SAN DIEGO (KGTV) - The U.S. Attorney's Office of Southern California announced charges Friday against a man in the death of a Camp Pendleton Marine who had an overdose in his barracks.The unidentified Corporal was found unresponsive on the floor near his computer chair on January 29, 2017. He was wearing headphones and appeared to have been playing video games, investigators said.An autopsy determined the Marine died of fentanyl toxicity. A pill found on the headboard near a powdery substance and a rolled-up dollar bill tested positive for fentanyl.A complaint unsealed Friday detailed drug charges against 25-year-old Kyle Shephard of San Marcos.Investigators said Shephard met the victim in November 2016 and sold him fentanyl and other drugs multiple times over three months.Shepard acknowledged the pills could lead to an overdose, according to the complaint.In December, Shephard was arrested and charged with possessing for distribution roughly 2,000 fentanyl pills.“What a senseless tragedy that another young life has been lost because of fentanyl,” said U.S. Attorney Adam Braverman. “This Marine was serving his country and had his whole life ahead of him. We are going to hold dealers accountable for the deaths that result from their reckless disregard for human life.”Shephard will be in court March 6 for a detention hearing.  1369

Elliott said in a news release sent to ABC 10News. “No neighborhood should have to put up with such dangerous behavior.”The home on 2970 2nd Ave. is listed on Airbnb’s website as "The Ashley - Your Private Oasis Next to Downtown." SAN DIEGO (KGTV) -- The San Diego Department of Agriculture is warning residents not to open unsolicited packets of seeds some people reported receiving from China.The department says it has taken 58 calls from people reporting receiving the seeds as of Wednesday afternoon and warns anyone who receives a package to not plant the seeds or throw them away. “The main concern with these seeds is that they were mislabeled and went through customs without an inspection. Seed from other countries might have pests or diseases that don’t exist here. The County Department of Agriculture, Weights and Measures is constantly looking for invasive pests which can be weeds, insects, or diseases. They can cause a lot of harm and we work hard to eliminate them.”RELATED: Mysterious seeds sent from China to US mailboxesThe department says unopened seed packets should be dropped off at drop boxes at 151 E. Carmel St, San Marcos 92128 or 9325 Hazard Way, San Diego 92123 address. They will then be sent to the USDA for analysis.Anyone unable to drop off the seeds should call 760-752-4700.Kimberly Pierce-Nolan is just one of the San Diego County residents to receive the seeds. She said she didn't think anything of it when it arrived at her Imperial Beach home a few weeks ago."I said 'I don’t remember ordering and I thought maybe I did, or maybe it was a free gift or something,'" she said.She put the package aside until recently, when posts and warnings about the seeds started circulating. She said she's happy she didn't throw it away or plant them, but is nervous that her name, address and phone number were all on the package.Reports of unidentified seeds from China have been popping up across the country. All 50 states have now issued warnings about the packages. The department believes it is all part of a “brushing” scam used to boost ratings for online vendors. The packaging label ranges from jewelry to "handmade flowers," and the seeds on the inside vary in size and shape.“At this time, we don’t have any evidence indicating this is something other than a ‘brushing scam,’ where people receive unsolicited items from a seller who then posts false customer reviews to boost sales. USDA is currently collecting seed packages from recipients and will test their contents and determine if they contain anything that could be of concern to U.S. agriculture or the environment,” the USDA said.Wang Wenbin, a spokesperson for China's foreign ministry, said at a briefing on Tuesday that the address labels were forged and that China Post has asked USPS to send those packages to China for investigation. 2618

  

SAN DIEGO (KGTV) - The oldest San Diego women's choir is scrambling to raise funds for a last-second trip to sing at the Pearl Harbor Memorial Ceremony. The Choral Club of San Diego dazzled crowds from veterans homes to Spreckles Organ Pavillion. They've been singing since 1939."It was a very private women's group. They all got together in their homes and they had tea," Executive Director Caron Andregg said, painting the picture of what the club looked like back then. In 2012, they officially became a 501(c)(3) non-profit and over the past five years they've been tuning to a more modern note."We've filtered out a lot of the older traditional music and we started filtering in more modern music," Andregg said.She said the crowds have loved it and they've ran with it, gaining notoriety and ultimately an invite to the Pearl Harbor Memorial Ceremony. Andregg added someone personally recommended the club to the organizers of the event on Honolulu."Getting 25 ladies to Hawaii is no small task," Music Director Kyle Adam Blair said. The group has been frantically making calls for two weeks, but are not gaining any traction."I can't even get people to pick up their phones ... That's why we're panicking and asking you for help," Andregg said.The club is stepping in after an East Coast choir suffered a misfortune and couldn't perform.Andregg said they are honored for the opportunity to be the only vocal ensemble."We're from a Navy town and we have a relationship with the Midway and we have relationships with other Naval outlets, we've performed for Naval ceremonies," she said.The group needs to raise ,000 in a month so they can book the flights and lodging for the choir members. 1706
