SAN DIEGO (KGTV) -- The Carlsbad Police Department released body camera footage Saturday night in response to public concerns over officer misconduct during an incident involving a 27-year-old black man.The June 11 incident gained attention after cell phone video surfaced showing officers using a Taser on the man and pressing his head into the pavement in an attempt to subdue him."A video is circulating showing a police use of force incident from Thursday night. Open lines of communication between the Police Department and the community are more important now than ever," Carlsbad police said in a statement."As with all uses of force, we fully investigate incidents to ensure the officers’ conduct is consistent with the Police Department’s policies," police said.The cell phone video doesn't show the start of the incident. The witness video begins with the man on the ground surrounded by paramedics and two officers lying on top of him.The newly released six-minute body cam video starts from the moment two officers respond to the scene. According to the department's timeline of the incident, officers and paramedics responded to a call at 8:48 p.m. about a man found face down on a sidewalk at Ponto Road and Carlsbad Boulevard."Two officers arrived and found the firefighters evaluating the man, who was now standing," police said.Bodycam footage shows the man talking with paramedics, and the group appears to disperse. With the officers approaching, the paramedics step away from the man. The man tells the paramedics, "I'm not complaining about anything else."The man appears to hear something from the group of paramedics and screams out, "are you mocking me?"A paramedic tells the man, "No, I'm not mocking you at all."One officer says, "Hey, they're just here to help you, man."The man stands face to face with the paramedic telling him, "the way he said it is different from how you said it. Because I understand how the f--- you say it. But what do you mean when you say it?"According to the police timeline, "The man walked quickly toward the medics while continuing to yell profanities. Officers, fearing for the safety of the medics, interceded."The report says, "Officers reached out to the man and told him to stop."A struggle ensues and the body cameras are knocked to the ground leaving only an audio recording of the incident for about two minutes. The officers pick up the cameras and resume video recording the scene about two minutes later.The department juxtaposed three camera angles of the confrontation with the man -- two from officer body cameras, and one that was recorded by an unidentified "resident." The witness video fills in a section of lost body cam footage.Carlsbad police said the investigation is still ongoing and are asking the public who may have witnessed the incident to contact the department at their non-emergency line at 760-931-2197.The man in the video, Marcel Cox-Harshaw, 27, of San Diego, was cited and released for resisting arrest. Police also charged him with being drunk in public. That’s why we are providing a detailed chronology of this incident.As with all uses of force, we fully investigate incidents to ensure the officers’ conduct is consistent with the Police Department’s policies.At 8:48 p.m. A caller reported a man face down on a sidewalk at Ponto Road and Carlsbad Boulevard.At 8:55 p.m. Carlsbad Fire Department personnel arrived at the location and began their evaluation of the man.At 8:59 p.m. Two officers arrived and found the firefighters evaluating the man, who was now standing.While medics evaluated the man’s condition, the man became visually agitated and started yelling at the medics.At 8:59 p.m. The man walked quickly toward the medics while continuing to yell profanities.Officers, fearing for the safety of the medics, interceded.Officers reached out to the man and told him to stop.The man continued to yell as officers tried to handcuff the man to take him into custody.The man yelled, struggled, turned and pulled from the officers and would not comply with their instructions.At 9:02 p.m. Officers then used a taser to attempt to subdue the man.At 9:03 p.m. The officers then restrained the man by holding his body and head to the ground while placing him in handcuffs. He was not injured, but he continued to shout angrily. Officers asked him to calm down, but he refused to comply and continued shouting.At 9:03 p.m. Officers considered the man detained.A mesh bag called a spit mask was placed on the man’s head to protect the officers and paramedics from coming into contact with droplets coming from the man’s nose and mouth This bag is porous and does not restrict breathing.At this time, paramedics were able to place the man on a gurney, where he continued to yell and struggle.At 9:07 p.m. Paramedics transported the man to a local hospital where he was sedated, assessed and released.The man, 27-year-old Marcel Cox-Harshaw of San Diego, was cited and released for resisting arrest. An