MIAMI — All of South Florida is now in the cone of concern for Hurricane Eta, which hammered Nicaragua on Tuesday.According to the 4 a.m. ET update from the National Hurricane Center, Eta is packing maximum sustained winds of 60 mph.The NHC said Eta will rapidly weaken as the storm moves farther inland over Nicaragua and Honduras.The forecasts project the storm will curve and emerge over the northwestern Caribbean Sea on Thursday night or Friday. Once it does, forecasters said it could re-strengthen into a tropical storm.By Sunday at 7 p.m., the center of Eta will be just south of Florida with maximum sustained winds of 60 mph.According to meteorologists for Scripps station WPTV in Palm Beach, Florida project that there will be a higher confidence on Friday for the potential impacts in South Florida."Computer models are in fairly good agreement, but the timing is different," said WPTV chief meteorologist Steve Weagle said. "Some are much faster, bringing the rainfall in on Friday. Others a lot slower, bringing it in on Saturday."At that point, Weagle said the forecast is calling for tropical storm conditions over the weekend with heavy rain and gusty winds.Weagle said rain bands will likely arrive later on Friday, loosely tied to Eta and a weak front over Cuba. Heavy rain squalls and possible tropical storm conditions are in the forecast for Saturday and Sunday."It'll likely be a very sloppy, disorganized weather system as it moves through," Weagle said. Experts say all of the ingredients are there for this election to be highly contested.“There are a lot of different reasons why the election may not be decided by the morning of November 4, and a lot of lawsuits may start to fly once that happens,” said Claire Finkelstein, law professor and director of the Center for Ethics and the Rule of Law at the University of Pennsylvania.With a record number of ballots coming in by mail, Finkelstein says the counting period will be lengthy.If a candidate declares victory on election night, but then more results come in, there could be calls for recounts, especially in states where the results are close. That could mean litigation over the counting procedures.Each states' elector will cast their vote on December 14. Then Congress meets on January 6 to count those votes and name the winner.If no candidate has a majority of the electoral votes, or if the counting period goes on and the election is still undecided, it is possible that the House of Representatives must decide.Finkelstein says that would be extraordinary and complicated.“It would likely be very contested as well, but one way or another by January 20, there needs to be a new president being sworn in,” said Finkelstein.The professor says this election is also entangled with the new Supreme Court justice.Like for Pennsylvania, which could now see a new decision on allowing mail-in ballots received up to three days after Election Day, the Supreme Court could also be involved in recounts, as happened in Florida in 2000. 1659
Michael Cohen said in court Wednesday that he had been living in a "personal and mental incarceration" under President Donald Trump and that his prison sentence would, ironically, help him get back his freedom.That's particularly true if he goes to a certain minimum-security prison not far from the city.In federal court on Wednesday, US District Judge William Pauley agreed to recommend that Cohen serve his 36-month prison sentence at FCI Otisville, about 70 miles northwest of New York City.FCI Otisville has sometimes been viewed as a preferable prison option for inmates convicted of white-collar crimes. In 2009, Forbes named it one of "America's 10 cushiest prisons."Despite the judge's recommendation, the decision as to where Cohen will spend time is ultimately up to the Bureau of Prisons, which has sole responsibility for determining where offenders spend their prison sentences.The decisions are made at the Designation and Sentence Computation Center in Texas. The DSCC attempts to send inmates to prisons within a 500-mile radius of their residence, which for Cohen is in New York. However, the decision also is made using a series of criteria, such as security needs, medical needs, availability of counseling services, and bed space.Bureau of Prison data shows the bureau complies with 74% of judicial recommendations, wholly or in part, according to an analysis of the DSCC published in Criminal Justice magazine in 2016. 1454
LOVELAND RESERVOIR, Calif. (KGTV) - With Santa Ana winds in the forecast for Wednesday morning, Cal Fire stationed more than 500 firefighters in strategic spots to attack any hot spots that flared up in the Valley Fire burn area.The plan worked.Crews were able to recognize hot spot fires quickly and direct resources to fight them before early morning winds spread the flames across Lawson Valley.One flare-up started on a mountain peak just northeast of Loveland Reservoir. That area burned on Saturday, but Barona Fire Department Chief Ken Kremensky said embers stayed hot enough under the tree canopy to reignite Wednesday morning."The retardant coats the area," Kremensky explained. "But a lot of times in the heavier brush it lays along the top of the brush and it doesn't penetrate all the way the ground so there's hot stuff and it creeps in there. And once it creeps through the retardant, it gets into that open field starts to spread. If you get some wind on it and it picks up, you see the flame starting to show up."The fire was in a remote area that would take hand crews hours to reach. So, Cal Fire sent in a squad of helicopters.Helicopters from San Diego Gas & Electric, Cal Fire and the San Diego County Sheriff's Department took turns dousing the flames with water for nearly an hour, making multiple passes and filling up with water from the reservoir.After they left, military helicopters took over. By 11 a.m., the fire was mostly out."We'll just keep plugging away and hopefully the weather will cooperate with us and that'll be a good success," said Kremensky.Heavy winds never materialized, with gusts in the fire zone topping out at 30 miles an hour. Crews were able to handle several other hot spots that ignited and keep the flames within the fire perimeter.Kremensky said they were fortunate that the weather cooperated. 1862
Millions of renters are safe from eviction after the Center for Disease Control (CDC) issued an eviction moratorium at the beginning of September. The moratorium blocks landlords from evicting tenants from their homes, over concern of further spreading COVID-19.Now, landlords are pushing back on the mandate.“My lender wants to get paid,” said Florida landlord Andy Orfitelli.For Orfitelli in Florida to landlord Rebecca Welsh in Kentucky, many landlords have said they cannot afford the financial burden the moratorium is now putting on them.“Literally, right now, I am supporting three homes, households, not just mine,” said Welsh, who is currently expecting a child.“We are concerned that an order like this could force many operators into bankruptcy and those properties could be lost,” said Bob Pinnegar, who is with the National Apartment Association (NAA).The NAA has joined landlords in at least three states in a lawsuit against the federal ban on most evictions.“We were forced into this situation with the inaction of Congress in putting together a stimulus package, and then, the combination of the CDC order laid over top of that,” explained Pinnegar. “It has forced us to where we have to take legal action.”The NAA explained with the lawsuit, its goal is not for landlords to be able to push residents out of their homes, but rather it hopes it pushes Congress to take action and fund the mandate.“This is really to try to force Congress to get back to the table and talk about a solution here,” said Pinnegar. ”We have been told by members of Congress on both the Republican and Democratic side that the next stimulus bill will contain relief for renters, but the bill is being held hostage to our current political environment.”The National Apartment Association wants a stimulus package with money allocated to renters, instead of a moratorium, because the money would trickle down to help landlords pay their mortgages and keep their property. If Congress does not allocate such money or fail to pass a stimulus bill soon, the consequence for landlords could be seen soon
