CHULA VISTA, Calif. (CNS) - The family of a 56-year-old man who died earlier this year following an encounter with Chula Vista police announced Monday they are filing a pair of wrongful death lawsuits against the city.The lawsuits seek the names of the officers involved in the March 13 call for service that culminated in Oral Nunis' death.Both lawsuits are being filed in San Diego federal and state courts on behalf of four of Nunis' children, including his daughter Kimone, who called 911 shortly after midnight March 13 after her father began experiencing a mental health issue and attempted to jump out of a second-story window.While addressing reporters at a news conference announcing the lawsuits, Kimone Nunis said responding officers did not speak to her or ask her what was happening with her father when they arrived."That night, I just wanted help. I picked up the phone. I didn't know what I was getting myself into," she said.Attorneys for the family say officers tackled Nunis outside the home and "dogpiled" atop him, placed him in a WRAP restraint device and put a "spit hood" over his head.In a statement released shortly after Nunis' death, the police department said he was restrained to prevent him from hurting himself or others. The department also alleged Nunis was "uncooperative with officers and struggled as they attempted to detain him," resulting in injuries to two of the officers.The federal lawsuit alleges Nunis was unconscious and unresponsive after the altercation, and that those restraints were placed upon him while he was unconscious.Nunis was taken to a hospital, where he was later pronounced dead.Attorney John Burris, who represents the family, said police should have responded by de-escalating the situation."Mr. Nunis was seeking help. The family was seeking help. But instead of getting help, he was met with force," Burris said.A similar lawsuit was filed last month on behalf of Nunis' widow and three other children. Their attorney, Carl Douglas, alleged the city has withheld Nunis' cause of death, while a statement released by the city last month indicated his cause of death has not yet been determined."The City of Chula Vista understands and shares the public's and the family's desire to have all of their questions answered about this incident. However, it is premature and inappropriate to come to any conclusions at this time," according to the city's statement in response to that lawsuit. "The investigation is ongoing, and the true cause of death has not been determined by the Medical Examiner. Because of this, and now the threat of litigation, the City and the Police Department must refrain from commenting further beyond the statements already made. But Tracy also said she would resign if what she calls “cyber bullying” toward her doesn’t stop.Speaking at her Fairfield, Ohio gym, the owner and coach of Cincinnati Gymnastics Academy strongly condemned Nassar and didn’t deny the positive comments she made about the since-convicted sexual abuser to Scripps affiliate WCPO in Cincinnati in December 2016. Tracy’s two-year-old comment sparked a controversy this week when Aly Raisman, an Olympic champion and Nassar survivor, went on Twitter and protested Tracy’s new national post as Elite Development Coordinator.As much as Tracy said she wanted the job, she also said she has received three “fairly threatening emails” and one that said she “should be in a jail cell next to Larry Nassar.” She has also been vilified on social media to the point that she has already told US Gymnastics she would not keep job if it means hurting her family.“What I feel I need to say is that when I saw Aly putting out some things about something I said two years ago as this was all coming out, that was my truth,” Tracy said about her 2016 comments about Nassar, the former national team doctor now accused of sexually assaulting up to 250 women and girls and serving up to 165 years in prison.“Larry had been treating my athletes for well over 25 years and had served them very well and had helped me and my athletes return to action," she said Thursday.  "He had been someone that we all unfortunately had trusted and depended on, so when I was asked about my experience with him, that’s what I said. So I’m not denying that I said that.“Would I say that anymore? Absolutely not … The man is a monster.  But at that moment, I looked at him like I would my dad or my brother. That was the level of trust I had.“But as we all find out, these people are that good. They are master manipulators. (KGTV) -- A card room in Chula Vista has built an elaborate outdoor facility as a way to continue its business and comply with San Diego County COVID-19 pandemic-related health guidelines.Seven Mile Casino’s new “card room” is actually a 5,500-square-foot tent, complete with tables distanced six feet apart, Plexiglass partitions to separate players, and touchless hand sanitizing stations around the tent.Before guests can enter the area, they must first go through a health screening. Staff and patrons must wear a face covering at all times while on the property.Seven Mile Casino spokesperson Brad Samuel said they’ve been working with health officials to make sure the casino meets all guidelines. They’re even using their cameras to help with contact tracing.Samuel added, "If someone was to get sick and say later, ‘I was at Seven Mile Casino,’ we can literally show that person and show authorities every single person that that person came into contact with … so they can be notified."Now that the casino has opened its doors, it means about 300 people also have jobs again. 1112

(KGTV) - Customers narrowly avoided being hit by an out-of-control truck that struck a Chula Vista bank Tuesday, sending cash flying.Four people were using the ATMs in a vestibule at the Chase bank at 1120 Broadway about 12 p.m. when the Dodge Ram truck crashed through the glass entryway.Three customers dodged the truck, which came dangerously close to Anna Gonzalez.“I’m shaking; I have a big angel with me,” said Gonzalez.Gonzalez had tried to use an ATM but when it didn’t work, she moved to another machine. The first machine was the one hit by the pickup. Three other customers in the vestibule dodged the truck.Irene Archuleta was cut by glass from the vestibule’s shattered windows.“Regular day, going to the ATM to withdraw some money. The next you know there was a truck right next to me,” said Archuleta. “Definitely an angel looking over us.”An elderly man was injured and taken to the hospital, along with two bank employees who were in another room and thrown from their desks upon impact.There was no immediate word on the severity of the injuries.The driver, who was not identified, was not injured, according to Chula Vista Fire Captain Francisco Soto.Chula Vista Police are looking into the cause of the crash.Firefighters said the crash did not damage a load bearing wall, making it possible for them to remove debris and return cash to the bank. 1399

They just made up stuff and made a balance."Martinez said she was sitting next to Superintendent Karen Janney when the multimillion-dollar deficit was discovered. "She said, hey it's the business system. It's old, huh? Just making up stuff. I've heard about six different versions of the truth and none of them have been truthful."The former Chief Financial Officer Karen Michel would not participate in the audit. The team also could not make contact with Doug Martens, the director of fiscal services.With the release of the FCMAT report, it will be up to the District Attorney, State Superintendent of Public Instruction, and State Controller to determine if fraud did in fact occur within the Sweetwater District.The district was given 15 days to respond to the audit's findings with its "proposed action."One teacher in the district, who did not want to be identified, said the audit's findings were sad, but not surprising. "Hopefully, the positive that can come out of this is that we become more transparent and have more oversight and this will never happen again," the teacher said. On Tueday, SUHSD spokesman Manny Rubio provided this statement to 10News on behalf of the district: "The Sweetwater Union High School District is currently reviewing the report from FCMAT and its findings and recommendations. The District takes this report very seriously and will be determining next steps. Given that this matter is still pending, we will refrain from any additional comment at this time."The District Attorney's office said they are reviewing the audit. There is also an investigation into the district by the Securities and Exchange Commission. An agency spokesperson would not comment. 4002
