Neighbors spotted them in the driveway on Sunday. Yogerst says they found his hidden spare key and walked right in."It was like a Holiday Inn. They were enjoying their stay," said Yogerst.Yogerst says the presence of homeless in the area has increased in the past two years."Some of the churches, God bless them, do feed them, but that does bring them in," said Yogerst.Yogerst says only a few items were taken, including loose change, toiletries, and prescription medication. One of the suspects has a distinct description: A transient African-American woman, about 5-foot 5-inches tall, with bright orange hair. SAN DIEGO (KGTV) - A federal judge has ordered the San Diego Police Department to stop citing people for living in their vehicles.The decision comes after a lawsuit was filed against the city by a group of homeless people and their advocates.On Tuesday, United States District Judge Anthony Battaglia agreed with the plaintiff’s argument that the city’s municipal code was too vague in defining what constitutes habitation of a vehicle.Tristia Bauman, an attorney with the National Law Center on Homelessness & Poverty which helped work on the case told 10News, “we are very happy and pleased that the judge understood what we were arguing.”However, that was only one half of the lawsuit. The other half targeted the city’s municipal ordinance that outlaws RV parking from 2-6a.m. Known as the Nighttime RV Ordinance, or Oversized Vehicle Ordinance (OVO), the judge denied the request to enjoin it, saying the same argument did not apply.In the decision, Battaglia wrote “while the court sympathies that this Ordinance leaves Plaintiffs with nowhere to park between these hours and is decidedly unfair, the law is not ambiguous, unclear or vague in any way.”A spokesperson for city attorney Mara Elliot declined to comment beyond saying they “will review the ruling and advise our client.”An early neutral evaluation conference had been scheduled for Thursday with all the parties. SAN DIEGO (KGTV) -- A 65-year-old woman was rushed to the hospital after being struck by a vehicle in Serra Mesa on Christmas eve. According to police, the incident happened just before 8 p.m. at the intersection of Ruffin Road and Village Glen Drive near the Village Glen Apartments. Police say the woman was crossing the street when she was struck by a 16-year-old driver. The woman was rushed to the hospital with major injuries. The teen remained at the scene after the crash. At this time, it’s unclear if drugs or alcohol played a role in the crash. Pedestrian struck by car while crossing Ruffin Rd in Serra Mesa. 65-year-old woman transported with major injuries. SAN DIEGO (KGTV) -- Security is tight at San Diego's mosques following an arson attack at a mosque in Escondido early Sunday morning. Someone set fire to the Islamic Center of Escondido on West Sixth Avenue around 3 a.m, but a handful of worshippers was inside, and the group put out the fire before it caused any significant damage. When police arrived, they found a message in graffiti referencing the recent shootings at mosques in New Zealand. Monday afternoon, two San Diego Police Department patrol cars sat in the parking lot of the Islamic Center of San Diego. Directors say worshipers are nervous. "They accept the faith of what happened, others are very, you know, worried as well. It's a mixed mood," said Khelil Ouznali, vice chair of the board of directors. The center already has surveillance cameras all over the property and guards on duty, but now the directors are considering hiring armed guards. "We are looking into improving security, you know, we are looking into different options based on the feedback from our community," said Ouznali. On the campus of San Diego State University Monday, dozens of students rallied against hate. They marched through the student union chanting, "No hate at state, Muslims are here to stay, no hate at state, Muslims are here to stay!" Faduma Mohamed is a member of the Muslim Student Association. "It just goes to show there's a lot of hate against us, but although some people can attempt to destroy Muslims, Islam itself the religion, cannot be destroyed," said Mohamed. The group posted pictures of the lives lost in the shooting rampages at the mosques in New Zealand and the attack at a Jewish Synagogue in Pittsburgh. "It doesn't matter what race, religion or color you are, every human life matters and we share a common denominator of a soul and spirit and that they should take part in respecting these people whose lives were lost," said Mohamed. 1926
