SAN DIEGO (KGTV) — A North Park gym owner who defied the governor's health order and moved workouts indoors was served with a violation notice from the county, threatening ,000 daily fines. Owner Frank Kole initially complied with last month's order and moved everything outdoors, but after five days made the decision to go back inside. That's because he says the sidewalks outside his gym were littered with feces, blood stains, and trash. Kole instead instituted strict rules indoors, requiring masks and social distancing. But the county, while acknowledging the tough reality outside, still served him with the violation, saying it was the law. Immediately, he and his staff discovered a syringe on the sidewalk as they were setting up equipment. The city of San Diego power washed the sidewalk on Wednesday, but Kole says it was a quick job without trash pickup. "If we weren't out there cleaning that sidewalk up everyday, that needle would still be there," Kole said. A spokeswoman for the city of San Diego says environmental crews will pick up syringes with biohazard boxes when they encounter them. In the meantime, residents can report the on the city's Get-it-done App. Kole says he will comply with the order and keep the gym outside, even if it means reduced hours and more staff time moving everything in and out everyday. "I'm a proud American and I'm a proud business owner and I will do what it takes to keep my business alive," Kole said. SAN DIEGO (KGTV) - A lawsuit was filed on Monday in San Diego County Superior Court against the County of San Diego, Registrar of Voters and other entities related to the ongoing battle over the future of the Julian volunteer fire department. Attorney and mayoral candidate Cory Briggs filed the suit and told 10News that the claim is that a group of former volunteer fire department board members made the decision to dissolve the department in secret meetings, and the County allegedly let it happen. For the past two years, locals have been in a contentious battle over the future of San Diego County's last all-volunteer fire department. Many residents believe the County should take over the department because it has more resources and money.Opponents don't trust the County and think that the department's volunteers can do a better job on their own. This morning, an independent regulatory agency conducted a final vote in favor of dissolving the department. A hearing on this new lawsuit is scheduled for Wednesday morning. 1041

SAN DIEGO (KGTV) -- A man was arrested after deputies say he intentionally drove onto a sidewalk outside an Encinitas bar, seriously injuring several people. According to the San Diego County Sheriff’s Department, the incident happened on the 500 block of South Coast Highway 101 around 1:20 a.m. Deputies say the man, later identified as Christian Davis, 28, was asked to leave The Saloon Bar because he was too intoxicated. RELATED: Man dies following attack in Vista; suspects at-largeAfter leaving the bar, deputies say Davis got into his rental U-Haul van and intentionally drove it onto the sidewalk, hitting three people. One of the victims was taken to Palomar Medical Center while two others were taken to Scripps La Jolla Hospital all with serious injuries. Davis was detained by witnesses at the bar before being taken into custody by deputies. Two of the witnesses were injured while detaining Davis and were taken to Scripps Encinitas hospital with minor injuries. The suspect is facing four felony charges including three of attempted first-degree murder and one of attempted escape with force. Davis is scheduled to be arraigned Tuesday. SAN DIEGO (KGTV) -- A man was arrested after San Diego Police say he threatened an employee and vandalized a downtown office building. According to police, the incident happened around 9:30 a.m. at the Mills Building on Imperial Avenue downtown. The building houses San Diego County government offices. Police say the man threatened an employee on the 5th floor of the building before damaging computer monitors in the office.
