SAN DIEGO (KGTV) -- A toddler found near Lincoln High School Thursday afternoon has been reunited with his parents.According to a witness, the child was found wandering around near the corner of Franklin Avenue and Gloria Street.The witness, who had just dropped her granddaughter off at cheer practice, said the toddler wasn’t crying, but simply standing on the street alone.The woman approached the child and asked if he was lost before the toddler smiled back at her. She then asked where he lived.After the child pointed down the street, the woman took his hand and called out loudly asking if anyone lost a child.After no one came forward, the woman took the young child to a nearby fire station where a fire crew was able to call police.Police were able to bring the child safely to a police station where they took care of him until he was brought home. 868

SAN DIEGO (KGTV) — An Ohio man accused of pepper-spraying 11 San Diego Police officers during a demonstration last month has pleaded not guilty.Denzel Draughn, 28, pleaded not guilty on Wednesday to felony counts of unlawful use of tear gas against a peace officer and 11 felony counts of use of force against a peace officer.On Aug. 28, a group of demonstrators protesting the shooting of Jacob Blake in Kenosha, Wisc., marched through downtown San Diego.See Sky10 video of the demonstration below:Police say that as the group neared 9th and E Streets, a vehicle that was following the group failed to stop at red lights. After police stopped the driver, a crowd began to form near the car and officers who pulled the vehicle over.SDPD says that the group ignored demands to back up from the scene, prompting one officer to pull out pepper spray. Police say one person tried to knock the pepper spray out of the officer's hand, forcing the officer to discharge the spray.Several police officers then tried to arrest the person. As the officers were placing the person in custody, a pepper spray canister fell on the ground. Officers say Draughn picked up the canister and sprayed it twice, hitting 11 officers.SDPD says Draughn fled but was later found and arrested.If convicted, Draughn faces probation to 11 years in jail. He was released on 0,000 bail Wednesday evening."Peaceful protest is a time-honored tradition in our country, and now more than ever it’s critical that we protect an individual’s important First Amendment right. The majority of those protesting in our County are doing so peacefully. SAN DIEGO (KGTV) - A San Diego veteran and father is defending his son's right to sit during the national anthem.Ray Everett is responding to a letter sent to Lincoln High School's principal, complaining that students on the basketball team were sitting and talking during the national anthem.The man who wrote the letter is a U.S. Air Force veteran and grandfather to a player on the opposing team. Another parent who was offended used her phone to film the students sitting."At the end of the day our students do not have to stand," said Everett. "But you will not make them feel like they did something wrong. They did not harm anyone and they did not break the law."Everett was in the U.S. Army for 15 years. He says he served his country in order to protect the rights of Americans, including the right to sit during the national anthem.Everett's brother-in-law, Antoine Jarvis, says while he was offended by the letter he respects everyone's right to their own opinion. "I think that the biggest challenge in voicing your opinion is when you're close-minded to other's opinions," said Jarvis. "When you're close-minded to their beliefs."Jarvis says he no longer stands during the national anthem after learning more about its history. He only asks that others respect his right to do so.The principal of Lincoln High School, a veteran himself, has been responsive to complaints and plans to sit down with the veteran who wrote the letter about the student's actions.On Thursday the San Diego Unified School District sent a statement to 10News:Public school districts do not have the authority to require students to observe patriotic or religious rituals in the classroom or at school functions. SAN DIEGO (KGTV) - An inmate at R.J. Donovan State Prison has filed a lawsuit against the California Department of Corrections and Rehabilitation.Anand Jon Alexander filed the complaint on Monday, alleging prison officials failed to keep him safe and to provide adequate medical care after he was assaulted behind bars.In the complaint, Alexander claims he was attacked by another inmate while waiting to make a phone call on May 18, 2019. He was allegedly stabbed multiple times in the face and kicked on the ground.After the attack he sustained “five facial fractures, a lower orbital floor blowout, sinus and nasal fractures, a deviated septum, a 50% abrasion to the right cornea, long term impairment of his vision and respiration, serious nerve damage, PTSD” according to the complaint.Alexander is 12 years in to a 59 year sentence after he was convicted of rape in 2008.An up and coming fashion designer, Alexander had been featured on “America’s Next Top Model” and was listed in Newsweek’s “Who’s Next in 2007.”But his career was put on hold after being accused by multiple women of sexual assault.Many of the charges were dropped, but he was convicted on one count of rape and 15 other counts following a trial in Los Angeles. The jury found him not guilty or were hung on several other counts.Alexander has maintained his innocence. In the complaint, his lawyer writes he “has acknowledged the existence of blurred lines between his personal and professional relationships…Nevertheless, he holds steadfast to his innocence.”The American Justice Alliance, a group which seeks to free prisoners who have been wrongfully convicted, submitted an amicus brief to the Federal Central District Court.In it, they wrote Alexander “was targeted by a collusion of disgruntled business associates and some former girlfriends, who have admitted they were out to “bring him down,” and “get revenge,” seeking notoriety and monetary benefits. He was then subject to a prosecution and trial riddled with extraordinary police misconduct.”The lawsuit names CDCR as well as Marcus Pollard, the Warden of R.J. Donovan Correctional Facility and Daniel Paramo, the former Warden.It alleges prison officials failed to protect Alexander from harm and after he was injured gave “deliberate indifference to Mr. Alexander’s medical condition.”They are seeking unspecified monetary damages and a jury trial.So far, no criminal charges have been filed against the assailant. 10News reached out to CDCR for comment but had not heard back before the story was published. 2557

SAN DIEGO (KGTV) -- A UC San Diego fraternity was suspended as the school investigates multiple sexual assault allegations against some of its members. According to a report by The UCSD Guardian campus newspaper, at least four female students claimed they were sexually assaulted by members of the Sigma Chi fraternity in incidents over the course of the academic year. Details of the accusations came to light during sorority meetings last month, where chapter residents read written accounts from the alleged victims. An anonymous student who was at one of the meetings told the school newspaper that one woman claimed she was drugged at a Sigma Chi party when a fraternity member handed her a spiked drink that rendered her unconscious.
