DENVER – The man accused of shooting and killing three people at a Thornton, Colorado Walmart on Wednesday night will likely learn if prosecutors will seek the death penalty against him Monday afternoon.Scott Allen Ostrem, 47, made his first court appearance Friday morning in Adams County. Formal charges have yet to be filed against him, but his arrest warrant carried first-degree murder after deliberation charges.Prosecutors are expected to seek similar first-degree murder charges, and an attorney for the state said at Friday’s hearing that “there’s going to be multiple counts in this case.” District Attorney Dave Young said they might also pursue attempted murder charges."When you fire into a crowd of people you don't necessarily need to fire more than one shot to be convicted or charged with attempted murder," Young said.Prosecutors initially argued that they should have until Wednesday to file formal charges, saying that they needed to interview more people and review more video footage to determine who, if anyone in particular, Ostrem was targeting in the shooting.Police and the FBI say they still have not determined a motive for the Wednesday night shooting, which left three people dead.First-degree murder convictions carry sentences of either life in prison without the possibility of parole or the death penalty in Colorado, but prosecutors must say which penalty they are seeking when the initial charges are filed. Dozens of people returned to Jimmy Durante Road with their picket signs Saturday morning to protest the gun show. Many did not think they would be there again."We thought we already had this issue decided," Rose Ann Sharp said. The founder of the website "neveragainca.org" organized the protest after the gun show temporarily was reinstated. Last September, protesters convinced the Del Mar Fairgrounds Board of Directors to suspend the gun show, but a judge's ruling this past June allowed the event to return."I feel really good that the court found it in our favor," California Rifle and Pistol Association Executive Director, Rick Travis said. "What that does is it protects San Diegans' and Californians' first amendment rights."In response, State Legislators passed AB893. The bill bans the sale of guns and ammunition, specifically at the Del Mar Fairgrounds, starting in 2021. 10News met several teenagers who joined the protest. 16-year-old Daphne Porras said she came to the rally because she was scared. At Canyon Crest Academy in Carmel Valley, she said lockdown drills are the new norm. "Unfortunately, it is a realistic possibility," Porras said. "I feel like our generation has almost gotten used to it."Her friend Robbie Glatts echoed her sentiments. "I don't like going to school scared anymore," Glatts said. "I don't like making plans on where I'm going to go. I have a plan for every single class. DETROIT (AP) — Ford is recalling more than 375,000 Explorer SUVs in the U.S. and Canada to fix a suspension problem that has caused 13 crashes. The recall covers SUVs from the 2013 through 2017 model years built at Ford's Chicago Assembly Plant from Sept. 4, 2012, to Jan. 25, 2017. They were sold or registered in 22 states and six Canadian provinces where salt is used to clear roads during the winter. The automaker says the rear toe links can fracture, reducing steering control. A toe link puts weight on the tires so they stay on the ground. Ford says six people were hurt in the crashes. DETROIT — Investigators raided Perry Funeral Home in Detroit late Friday afternoon and have removed nearly 63 infant remains, according to Detroit Police. Officers found 36 fetuses in cardboard boxes and 27 more in freezers. DEL MAR, Calif. (KGTV) - A woman was struck and killed by a Coaster train during rush hour Wednesday.The Coaster came to a stop at 111 11th Street in Del Mar. Deputies from the Sheriff's North Coastal Transit Enforcement Unit arrived at the scene around 5 p.m. Deputies say the northbound Coaster Train was traveling around 48 mph when it struck the woman, killing both she and her dog as they attempted to cross the tracks. Both the woman and the dog died at the scene. Anyone with information about this case is asked to call the Sheriff's Department's non-emergency line at (858) 565-5200. 620
