SAN DIEGO (KGTV) — From the confrontation in a Los Angeles Trader Joe's to a showdown in a San Diego Starbucks, there have been a lot of customers claiming businesses can't legally require them to wear a mask.Some customers even carry a card threatening fines and citing the Americans with Disabilities Act, or ADA. But there are three things to consider before making an ADA claim, according to lawyers.First, to bring a successful ADA lawsuit, attorneys say the person without a mask must truly have a disability. "I would not advise businesses to ask for any type of documentation."If the person says they have a disability, the ADA requires businesses to make reasonable accommodation. There's a third component in the ADA: Subsection 36.208 allows businesses to turn disabled people away if they pose a direct threat to the health and safety of others."Someone not wearing a mask, they might think they're not infected, but they could be and pose a direct threat to spread the virus to many people," Elia said.The Equal Employment Opportunity Commission has said COVID-19 does constitute a direct threat, so our experts say the threat of a successful lawsuit in a case like this is low.That said, there's nothing stopping people from filing these lawsuits. SAN DIEGO (KGTV) -- District Attorney Summer Stephan spoke about her new efforts to train officers and weed out “bad actors.”The push includes calls for a new independent Commission on Police Practices, which would replace the current Community Review Board on Police Practices. “Our communities need us to grieve with them, but they also need us as leaders to step up,” Stephan said. “Officers that are involved in abuse like what we saw with Mr. George Floyd have a history. They do not belong in a field where you supposed to serve and protect and you have the power between life and death.”She said part of the effort to train officers in de-escalating situations includes a new class that focuses on interactions with the public. “This is about interacting with someone that may have mental health issues, may appear not compliant, and how do you talk to them. How do you de-escalate? How do you show respect and communication?” she said.The goal is to train all 5,000 officers in the local departments.The independent Commission on Police Practices would have independent council and subpoena power. It still needs to qualify for the November ballot. Mayor Faulconer pledged his support for the ballot measure Monday. Stephan said she also supports it.“I support it because it is a balanced approach for oversight and transparency,” Stephan said. SAN DIEGO (KGTV) -- For most of the year, a favorite Ladera Street surf spot has been closed after part of the cliff gave way. After the cliff collapsed the City declared an emergency situation because lifeguards have raised concerns about having access to the beach. In a City Council meeting Monday, a decision was made to fast-track a project that will stabilize the cliff by scaling it back. Members of the Sunset Cliffs Natural Park Advisory Board want to the City to find a different solution. "This is just a temporary fix but it's causing permanent damage to the whole cliffside," said Point Loma resident Aaron Taylor. Aside from urging the City to spend more time on the issue, there are some on the committee who think the access point should be moved to another location altogether."You go down the stairs now you're in the tidal zone you're in a danger zone," said Kim Haynes. SAN DIEGO (KGTV) -- Firefighters responded Tuesday afternoon after a brush fire broke out near Scripps Mercy Hospital Tuesday afternoon. According to fire crews, the fire broke near northbound SR-163 and Washington Street. At this time it's unclear what caused the fire. Heavy smoke could be seen coming from the area as passersby drove on the roadway.  381
