RUTHERFORD COUNTY, North Carolina — A teen who shot and killed her mother's boyfriend will not be charged, authorities said.The Rutherford County Sheriff’s Office and the District Attorney’s Office said on Aug. 8, Chandra Nierman's 15-year-old daughter shot the 46-year-old male as he was attacking Nierman.Her other children, a 12-year-old son, and a 16-year-old daughter were there when the violence occurred. Sheriff's deputies said the man was threatening to "cut Nierman’s throat and kill everyone in the house."A release from authorities said:"Nierman’s twelve-year-old son retrieved a firearm and Nierman’s fifteen-year-old daughter took the gun from her brother and fired it twice, striking the deceased male in the chest. One of the fired rounds fragmented, grazing Nierman’s sixteen-year-old daughter in the leg."The 16-year-old was taken to a hospital and was released."Nierman suffered significant bruises and contusions from the assault," the release said.The investigation also revealed the deceased man had threatened Nierman several times previously, and four days before, he had assaulted Nierman and fired multiple rounds from a firearm inside the residence to threaten and terrorize her."The investigation further revealed that the deceased male, who had multiple firearms in the house and frequently carried one on his person, was a convicted felon and had two active domestic violence protection orders against him from two different women in Indiana and Ohio, although no domestic violence or assaults had been reported to law enforcement locally prior to the fatal shooting," the release said. "The deceased male has been positively identified as Steven Kelley, originally from Indiana."Based on the facts and the evidence, "it is the conclusion of the District Attorney’s Office that the shooting was justified and no charges will be filed," the release states. 1903

RICHMOND, Va. — Richmond Police are investigating after someone spray-painted "White Lives Matter" across a statue of black tennis legend Arthur Ashe statue along Monument Avenue in Richmond.Ashe, a Richmond-born tennis star and humanitarian, was the first black man to win U.S Open and Wimbledon titles.Wednesday's incident at the Ashe statue comes after weeks protests against police brutality both in Richmond and around the country.Statues along Monument Avenue honoring Confederate leaders like Robert E. Lee, Stonewall Jackson, and Jefferson Davis have either been spray-painted or toppled during the protest.Concrete barriers were installed around the Lee statue on Wednesday morning.The Virginia Department of General Services said it was erecting the barriers to protect the safety of demonstrators and the structure.The action came shortly after protesters toppled the Howitzers Monument located near Virginia Commonwealth University's Monroe Park campus on Tuesday.It was the third Confederate statue, and the fourth monument, to be torn down by demonstrators in Virginia following the death of George Floyd, a black man who died after a white Minneapolis police officer pressed a knee into his neck.Earlier this month, Virginia Gov. (AP) — The California Assembly has approved new rules for electric bikes and scooters.Businesses like Bird and Spin have deployed scooters to cities across California and the country in recent years. Often local governments have not set up permits or regulations for the devices.A bill passed by the Assembly on Monday would require electric bike and scooter companies to get permits from cities. It would also require them to agree to rules for parking, maintenance and safety.Democratic Assemblyman Al Muratsuchi, the bill's author, says while electric bikes are a fun and eco-friendly mode of transportation. But he says they can be hazardous if they are parked or ridden improperly on sidewalks.The Assembly passed the bill 47-12.It now goes to the state Senate.__The bill is AB1286. 814

  

SACRAMENTO, Calif. (AP) — Gov. Gavin Newsom has approved legislation prompted by the helicopter crash that killed Kobe Bryant and eight others.The bill signed Monday makes it a crime for first responders to take unauthorized photos of deceased people at the scene of an accident or crime.Reports surfaced after the January 26 crash that graphic photos of the victims were being shared. Eight deputies were accused of taking or sharing graphic photos of the scene, Los Angeles County Sheriff Alex Villanueva said then, adding that he had ordered the images deleted.Sheriff Villanueva said the department has a policy against taking and sharing crime scene photos, but it does not apply to accident scenes.The measure that will take effect Jan. 1 makes it a misdemeanor with fines up to ,000 per offense to take such photos for anything other than an official law enforcement purpose.Bryant’s widow, Vanessa Bryant, has sued the department over the photos. In her lawsuit, Bryant alleges that eight deputies took "gratuitous images" with their cell phones after responding to the scene.Bryant's suit also alleges that one of those deputies showed images from the scene to someone outside the department. According to Yahoo, that deputy showed photos from the scene to a person at a bar and bragged "about how he had been at the crash site." A bartender who overheard the conversation later notified the Los Angeles County Sheriff's Department about the conversation. 1474
