BOSTON (AP) — Prosecutors dropped a case Wednesday accusing Kevin Spacey of groping a young man at a resort island bar in 2016, more than a week after the accuser refused to testify about a missing cellphone the defense says contains information that supports the actor's claims of innocence.Spacey was charged with indecent assault and battery last year in the only criminal case that has been brought against the actor since his career collapsed amid a slew of sexual misconduct allegations. The two-time Oscar winner was among the earliest and biggest names to be ensnared in the #MeToo movement against sexual assault and harassment that swept across the entertainment and other industries.Spacey denies groping the man, whose mother first went public with the allegations in 2017.A phone message seeking comment was left with Spacey's lawyer.The actor's accuser was ordered to take the stand earlier this month after he said he lost the cellphone he used the night of the alleged groping. The defense said it needed the phone to recover deleted text messages it says would help Spacey's case.The man denied deleting messages or manipulating screenshots of conversations he provided to investigators. But when he was pressed by the defense about whether he knew that altering evidence is a crime, he invoked his Fifth Amendment right against self-incrimination, and the judge said his testimony would be stricken from the record.The judge then questioned how prosecutors would be able to bring Spacey to trial if the accuser continued to refuse to testify, and prosecutors told the judge they needed time to decide how to proceed.On Wednesday, Cape and Island District Attorney Michael O'Keefe said in court documents that they were dropping the charge "due to an unavailability of the complaining witness."The hearing at which the accuser testified came days after the man abruptly dropped a lawsuit he had just recently filed against the actor that sought damages for "severe and permanent mental distress and emotional injuries." The suit was dismissed "with prejudice," meaning it cannot be refiled.The man did not receive a settlement to drop the civil case, his mother said. His lawyer said he dropped it because he was emotionally overwhelmed and wanted only "one roller coaster ride at a time" and so chose to focus on the criminal case.The man's mother, former Boston TV anchor Heather Unruh, alleged in 2017 that Spacey got her son drunk and sexually assaulted him at the Club Car, a bar on Nantucket where the teen worked as a busboy.The man told police he went over to talk to Spacey after his shift because he wanted to get a picture with the former "House of Cards" star. He said Spacey bought him several drinks and tried to persuade him to come home with him before unzipping the man's pants and groping him for about three minutes.Unruh's son told police he tried to move Spacey's hands, but the groping continued, and he didn't know what to do because he didn't want to get in trouble for drinking because he was underage. The man said he fled when Spacey went to the bathroom.Shortly after Spacey was charged, he posted a video on YouTube in the voice of his "House of Cards" character who was killed off after the sexual misconduct allegations emerged, saying "I'm certainly not going to pay the price for the thing I didn't do."Spacey has faced several other accusations.His first accuser, actor Anthony Rapp, said Spacey climbed on top of him on a bed when Rapp was 14 and Spacey 26. (KGTV) - A Bonita family has been making gift bags for children in need for eight years and the pandemic this holiday season didn't stop them from spreading joy.Usually the assemblyline forms in Diane Zoura's garage the weekend after Thanksgiving. There's lots of friends, family and food to go around. This year the pandemic pushed them outside, under a tent a week later than planned."We are more spaced out this year, we set up outside, we’re taking temperatures, we’re all wearing masks so we’re just being more safe," Zoura said.They had to delay the event because a family member was sickened with the coronavirus weeks earlier. She said everyone is okay and they wanted to make sure everyone was safe when they did come together.Sunday, they were focused not on the pandemic, but on giving the gift of love and joy, a thousand times over."We’re going to give 400 of them to Build a Miracle and they’re going to hand them out to homeless children in Mexico and then we’re going to be giving the rest to the Polinsky Children’s Center for the foster kids in San Diego." Zoura said they wanted to send more gifts than last year.In 2019, they sent 750 gifts, in 2020 they'll distribute 1,000 and their ambitious goal for 2021 is 2,000 gifts. BEND, Ore. -- It’s a crisp September morning. A good time to go for a hike. For 21-year-old Isaac Shannon, that means strapping into the AdvenChair.