Brown hanged himself at Cuyamaca Rancho State Park in October of 2014, which his lawyers said was a result of the homicide investigation, as well as the seizure of numerous items of sentimental value from his Chula Vista home.Rebecca Brown's attorneys alleged now-retired SDPD Detective Michael Lambert misled a judge when securing an affidavit for a warrant to search and seize property at Brown's home. The affidavit was secured on the basis of Brown's sperm cells, which were found on a vaginal swab of Hough, though Rebecca Brown's attorney, Eugene Iredale, said those cells were most likely transferred onto the swab via accidental cross-contamination.Iredale told jurors that lab techs at the SDPD crime lab often used their own semen as reference samples when conducting testing for the presence of semen.Other DNA evidence found on Hough's clothing pointed to another suspect, Ronald Tatro, who was previously convicted in several other rapes and assaults on women. Tatro, who died in 2011, was matched to several blood stains and a pubic hair found on the girl's clothing, Iredale said.Despite Tatro's DNA being far more prominent on the swab, Iredale said Lambert used Brown's sperm cells and evidence that Brown had frequented strip clubs in the 1980s to suggest he worked in concert with Tatro in the killing.However, no such connection between the men was ever discovered, nor was Brown ever connected to the murder.Brown, who suffered from anxiety and depression, was "obsessed with getting his property back," Iredale said, yet was unable to secure their return over the course of several months.Iredale said the prospect of spending time in jail while fighting to clear his name and the property seizure was enough to push Brown to suicide.The attorney said Lambert was aware Brown was suicidal and held onto his property "because he knew it would cause pain and hurt, because he felt he was going to break him down, he was going to crack the case."Deputy City Attorney Catherine Richardson argued at trial that Lambert relied upon DNA experts when he wrote the affidavit and was not given all the information he needed.The attorney said Lambert asked about contamination when presented with the evidence of Brown's DNA, but was told by his sergeant that contamination was not possible. She also said Lambert was not informed that SDPD lab techs sometimes used their own semen for testing until months after the search warrant was secured.Richardson said the items from Brown's home had to be seized in order to prove or disprove a possible connection between Tatro and Brown, which would have dated back more than three decades, and that a rigid investigation was needed to prove there was no favoritism toward an SDPD employee."If he hadn't investigated (Brown), then the police would have been accused of covering up for one of their own," Richardson told the jury in her opening statement. 3615

SAN DIEGO (CNS) - A pedestrian was fatally stuck on the Mission Valley (8) Freeway in San Diego, according to the California Highway Patrol.The crash occurred on the westbound 8 Freeway near Hotel Circle about 8:15 p.m., the CHP reported.The body was found near the center divider. There was no immediate word on the age or gender of the victim. The person's name will be withheld pending notification of next of kin.The vehicle that struck the pedestrian remained at the scene, the CHP said.The crash was blocking two lanes and the CHP issued a SigAlert at 8:35 p.m. 575

SAN DIEGO (CNS) - Flames tore through a Mira Mesa home Wednesday afternoon, causing extensive damage, injuring a firefighter and displacing five residents.The blaze erupted for unknown reasons shortly before 2 p.m. in the 10100 block of Embassy Way, just west of Camino Ruiz, the San Diego Fire-Rescue Department reported.All the occupants of the house were able to safely get outside prior to the arrival of emergency crews, according to SDFRD public affairs.Watch firefighters battle the fire below:Firefighters arrived to find the residence engulfed in flames. SAN DIEGO (CNS) - A parolee who allegedly stabbed a pair of transients -- one fatally -- in two separate Midway District attacks on Thanksgiving Day was charged Friday with murder, attempted murder and assault with a deadly weapon. Forrest Robert Brantley, 38, of Ventura County, is accused of fatally stabbing 55-year-old Robert Erbe in the neck at about 8 a.m. Nov. 28 outside a business in the 3100 block of Sports Arena Boulevard, according to San Diego police.Brantley is also accused of stabbing another man three times in the back and arm on Sports Arena Boulevard about six hours prior to Erbe's slaying, according to Deputy District Attorney Will Hopkins.The prosecutor said that after stabbing the first victim around 2 a.m., Brantley returned to the area and approached Erbe and an unidentified second transient outside a 7-Eleven store.RELATED: Police identify man in deadly Thanksgiving Day Midway District stabbingHopkins said he offered Erbe drugs in a bag and then stabbed the victim while Erbe was looking through the bag.According to the prosecutor, Erbe asked Brantley why he stabbed him and Brantley responded, ``This is war,'' then stood over the victim and watched him bleed out.In the days following the stabbings, San Diego police circulated photographs of the defendant, which included images captured from surveillance footage on the San Diego trolley.Brantley was arrested in Ventura on Dec. 4 while walking near the intersection of the 101 Freeway and state Route 33, where officers recognized him from fugitive-suspect alerts, according to police in the coastal city north of Los Angeles.According to the prosecutor, Brantley posted on social media days prior to the stabbings that he was going to ``help the homeless,'' though his true intention was to target homeless victims.RELATED: Midway District murder suspect arrested in VenturaWhile the prosecution asked for no bail, San Diego County Superior Court Judge Jay Bloom set bail at million due to the ``totally senseless'' nature of the attacks on ``vulnerable victims,'' as well as the flight risk he believed Brantley represented.
