SAN DIEGO (CNS) - San Diego Loyal SC asked the public to be respectful to a Phoenix Rising FC player, coach and team in connection with an allegation of a homophobic slur directed at a player. The club issued a statement on social media that read:We’ve received affirmation and an outpouring of support following our actions these last two matches. We’re humbled and gratified, but we have seen expressions of hatred towards Phoenix Rising, their head coach, Rick Schantz and their player, Junior Flemmings which have no place in our sport as well as our society. We do not want to see players and coaches that love the sport as much as we do bullied, and their reputations sullied, by unfortunate lapses of judgements when fueled by passion and competition. We do not endorse a player being terminated by the club, but rather given an opportunity to learn from their mistake through league punishment protocols and, most importantly, the support of their club. We believe in second chances and look forward to working with Phoneix Rising on productive ways we can forgive, educated, and grow from these moments. We support “We Will Speak. We Ill Act.” and we seek to Forgive, Educate and Inspire. The purpose of our stand was to raise awareness, spread love and eliminate hate in all forms. We ask those who support our stand to please be respectful with Junior Flemmings, Rich Schantz and the entire Phoenix Rising FC organization - threats of any nature are not the solution. We look forward to working with Phoenix Rising and the USL to make our game a safe and inclusive environment for all.SD Loyal President Warren Smith said "we've received affirmation and an outpouring of support following our actions these last two matches. ""The purpose of our stand was to raise awareness, spread love and eliminate hate in all forms," Smith said. "We believe in second chances and look forward to working with Phoenix Rising on productive ways we can forgive, educate and grow from these moments."Said Phoenix Rising Governor Berke Bakay: "Prejudiced language and bigotry has no place in sport or anywhere else for that matter. The on-field events of Wednesday's match could not be more contrary to the values of our organization."Bringing both clubs together to fight prejudice will undoubtedly lead to great things. We look forward to the implementation of these educational programs and hope that they can serve as a model for our league."SD Loyal players walked off the field at Torero Stadium at the start of the second half on Sept. 30 leading 3-1 and forfeited the game after midfielder Collin Martin, an openly gay player, was allegedly called a homophobic slur by Flemmings.Flemmings issued a statement on his since deleted Twitter account that same night calling the accusation false and writing that "my fellow teammates will support my claim." He also wrote that he was "mauled and ridiculed online" and "I stand in solidarity with the LGBTQ+ movement."USL Championship is conducting an investigation to determine the facts surrounding the incident. Rising is also conducting an investigation. The second-division men's professional soccer team also announced Thursday that Flemmings "will be taking an administrative leave so that he may focus fully on cooperating with the investigation."Shantz, the team's coach, will also be taking administrative leave, unrelated to the league's investigation, Rising announced.Flemmings is the league's leading goal scorer with 14.SD Loyal announced Sept. 25 it would forfeit the standings point from their 1-1 tie with Los Angeles Galaxy II Sept. 23 because of a racial slur directed as SD Loyal midfielder Elijah Martin, who is Black. However, the league's standings did not subtract the point.Galaxy II announced last Saturday they had "mutually agreed to part ways" with defender Omar Ontiveros, one day after he was suspended by USL Championship for six games because of the racial slur. 3945

SAN DIEGO (CNS) - The caregiver for a 74-year-old man who died in her care and another senior who were both involuntarily locked away at her various San Diego residences was sentenced Friday to 13 years in state prison.Shirley Montano, 53, pleaded guilty earlier this year to charges of voluntary manslaughter, false imprisonment of a dependent adult and perjury.A murder charge stemming from the death of Robert Chagas was dropped under the plea agreement.RELATED: Woman to stand trial for senior's death, abuse of elderly womanProsecutors alleged the defendant withheld food from Chagas and Josefina Kellogg, 61, causing their health to deteriorate over the course of several years, during which she moved often and relocated them, as well.Chagas died Oct. 7, 2016, at Sharp Memorial Hospital of pneumonia, which prosecutors argued was exacerbated by severe malnutrition he suffered under Montano's