“I’m in a wheelchair because I have a mitochondrial disease, which is a progressive genetic disorder that affects pretty much everything in my body and makes me extremely tired and fatigued easily,” Shannon said.For the majority of his life, Shannon hasn’t been able to go on hikes. This is now his fourth time using the AdvenChair.“It’s rejuvenating to be outside, especially as a person with a disability because these resources are not exactly the most accessible,” Shannon said. “So when there is a tool that allows a person to be able to experience life in the most average way possible, I think it’s healing, and it’s nice to be out in nature where you’re not around people.”The AdvenChair is an adaptive, human-powered wheelchair designed to help people with physical disabilities get outside. Jack Arnold is the engineer who helped develop the chair.“It’s an all-terrain wheelchair. With a small team of people, you can go backpacking,” Arnold said.One person pushes from behind, and another – adequately referred to as a mule -- pulls from the front. Up to five people can help remove the chair with nylon straps and carabiners on more challenging trails.“There are so many people with physical challenges out there in the world,” Arnold said. “We take it for granted; we can get up and go for a hike. And everybody with physical challenges, they don’t want to be stuck indoors either. They want to get out.”The man who inspired and created the idea of the AdvenChair, Geoff Babb, was supposed to be on the trail with us, but a medical emergency rushed him to the hospital instead. Geoff is no stranger to the hospital. This visit is due to a complication with a pump in his abdomen that helps control muscle spasms. But as he puts it, it’s not his first rodeo.“I had my first stroke on November 10th, 2005,” Geoff said.Twelve years later, on the same date, Geoff had a second stroke. Now he lives with quadriparesis, which means he experiences weakness in all four limbs. His favorite medicine is nature.“For me, to start to heal, I had to be in my place of comfort and strength, which was being outside,” Geoff said.Outside is where he met his wife, Yvonne.“I mean, we weren’t born outside, but we’re just outdoorsy people,” Yvonne said with a laugh.Both worked as plant resource specialists. Geoff used to be a fire incident commander. As his primary caretaker, Yvonne’s life has been influenced by the AdvenChair as much as Geoff’s has.“To me, it’s a safe way to go out to the woods with Jeff and continue our life in an adventurous way,” Yvonne said.They can go on trips to the beach, or in the snow and trek through somewhat tricky trails.“Takes five or six people we’re like ‘ohhh we can do this,’” Yvonne said.Yvonne says Geoff is the most driven person she’s ever known. Geoff says his motivation is his desire to contribute to the world positively.“I have a purpose when I get up, and that purpose is to help people experience wild places eventually,” Geoff said.It’s a goal he’s already achieved on a small scale with other friends in Oregon.“I think this is one of the coolest things that I’ve gotten to experience in my life because I’ve been able to hike again without feeling tired or having any pain,” Shannon said.Geoff hopes to continue his legacy allowing more people to hike outside.“I want to be able to see other people in his chair… on the Camino, or climbing the Great Wall of China,” Yvonne said.No matter what life throws at him, Geoff says he will continue rolling boldly off the beaten path. 3684

BLOOMINGTON, Ind. — At least two protesters were struck by a vehicle Monday during a demonstration against racism in Bloomington.The incident happened around 9 p.m. Monday in the area of 6th and Walnut in Bloomington near the Monroe County Courthouse as the protest was wrapping up.Hundreds of people had been taking part in a rally and protest march through Bloomington in response to an alleged racist attack at nearby Lake Monroe over the weekend. In that incident, which was caught on video, several men attack and allegedly threatened to lynch Vauhxx Booker, a Monroe County Human Rights commissioner.Geoff Stewart was one of the two people struck by the vehicle during Monday's protest."A woman driving the vehicle came up to the stop and had started revving her engine toward us, and we tried to stop her and let her know that the crowd is clearing up," Stewart said. "But, she and her passenger both wanted to go right away, so they started to push. They pushed into the woman that was with me and when she pushed again both of us went on the vehicle."Stewart said when the driver started to accelerate, the woman he was with ended up on the hood of the vehicle, and he ended up hanging off the driver's side of the vehicle."I was just trying to block her vision so she would slow down, so I tried to pull myself as far in her way to obstruct her view," Stewart said. "She drove through red lights and made her turn up here that threw both of us off the car."One protester was transported to the hospital with injuries, and another was checked at the scene.
