BEIJING, April 13 (Xinhua) -- The State Council, China's Cabinet, released here Tuesday new regulations on overseas investment, promising good business conditions but restricting funds to environmentally unsound projects.According to the new regulations, China still welcomes foreign investment in high-tech industries, services sectors, energy-saving and environmental protection, but polluting and energy-gorging or projects in industries running at overcapacity are not wanted.According to the regulations, the State Council said China will continue to support Chinese A-share listed companies in further introducing strategic investors from home and abroad, and standardize foreign companies' investment in domestic securities and corporate merger and acquisition moves.A national security examination mechanism will be built as soon as possible for foreign-funded companies' merger and acquisition operation in China, according to the regulations.Qualified foreign-funded companies are allowed to go public, issue corporate bonds or medium-term bills in China.Multinationals are encouraged by the regulations to set up regional headquarters, research and development centers, procurement hubs, financial management and other functional offices in China.Importing items for scientific and technological development by qualified foreign-funded R&D centers will be exempt from tariffs, importing value added tax and goods and services tax by the end of 2010, according to the regulations.Foreign-funded enterprises are also encouraged to increase their investment in China's central and western regions, particularly in environment friendly and labor-intensive companies.

In recent years, such bilateral relations were maintained in a sound trend in general as there have been frequent diplomatic visits, and economic and trade cooperation continue to expand. BEIJING, April 7 (Xinhua) -- Chinese President Hu Jintao's upcoming visit to Brazil, Venezuela and Chile will be significant to furthering comprehensive development of China-Latin America relations, a senior Chinese diplomat said on Wednesday.Vice Foreign Minister Li Jinzhang told a press briefing that Hu will pay a state visit to Brazil and attend the second summit of the BRIC countries - Brazil, Russia, India and China - in Brasilia from April 14 to 17, make a state visit to Venezuela from April 17 to 18 and a working visit to Chile on April 18."China and Latin American countries, all as developing countries, share extensive common interests. China has always attached great importance to its relations with these countries," Li said.China-Latin America relations have maintained a good momentum of comprehensive and sustained growth with increased political mutual trust, expansion of cooperation and more frequent cultural exchanges, he said.Hu's visit will be made at the invitation of Brazilian President Luiz Inacio Lula da Silva, Venezuelan President Hugo Rafael Chavez Frias and Chilean President Sebastian Pinera.Hu will hold talks with President Lula and meet other leaders on furthering China-Brazil ties and boosting cooperation on major global issues, Li saidThe two countries will ink a joint action plan from 2010 to 2014 and agreements in the fields of culture, energy, finance, science and technology as well as product quality inspection, he said. China is Brazil's largest trading partner and biggest export market.During his first state visit to Venezuela, Hu will hold talks with President Chavez, when cooperation documents on energy, finance, culture, electricity and poverty alleviation are expected to be signed, Li said.Venezuela is China's fifth largest trading partner in Latin America with a trade volume of 7.15 billion US dollars in 2009.Hu will hold talks with President Pinera and meet with other Chilean leaders. China now is Chile's largest trading partner, and Chile is China's second largest in the Latin America. Their trade volume reached a record high of 17.7 billion US dollars in 2009.Li said, China expects to further friendly relations and deepen cooperation of mutual benefit with the three nations and promote comprehensive development of its relations with Latin America through Hu's visit."I believed that China-Latin America relations would achieve further development with our joint efforts," he said.

  

BEIJING, May 31 -- Evidence obtained illegally - such as through torture during interrogation - cannot be used in testimony, particularly in cases involving the death penalty, according to two regulations issued on Sunday.A death sentence should be pronounced only with sufficient evidence acquired through legal means, stipulate the two regulations: One on evidence review in death sentence cases, and the other on excluding illegal evidence in criminal cases.Jointly issued by the top court, the top procuratorate, the ministries of public security, state security and justice, they are the first specific rules on collection of evidence and review in criminal cases.The first regulation sets out principles and rules for scrutinizing and gauging evidence in cases involving the death penalty, and the other sets out detailed procedure for examining evidence and for excluding evidence obtained illegally.They are expected to cut down on death sentences and reduce forced confessions, experts said.The regulations make it clear that evidence with unclear origin, confessions obtained through torture, or testimony obtained through violence and intimidation are invalid, particularly in death sentences."Not a single mistake is allowed in fact finding and collection of evidence in cases involving the death sentence," said a written Q&A released by the five central departments on Sunday.The new regulations define illegal evidence and include specific procedures on how to exclude such evidence.Lu Guanglun, a senior judge at the Supreme People's Court, said such details do not exist in the Criminal Procedure Law and its judicial interpretations."This is the first time that a systematic and clear regulation tells law enforcers that evidence obtained through illegal means is not only illegal but also useless," said Zhao Bingzhi, dean of the law school at Beijing Normal University."Previously we could only infer from abstract laws that illegal evidence is not allowed. But in reality, in many cases, such evidence was considered valid," he said."This is big progress, both for the legal system and for better protection of human rights," he said. "It will help reduce the number of executions".Zhao said the new rules will also help change the mindset of law enforcers and reduce torture in interrogation, one of the causes of wrongful sentences.Ever since the top court started reviewing all death sentences in 2007, the overall quality of handling criminal cases has improved, but a lot of problems still remain, the joint Q&A said.In 2008, the top court announced that about 15 percent of death sentence verdicts by lower courts in 2007 were found to have faults.On May 20, Zhou Yongkang, secretary of the Communist Party of China Central Political and Legislative Committee, said at a meeting that "the criminal legal system should be perfected and law enforcers should improve their capability to ensure that every case handled can stand the test of law and time". Lu at the top court said the new rules will help prevent wrongful convictions like the one in which an innocent villager in Henan province was wrongly prosecuted.The case of Zhao Zuohai, who stayed behind bars for 11 years until the man he allegedly murdered turned up alive on April 30, has attracted national attention and triggered public criticism of judicial officers after Zhao said he was tortured by local police to confess.Three former police officers have been arrested for allegedly torturing Zhao."Such cases seriously undermine the image of China's justice system and people's trust in the government," said Bian Jianlin, a law professor at China University of Political Science and Law.

  

BEIJING, April 7 (Xinhua) -- The Chinese government said Wednesday it will continue to develop the country's western regions with a focus on improving people's well-being.The government will resolutely push forward the development of the west strategy, which was initiated ten years ago and has facilitated historic social and economic progress in the region, according to a statement released after a executive meeting of the State Council on Wednesday chaired by Premier Wen Jiabao.More efforts will be made to improve education, health services, job creation, social security, as well as cultural and sports development, to promote equal social services, the statement said.Infrastructure construction will be given priority, with the building of hydro-power stations to relieve water shortages in the region, it said.The government also called for sustainable development through a recycling and energy-saving industries and for all projects to meet ecological protection standards.The government's consistent efforts to develop the western regions have helped bridge the region's gap with the better-off coastal areas in eastern China.Figures released by the National Bureau of Statistics showed the industrial added-value for the central and western provinces grew by 17 percent in 2008, 6 percentage points more than the eastern areas.