care. While the victims lived with Montano, she used their social security checks and other government benefits to buy herself a truck, among other personal purchases, and gambled away their money at local casinos, according to prosecutors.Testimony from Montano's 2019 preliminary hearing indicated Chagas and Kellogg were kept isolated from others and were confined to their respective bedrooms. Montano's niece, who stayed with her for about a year, testified that for the first month she lived at her aunt's apartment, she was not even aware Kellogg existed because the woman would hardly ever emerge from her bedroom.RELATED: La Jolla man arrested for assaulting elderly woman in Morro Bay, police sayOthers who resided at Montano's apartment or visited were offered various explanations for the presence of the victims, according to testimony.Kellogg testified that she stayed in her bedroom for several hours each day and feared angering Montano, who would hit her if she did not obey the rules of the house.Chagas was "emaciated" when he was brought into the hospital, where he died five days later, prosecutors said.RELATED: Woman sentenced for defrauding 86-year-old auntAt the hospital, Montano posed as Chagas' niece and told medical personnel that he did not wish to be resuscitated, according to testimony. Chagas' family members were only notified of his hospitalization after his death, they testified.Montano's attorney, Shannon Sebeckis, argued at the preliminary hearing there was no evidence that Chagas' malnutrition was caused by her client, and instead was the natural result of aging.Sebeckis reiterated the testimony of San Diego County Chief Medical Examiner Glenn Wagner, who declined to classify Chagas' death as a homicide. Wagner said Chagas was not getting sufficient food, but could not opine as to why, only that it appeared to be due to non-medical factors. No calls were made by family or medical professionals to Adult Protective Services in Chagas' case, which also contributed to Wagner's opinion not to classify his death as a homicide, the doctor said. While evidence was presented that Chagas once told a doctor that his weight loss was due to not having enough money for food, Sebeckis said that was not proof that Montano was taking his money or withholding food, especially in light of Chagas' issues with handling his own finances.Chagas' family members testified that an accident that occurred at childbirth had left him "slow," as his brother Richard described it, and that throughout his adult life, Chagas was susceptible to being scammed and had lost exorbitant amounts of money to fraudsters, leading family members to take an active role in assisting him with taxes and paying bills.Sebeckis argued there was little direct evidence that Montano didn't feed the seniors, as past roommates said they had seen her providing food for Chagas and Kellogg. The attorney also said Chagas was not confined at all, and regularly left the apartment each day for his janitorial job at Sea World, which he attended with a sack lunch prepared by Montano each day.The defense attorney also said it was "pure speculation and conjecture" that Montano didn't use the seniors' funds to pay for their basic needs. 4151

SAN DIEGO (CNS) - San Diego Superior Court officials warned the public Thursday about a scam targeting the Hispanic community in which a scammer reportedly threatens to arrest people unless they pay for items they never ordered.According to court officials, a woman recently showed up at court looking for a fictional courtroom number. She had been told there would be a hearing on her refusal to pay for items the scammer said she purchased. The woman was told to either pay ,500 or be taken to court. When she came to the courthouse, the woman discovered there was no such case and the threat was a scam. When court staff dialed the phone number provided to the potential victim, the person who answered said she would only speak in Spanish.Superior Court officials are now warning vulnerable non-English speakers about the scam."It appears these scammers are targeting members of the community they believe won't go to authorities or show up at a courthouse," said Executive Officer Michael Roddy. "It appears they believe they can just take the money and no one will report them."These scams happen every year; sometimes they tell people there are charges for failing to show up for jury services or charges for clearing up arrest warrants; this time it's charges for not paying for ordered items," Roddy said. "Once again, we want the public to know the court or law enforcement will not call you with this type of issue and court will never, ever demand cash as the way to make charges go away."The public is told to simply hang up or contact law enforcement if the scammer gets aggressive. 1604