additional charge of drunk in public has been presented to the District Attorney's Office. The initial investigation indicates that drugs and or alcohol played a role in the incident.The investigation is still ongoing. We are asking any community members who may have witnessed the incident to call the non-emergency police number at 760-931-2197 to share their accounts.Here are some of the department’s policy that pertain to the incidentOfficers shall use only that amount of force that reasonably appears necessary given the facts and totality of the circumstances known to or perceived by the officer at the time of the event to accomplish a legitimate law enforcement purpose.When determining whether to apply force and evaluating whether an officer has used reasonable force, a number of factors should be taken into consideration, as time and circumstances permit. These factors include but are not limited to:o The apparent immediacy and severity of the threat to officers or others – Mr. Harshaw charged unarmed fire personnel while yelling profanities.o The individual’s apparent ability to understand and comply with officer commands – Mr. Harshaw would not comply with officer commands.o The conduct of the individual being confronted, as reasonably perceived by the officer. Mr. Harshaw was yelling and behaving aggressively toward fire personnel.o Proximity of weapons or dangerous improvised devices. – Officers had no way of knowing what was in Mr. Harshaw’s backpack or baggy pants.o The effects of drugs or alcohol. Mr. Harshaw appeared to be under the influence of drugs and or alcohol.o Whether the person appears to be resisting, attempting to evade arrest by flight, or is attacking the officer. Mr. Harshaw was at no time compliant.The TASER device may be used in any of the following circumstances, when the circumstances perceived by the officer at the time indicate that such application is reasonably necessary to control a person:o The subject is violent or is physically resisting. Mr. Harshaw was physically resistant and behaved aggressively toward fire personnel.o The subject has demonstrated, by words or action, an intention to be violent or to physically resist, and reasonably appears to present the potential to harm officers, him/herself or others. – Mr. Harshaw charged fire personnel, while yelling profanities and he was not compliant with officer commands.Supervisory notification shall be made as soon as practicable following the application of force. A supervisor was immediately called to the scene and an investigation was opened. The investigation includedo Obtaining the basic facts.o Collect evidence at the sceneo Ensure that all needing medical treatment are treated. Mr. Harshaw was transported to the hospital and released. SAN DIEGO (KGTV) -- The mother of a San Diego middle school student is begging for more answers from school administrators after she says other students threatened to shoot and stab her son. “I’m not willing to play Russian roulette with my kid’s life,” states Vanessa Flores. In a 10News exclusive, we interviewed her and her thirteen year-old son, Daniel, at their home on Tuesday. She says she pulled Daniel out of downtown’s KIPP Adelante charter middle school on Tuesday morning. It was two weeks ago when Daniel says he got in a fight with a couple of students. He says over their lunch break they were saying, “What are we going to do with Daniel? Are we going to jump him? Let’s jump him. Let’s bring the gun.” Daniel tells us he them heard one of them add, “The gun’s too much. Let’s bring the knife.” Vanessa showed us text messages that she says she exchanged with the school’s principal the night of the incident. She says she later met with administrators. “I just wanted the authorities to be contacted and made aware of the situation,” she adds. For days, she says her family could not get clear answers about any action the school was taking.  With tears in his eyes, Daniel described for us the anxiety he felt in the school hallways in the days following the alleged threats. “I’d think, what’s the next move? What are they going to do to me when I pass by the hallway? What do they have or what are they hiding?” “I’ve told [the school] that I’m in fear with the climate right now with all these shootings. Everybody’s talking about red flags. I’m giving [the school] the red flags on a silver platter. Please help me,” says Vanessa. On Tuesday, she says she picked Daniel up the from school after getting confirmation from school administrators that KIPP Adelante would not get the San Diego Police Department involved. She tells us she no longer felt safe keeping him on that campus. After picking him up from school, she says she took him to the San Diego Police Department to try to file a report. San Diego Police confirm with 10News that there was a misunderstanding that she was referring to a charter school and not a regular San Diego Unified School District (SDUSD) public school. She says SDPD sent