San Diego County welcomed its first baby of 2019 at 12:04 a.m. Ainhara Abegail Banos was born at Scripps Mercy Hospital in Chula Vista at 7 pounds and 14 ounces. The bundle of joy is 20 inches tall. Her mother, Elizabeth Morales, said Ainhara's three older sisters can't wait to meet her. "They're waiting for her!" Morales said. She joked that her other daughters, however, "wanted a boy."Morales thought she would have a quiet New Year's Eve because the baby wasn't due until the middle of January. While at home, Morales' water broke and her sister brought her to the hospital. Even though Morales has three other children, she said she was still nervous. Even for seasoned veterans of the hospital, the first baby of the year is always exciting."I've been doing this for over 30 years. SAN DIEGO (KTGV)— A homeless man and convicted rapist accused of sexually assaulting a woman at an East Village bar in November faced his accuser in San Diego Superior Court. Gary Cushinberry, who's accused of multiple counts of sexual assault and attempted rape, pleaded not guilty. The judge ordered all media to conceal the victim’s identity, and to refer to her as Jane Doe. Jane Doe took the stand and recalled what happened on the evening of November 5th. She said she was at Amplified Kitchen and Beer Garden in East Village, celebrating with some colleagues.After having a few drinks, she headed to her car. She admitted she was drunk at the time, and her memory was hazy. But she did remember the moment her bottom touch the ground.“He was touching underneath the blanket, and I just remember being shocked. Uh, next he further proceeded to put his hand in my pants,” Doe said. While he attacked her on the ground underneath a dirty blanket, he tried to drug her with what she thought was a meth pipe, Doe continued. Detective Carlos Munoz of the San Diego Police Department also spoke in open court. After the case was assigned to him, he monitored surveillance cameras in the area. The detective found footage of a homeless man fitting Gary Cushinberry’s description, pulling Jane Doe into a bush next to her car. The two were not in frame for the next 25 minutes, until video captured Jane Doe speeding away from the parking lot, back into Amplified, where she later reported the assault.“It’s like you imagine a fight or flight. And I didn’t really fight and I didn’t flight. I just froze,” Doe said. Cushinberry, who is already a convicted rapist in Indiana, returned to the frame, just two minutes later. “When he walks up toward the intersection, or the corner, he is adjusting his belt, he is adjusting his waist,” Detective Munoz said. The next day, Jane Doe provided information for a suspect sketch.Officers also took her to Palomar Hospital to run a rape kit. DNA Criminalist Adam Dutra of the San Diego Police Department Crime Lab tested the DNA swab taken from the front button and zipper of Jane Doe’s shorts.“There was strong support for the inclusion of Mr. Cushinberry as the 98% contributor,” Dutra said. Cushinberry’s past convictions include rape in 1995, sexual battery in 1997, and recently, felony robbery in San Diego.His next court appearance is on December 19th. 2407

SAN DIEGO, Calif. (KGTV) - With car horns blaring, cellphone video captured a fight breaking out at a busy intersection in San Diego near Montgomery High School.The incident played out at Palm Avenue and Beyer Way - just feet from the high school - as school let out Friday afternoon. In the crosswalk, there was a flurry off punches. A teen in a hoodie is recorded battering another student on the ground. Some other teens joins the fray and more punches are traded."It's stupid. Why have a fight so dramatic like that? It could cause a car accident," a student told 10News. We are not naming the student at the request of their family.The student doesn't know what sparked the fight, but says those involved were juniors. The student told 10News this was the third big fight on campus this year. "Just make us look bad. Students should set a good example for our school," the student said.There were no accidents, but some of those drivers did get out of their cars. A witness tells us some tried to stop the fight. In the now-viral video, a crowd of people spill across the crosswalk. The melee lasted more than 20 minutes before it broke up. Police arrived but did not make any arrests.Janet Paz, a mother of two students at the school, says it sends a bad message."Makes me feel worried that kids aren't safe in school," said Paz.A spokesperson with the Sweetwater Union High School District says they believe they've identified the three-to-five students involved and are mulling possible discipline. Part of the investigation will include determining the cause of the fight and addressing any campus-wide issues. 1628

