this weekend, July 17-19. The cancellation follows 15 jockeys recently testing positive for COVID-19. Racing is slated to resume July 24."Assuming these individuals continue to show no symptoms, they will be isolated for a total of 10 days and should be able to resume their usual activities, including riding after that time,” said Dr. Eric McDonald, Medical Director, Epidemiology & Immunizations Services, County of San Diego.Racing at the track is set to return on July 24.The 15 jockeys who tested positive are believed to be asymptomatic, officials said. “Contact tracing procedures are underway in conjunction with the San Diego Health & Human Services Agency. However, a common factor among all but one of the riders that tested positive is that they rode at the recently concluded Los Alamitos meet.”The track ordered testing of all jockeys after two riders, Flavien Prat and Victor Espinoza, tested positive for COVID-19.Espinoza, who rode American Pharaoh to horse racing’s Triple Crown in 2015, spoke about his coronavirus diagnosis earlier this week on “The Winner’s Circle” podcast.Espinoza told podcast host Bram Weinstein that he took a COVID-19 test on July 7 and did not go to Del Mar’s opening weekend because he did not receive his results until July 10.The famed jockey described his symptoms as body aches and join pain, but he did not have a cough, fever or shortness of breath."It's different from a cold. Tuesday at 5 o'clock, it hit me hard for two hours. The next day I wake up normal like nothing happened. I feel fine ... The following day, my body starts hurting, every joint in my body, especially my legs, every joint from my hip to my ankles. SAN DIEGO (KGTV) - The City of San Diego is close to completing a project that will protect a popular Ocean Beach walking path from erosion.People who live along Orchard Avenue say the pathway that goes along the coast has been falling apart in the past few years, as tidal surges wear away the concrete."It was falling apart. The sidewalk's coming up, you could have tripped," says Tony Nieves, who lives on the corner nearby. "It's nice to see something done about it."Over the winter, the City started construction on a 3,000 project to rebuild the walkway and add break rocks and rip rap to protect it. It's part of a bigger plan to revitalize staircases and walkways along the coast to improve beach access, which the city started working on in 2008.Rainy, windy weather delayed the Orchard Avenue part of the project, which was supposed to be completed by the start of spring.This past week, the city installed large, man-made rocks to the coast to break up waves. They also added green metal cages around them, leading people to fear they'll get so big they may block views."I come down here most nights that I'm not working, just to catch the sunset," says Brittany Hagedorn. "Living a block away makes it easy."In a statement, the City told 10News the boulders will get another layer of concrete above the cages and they hope to have the project completed before Memorial Day Weekend.In the meantime, people who live nearby will have to wait to use the path again.The full statement from the City of San Diego is below:"The man made boulders being constructed are part of the project to reconstruct the beach access walkway at Orchard Ave. The boulders are intended to protect the newly-installed sidewalk, because this section of sidewalk has previously been seriously damaged by tidal surges. SAN DIEGO (KGTV) - The Department of Homeland Security is responding to the caravan of Central American immigrants prepared to enter the United States through the border with Mexico.At least 600 people from Guatemala, Honduras, El Salvador, and Nicaragua are traveling to Tijuana, according to freelance journalist Jorge Nieto. About 100 arrived last night. Eventually the group will enter the U.S. at the San Ysidro port of entry.Homeland Security Secretary Kirstjen Nielsen released a statement on the caravan.“DHS continues to monitor the remnants of the ‘caravan’ of individuals headed to our Southern border with the apparent intention of entering the United States illegally. A sovereign nation that cannot – or worse, chooses not – to defend its borders will soon cease to be a sovereign nation. SAN DIEGO (KGTV) - The City of San Diego and the San Diego Housing Commission announced details about a planned purchase of two hotels to convert into permanent housing for the homeless.After a six-month search, city officials announced the purchase of the Residence Inns in Mission Valley and Kearny Mesa. The price tag: 6.5 million.Scott Marshall of the San Diego Housing Commission says the project draws upon city, county and state funds to turn hotel rooms into 332 affordable apartments for the homeless, many of them currently staying at the convention center as part of the program, Operation Shelter To Home."This is not temporary shelter. They are permanent homes that will provide them a path out of the shelter and off the streets," said Marshall.Marshall says of the 29 sites considered, the two Residence Inns stood out."They were operating as hotels and in good condition. They didn't require a lot of work for people to move in," said Marshall.Federal housing vouchers will help residents with part of the rent. They'll also receive a host of wraparound services."Things like health care, Life skills training and employment assistance to help them get back on their feet and to a more stabile life," said Marshall.The hotels turned apartments reside in commercial areas, with many other motels and hotels as neighbors. SDSU marketing professor Miro Copic says any issues at the sites could turn into pubic relations problems."Tourists and travel agents could see it as a negative, and it may turn away people from the area. The city has to manage this effectively. If it does so, it may not have much of an impact on nearby hotels," said Copic.If the city council approves the purchase in October, the apartments could be ready by December. 1768
