Jurors have found Border Patrol Agent Lonnie Swartz not guilty on the Second Degree Murder charge of shooting through the border fence and killing 16-year-old Jose Antonio Elena Rodriguez.Jurors could not come to an agreement on a verdict on the two lesser charges, voluntary manslaughter and involuntary manslaughter.If they wish, prosecutors can retry Swartz on the lesser charges only.Friday jurors told Federal Judge Raner Collins they could not agree on a verdict.  The judge told them to continue deliberating. They could choose to convict Swartz on lesser charges of Voluntary Manslaughter or Involuntary Manslaughter.Swartz testified he was protecting himself and other officers from rocks thrown over the border fence by people on the Mexican side trying to interfere with efforts to arrests smugglers who were trying to climb over the fence and into Mexico.In closing statements to the jury, prosecutors said in his two years as a Border Patrol Agent, Swartz had rocks thrown at him six or seven times, and each time had responded by using less lethal weapons. Border Patrol may use items like guns that shoot an irritating pepper.But the night of October 10, 2012, Swartz had been on duty at the DeConcini Port of Entry.  He had only his gun and used it to fire 16 rounds through the fence. Ten shots hit the 16-year-old Mexican teen.Prosecutors say the threat against Swartz and other officers was not severe enough to justify deadly force and that they could have easily removed any threat by taking cover.They say other agents took cover but Swartz was fed up with rockings, wanted to send a message, and did it by calmly walking to the border fence, taking careful aim, and firing 16 shots into Mexico.Defense attorney Sean Chapman told the jury rocks are enough of a danger to justify deadly force and that there is no evidence to conclude Swartz fired out of anger over rock attacks. Judge Amy Coney Barrett's Supreme Court confirmation hearing was beset by technical issues on Wednesday afternoon, as the Senate Judiciary Committee was forced to take two recesses when microphones in the room went dead.The issues began at 2 p.m. ET, about five hours into day two of questioning. Sen. Richard Blumenthal, D-Connecticut, was in the process of beginning his 20 minute period of questioning went microphones stopped working.The committee went into recess for about half an hour as Capitol maintenance workers attempted to fix the issue. Upon returning, Blumenthal was able to get through most of his questioning session before microphones in the room cut out again.The committee was forced to take another 15-minute recess to address the technical issue.It's currently unclear as to what caused the issue. 827

(KGTV) - A Monterey Cypress known as the “Dr. Seuss Tree” or “The Lorax Tree” toppled over early Thursday morning in La Jolla.The unique shaped tree has been theorized to be the inspiration for the colorful trees in “The Lorax,” written in 1971 by Theodor Geisel, known best as "Dr. Seuss."Geisel lived in La Jolla from 1948 until he died in 1991. The tree is located in Ellen Browning Scripps Park near La Jolla Cove.The tree had become a tourist destination for Seuss fans around the world, with its long, drooping branches and leaves.As of Thursday night the tree was still lying on the ground. JACKSON, Miss. (AP) — Mississippi lawmakers are taking steps to erase the Confederate battle emblem from the state flag. The symbol has come under criticism amid nationwide protests against racial injustice. The House voted Saturday to file a bill to remove the symbol that many see as racist. A committee would design a new flag including the words “In God We Trust.” Voters would decide in November whether to endorse that design. Mississippi has used the same flag for more than 125 years. Religious, education, sports and business leaders are pushing legislators to remove the Confederate symbol. Republican Gov. Tate Reeves said Saturday that he will sign a bill to change the flag. 695