(KGTV) - As Governor Gavin Newsom orders seven California counties to close bars to stop the spread of coronavirus, San Diego County made that same decision on their own and now, some San Diego bars are trying to figure out how to stay open to save their future.Related: San Diego County to close bars that don't serve food ahead of July 4 to slow COVID-19 spreadThe directive from the county states that bars, wineries and breweries have to close by July 1 if they don’t serve food. There is an exception for businesses like rural wineries that have dominantly outdoor, spread out seating. For the food rule, a bag of chips does not count. An outline of the rules states businesses have to offer a sit down, dine-in meal and any alcohol purchased has to be on the same transaction of the meal.The co-owners of Carriage House Lounge said they don’t meet this requirement, but they’re brainstorming ways to add food so they can stay open.“Now we gotta close again? At least if we can open a little bit with some food, maybe we can make enough to pay the rent anyway so we don’t get deeper behind,” said Andrew Haines.Haines said he and his business partner Rachel Dymond been back open for less than three weeks before this second closure. During that span when they were open between closures, they barely hit 50% for sales, which has been enough to pay rent and paychecks, but not bring in a profit. They said they can’t consider a second closure, so they’re talking about bringing in catering or partnering with a local restaurant to have food and be able to stay open.They’re not alone in this plan.Chad Cline has ownership in multiple San Diego bars and restaurants, which he says have also been hurting financially through the last three months. He said his businesses that don’t serve food are also going to now have a food option so they can meet new regulations and be able to stay open. Cline said he doesn’t agree with the thought process behind the new law.“I don’t think any rational person is going to be able to wrap their head around the difference between going to a table and having a drink and then going to that same table and having a drink and a hamburger and the second trip is okay but the first trip is not okay,” said Cline.When asked why the food distinction was made, Supervisor Nathan Fletcher said bars lead to impaired judgement which can impact carefulness, people spend more time in bars, the loud setting requires people to yell which can spread droplets and the congregating makes contact tracing more difficult.Cline said they’ll follow the rules but he isn’t happy with the leaders who made this decision.“We just play the game and go okay we have to serve food so we’ll serve food, but if I’m being completely clear it is kind of a game at this point because we’re just trying to exist and we just have to figure out how to follow the guidelines,” said Cline. 2922

SAN DIEGO - At St. John The Evangelist's Sunday night service, the pews were packed to hear why their pastoral associate was resigning.Aaron Bianco was asked to come to St. John August of 2016. His work for the San Diego church: organizing events, budgets and other behind the scenes tasks. His goal, to build up a more inclusive church.Bianco has been married to his husband for 10 years last month, and once he started at St. John, so did the attacks."They've threatened me from shooting me down across the street, to throwing Molotov cocktails into the church," Bianco said.The hate groups sent emails equating him to a pedophile and threatening him. His tires were slashed, fire thrown at the church doors, the office broken into and spray painted with a gay slur."They're no different from organized crime or a terrorist group. They will continue until they get their way," Bianco said their goal was to force him out. "I'm convinced that the gospel is on my side, and they can spew their hate, but I'm not going to allow them to make me hate them back," Bianco said.Last week his personal information including photos of his family and his home address was published on a conservative Catholic website. Bianco said he saw someone in their yard in the middle of the night watching the house.Since the threats, he's added security to his home and filed police reports.He realized it was all too much, "My life and those of my family are more important than any job."Bianco addressed the packed church at Sunday night's mass, "when hate rages like a fire, love rains down, and I feel it from so many of you in this room."Bianco said he believes there is more good in the world than bad, explaining he's received encouraging notes from people all over the world.After his speech, the church erupted, "It made me so happy that everybody stood there and clapped for the longest ovation I've ever heard in a church in my life. Letting him know that we love you, we care about you and you're going to be missed," Parishioner Berena Pe?a said.She attended the church a decade prior and stopped coming because she didn't feel welcome as a lesbian. Her friend convinced her to try again two years ago. She said she could feel the difference, and it woke her up.Bianco said this is not the end, and he will keep fighting.
