SAN DIEGO (KGTV) — Light scattered showers fell throughout the day from Mission Valley to Carmel Valley.While Sunday's rainfall marked the first fall rain for the region, Alex Tardy with the National Weather Service said that rain will disappear by Monday. “We're looking at conditions that are bone dry, record dry. SAN DIEGO (KGTV) - In a downtown courtroom on Friday afternoon, attorneys battled over a request to halt the shutdown orders for San Diego bars, restaurants, and gyms.Attorney Bruno Katz is representing a group of local businesses like Cowboy Star restaurant and Bear Republic Crossfit gym, which are seeking an emergency injunction. He told the judge, “What I do want to say, your Honor, is that the temporary restraining order is based on data. It’s based on facts. It’s based on science and it's based on the state not showing why it has targeted these industries when the science and data doesn't support it.”The state argued that the damage to businesses pales in comparison to the damage on human life. “There's nearly a thousand dead San Diegans and the numbers are getting dramatically worse and have been for the last couple of weeks,” said state Deputy Attorney General Jonathan Eisenberg.Restaurants and gyms were open for indoor operations with limited capacities under the red tier. However, last Saturday’s move to the purple tier forced them to shutdown indoor services completely and move outside. They're suing Governor Newsom and San Diego County, arguing that the closures go against their rights and are causing financial devastation.The suit was filed on behalf of all restaurants and gyms.Local owner of The Studio SD fitness studio Rachel Racz spoke to ABC10 News before Friday’s hearing. She told ABC10 News in part, “It's been rough to shut down business again when people were feeling normal and then we see the County of San Diego's Department of Health say that gyms are only point .4% of cases in San Diego and it's really frustrating as a business owner where we have these ebbs and flows- where we can be open and then we can’t.”Superior Court Judge Kenneth J. SAN DIEGO (KGTV) — It's been a tumultuous year for East Village's Monkey Paw Brewery.The local brewing company was purchased by Coronado Brewing Company in July 2017, put up for sale in May of this year, and closed its downtown San Diego brewpub Monday.Coronado Brewing Company (CBC) CEO Brandon Richards said in May, months after finalizing the purchase, the sale was part of a refocusing for CBC.RELATED: Miramar's Intergalactic Brewery is closing its doors"While we were excited about the potential of Monkey Paw, the decision to sell came from the need to refocus our energy toward Coronado Brewing," Richards said. SAN DIEGO (KGTV) — In response to a rise in coronavirus cases among San Diego State students, the campus said Wednesday it will move all its classes online for the next month.The school says it has recorded 64 confirmed and probable COVID-19 cases in students since the start of fall classes on Aug. 24, but that doesn't mean there is an outbreak on campus. Many of the cases have come from students living off-campus. The school says 15 cases out of 7,997 on-campus students have been reported since the start of the semester.A little more than 100 students are currently quarantined out of an abundance of caution, said Andrea Dooley, Associate Vice President for Student Affairs.One of the positive cases arrived in San Diego from out of state, according to County Medical Director Dr. Eric McDonald. McDonald said there is one off-campus gathering under investigation as to whether it meets the "outbreak" designation.RELATED: San Diego State fraternities ban social events this fall due to COVID-19In response to the growing number of students testing positive, SDSU moved all classes online for the next four weeks. The campus had been hosting about 200 classes in-person, many of which were lab classes that were determined to only be possible in person.Starting Sept. 3, all athletic events have also been paused for two weeks."We understand there may be some frustration with this decision ... the shift to the virtual space does not impact our students who are living on campus," said Luke Wood, Vice President for Student Affairs and Campus Diversity. For those isolated, a hygiene kit and food and meal delivery are provided by SDSU to those isolated students, Wood says.To address off-campus students testing positive, the school had banned fraternity events and instituted several policies to stop the spread of the coronavirus. Those policies include hiring security to patrol the campus after hours, document violations, and report to staff who handle disciplinary action. SAN DIEGO (KGTV) – Military officials have confirmed to 10News that the man suspected of gunning down more than two dozen people at a Texas church Sunday served 12 months in San Diego in 2014. Devin Patrick Kelley, 26, is accused of killing 26 people and wounding 20 others at a Texas church on Sunday. Authorities said he was wearing tactical gear and a black mask with a white skull face.RELATED: Texas shooter was charged with animal crueltyKelley was a member of the Air Force, serving at Holloman AFB from 2010 until his discharge in 2014. In 2012, Kelley was court-martialed for two counts of assault on his then-wife and their child, the Air Force confirmed. He was sentenced to 12 months of confinement and a rank reduction. He and his wife divorced that year."Kelley was convicted by a general court-martial on two charges of domestic assault against his wife and step-son under Article 128 of the Uniform Code of Military Justice. He then served 12-months in confinement at Naval Consolidated Brig Miramar in California before being released with a Bad Conduct Discharge in 2014. He was also reduced in grade to E-1.