her to SDUSD school police, which don’t handle investigations related to local charter schools. The SDUSD school police apparently sent her back to SDPD. SDPD confirms its officers took a report on Tuesday afternoon and now the juvenile service team is investigating the reported threats. On Tuesday afternoon, KIPP Adelante charter school principal Monique McKeown sent us the following statement. “Two weeks ago, we had an 8th grade student report that two of his classmates threatened to harm him with a weapon. We fully investigated the matter and found no credible evidence that the students in question threatened to use a weapon against their classmate. San Diego Unified Police Services confirmed that we handled the investigation appropriately. At KIPP we respond swiftly to all potential threats to student safety.” The referenced "San Diego Unified Police Services" is also known as SDUSD school police. A spokesperson for KIPP Adelante later clarified that SDUSD school police did not conduct its own investigation. Rather, it apparently reviewed and approved the school’s own investigation. The spokesperson for KIPP Adelante also reported that the teens who made the apparent threats are still students at the school. 3559

SAN DIEGO (KGTV) - The California Highway Patrol said a person arrested at gunpoint on Interstate 15 in San Diego Thursday was suspected of driving illegally in the HOV lane and leading an officer on a pursuit.The chase happened on southbound I-15 just south of Aero Dr. at 5:30 p.m.Officers said the driver was in the high-occupancy vehicle lane and failed to pull over, leading to the brief pursuit.There are no reports of any injuries or a reason why the driver did not yield for the traffic stop.10News is monitoring developments in the story. 555

SAN DIEGO (KGTV) - The mother of Rebecca Zahau testified Thursday in the second day of the civil lawsuit surrounding the Coronado mansion death.Rebecca Zahau died in July 2011. Her nude, bound body was found hanging from the balcony of the Spreckels mansion.The death was officially declared a suicide but Zahau's family disagreed. They filed a wrongful death civil lawsuit against Adam Shacknai, the brother of Zahau's boyfriend.Shacknai’s lawyers argue there is no physical, eyewitness, or scientific evidence linking him to Zahau’s death.Zahau's mother, Pari Zahau, took the witness stand Thursday morning and gave an emotional testimony as she was asked questions about her daughter.She remembered her as a sweet, loving and religious woman. The jury has three days off and will hear testimony again Monday.The family’s attorney Keith Greer handed Pari Zahau a piece of evidence and asked her to describe what it was.It was an envelope full of cash from Rebecca Zahau addressed to Pari Zahau and her late husband.Pari Zahau explained to the jury her daughter would support her financially by sending cash every month. That envelope was never sent, although one of the final times Pari Zahau talked to her daughter, she was told it would be on the way soon.Pari Zahau had to take a break from testifying when lawyer Keith Greer asked, “Did you ever think Rebecca would kill herself?”She gave a tearful response saying, “No. No, never. Never. My daughter? No. She is very sweet girl and she is very strong. No no, not suicide, they killed her.”After Pari Zahau broke down in tears, the lawyer asked for a brief break.The trial is expected to last a month. The Zahau’s family’s goal is to get the Sheriff’s Department to reopen a criminal investigation. 1802

SAN DIEGO (KGTV) -- The man accused of killing his parents and sister in a Logan Heights house fire pleaded not guilty in court Tuesday. Wilber Romero, 26, is facing charges that include first-degree murder and arson in the October 13 blaze. The fire started around 4:30 a.m. on the 3100 block of Clay Street. 44-year-old Jose Romero died at the scene while his wife and daughter, Nicolasa Maya-Romero, 46, and Iris Romero, 21, died at the hospital in the days following the blaze.The family’s 23-year-old daughter remains hospitalized. A 16-year-old son, who was injured when he escaped out a window, was released following treatment. RELATED: Family's oldest son charged in Logan Heights house fire deathsProsecutors in court Tuesday said Wilber started the fire before escaping through a side door, taking the family's dog with him. Wilber is being held on million bail and faces life in prison if convicted. Court documents show the fire wasn’t the first time he allegedly targeted his family. Wilber reportedly attacked his father with a brick and rocks and damaged his car in September of 2018.The incident prompted a police standoff that ended when police shot bean bags at Wilber and released a police dog, documents show.The documents go on to state Wilber was in a car accident when he was 6-years-old and that he has suffered from a learning disability since the crash.According to the documents, Wilber also struggled with drug addiction. 1461
