SAN DIEGO (KGTV)- San Diego County barely avoided falling back into the purple tier of the state’s reopening system, staying in the red for now.The color-coded tier system has been difficult for many business owners to deal with as they wonder if they will face more restrictions in the coming weeks.“We are working with the state to share our concerns and thoughts about the metrics they are using to put our county in the different tiers,” said Greg Cox, San Diego County Supervisor. "The reality is we remain at risk of being moved to the more restrictive tier in the future if we don’t do those things that we know we need to do.”Dr. Wilma Wooten, the county’s public health officer, said she and other health officers across the state have been pushing for the state to improve its metrics system to go beyond case rate and positivity rate.She would like to see three things happen.“If counties are maintaining hospitalizations and hospital capacities to somehow get credit for that, and also get credit for contact tracing,” she said.Wooten said the county should also get credit for providing access to COVID-19 testing in vulnerable communities hit the hardest.“San Diego has done an excellent job to date of getting access to testing in those communities that are hit the hardest,” she said.On Tuesday, the County Board of Supervisors passed a motion in a 4 to 1 vote to send a letter to the state backing Wooten’s effort in revising the reopening criteria.Wooten is urging members of the public to continue wearing a facial covering, washing hands, avoiding large gatherings, and staying home when sick, especially as flu season is on the way.“We do not have a vaccine for COVID-19, but we have a vaccine for the flu,” she said. “Getting the flu vaccine is the most important step in preventing the flu.” 1822

SAN DIEGO (KGTV): A new study shows that young adults are seeing a spike in deaths from liver disease related to binge drinking. It's especially dangerous in California, where high alcohol content drinks are popular.The study, published this month in the British Medical Journal, says that the number of 25- to 34-year-olds who died annually from alcohol-related liver disease nearly tripled between 1999 and 2016, from 259 in 1999 to 767 in 2016, an average annual increase of around 10 percent.It cites binge drinking as a leading cause, because of rising rates of alcohol consumption between 2002 and 2012.It's especially bad in California, which the study says was among the top five states for those types of deaths.Local experts say the kind of alcohol we drink may be to blame, as craft beers tend to have higher concentrations of alcohol."If someone was having highly concentrated alcohol, then they're consuming more drinks per hour," says Dr. Rohit Loomba, with the UC San Diego Health Liver Center. "That will have detrimental effects on the liver, for sure."The CDC recommends no more than 1-2 drinks per day for "moderate" drinking. Binge drinking is defined as 4 or more drinks over 4-6 hours. Loomba says you may hit the "binge" point in fewer drinks if what you're having is stronger.For example, a Bud Light has just 4.2% alcohol by volume. Craft beers often have 6% or higher, so one craft beer may be as much as 2 or 3 other drinks."That quantity of alcohol intake over years definitely will contribute to higher risk for liver disease," says Loomba.He says people should ask themselves four questions to determine if they are drinking too much:1. Have you ever cut down on drinking? 2. Would you be annoyed if somebody asked you to cut down on drinking? 3. Do you feel guilty after drinking excessively over a weekend? 4. Do you need an "eye-opener" in the morning to get to work?Dr. Loomba says if you answered "yes" to 2 or more of these questions, you should talk to your doctor to discuss treatment.He also says obesity combined with alcohol can lead to more severe liver problems and even death. People with diabetes or who are overweight multiply their risk of the disease."If you're obese, you not only should restrict your alcohol, but you should try to lose some weight as well," says Loomba.The study says the financial crisis may have led to more binge drinking in the past decade, as young adults turned to alcohol to cope with financial stress. Researchers found the rise in alcohol-related deaths overlaps with rising rates of binge drinking from 2002 to 2012 observed across much of the U.S.The good news, according to the study, is that many liver diseases are preventable and reversible."Once you stop alcohol use, you can reverse complications related to it in the majority of cases," says Dr. Loomba. 2882

SAN DIEGO (KGTV) -The extended patio seating in the Gaslamp Quarter is here to stay for now, according to the Gaslamp Quarter Association.Thanks to a special events permit, as long as social distancing is required, restaurants will overflow into the streets with patio dining Thursday through Saturday each weekend through the end of the year.Manager at The Field Phil Nestor was thrilled to see how busy it was Saturday, saying the patios made a "100%, a million times over," difference to recuperating after being shut down during the pandemic.He said people feel more comfortable sitting outside, and diners said they enjoyed the atmosphere."I think it's actually a pretty good idea, it reminds me of my time in Europe so I think it's pretty cool," Luis Morales said.Fifth Avenue shut down between G and L Streets Thursday through Saturday to make way for the patios, and was slow to start."I think the first day everyone was finding their feet I guess, they were seeing how many tables they could put in their area," Nestor said.By Saturday nearly a dozen restaurants expanded into the streets.Morales said they enjoyed themselves, "we came out to get together with the boys and just finally get a sense of normalcy."Right now normalcy comes with hand sanitizing stations at each table and masks while you're waiting to be seated."I always take my precautions," one diner said. The man said he came down from Los Angeles to celebrate his birthday and felt safer in San Diego compared to up north where Orange County reduced their mask policy to "strongly recommended."Last weekend images of crowds not social distancing, or wearing masks in the Gaslamp Quarter garnered harsh words from County Supervisor Nathan Fletcher. He said earlier this week targeted enforcement would ensure this doesn't happen again.Nestor said the weight falls on restaurants to enforce the county's policies, "we're responsible for our patio and the surrounding areas and making sure people are in the line wearing masks and they're social distancing.""You can't just run into the street and tell someone to do something but you're doing your best and I think most people whether they're drunk or not, I think taking responsibility for themselves too which is a good thing to see," he said.He and other businesses are hopeful as long as the patio dining is successful and they keep everyone healthy this could become a more permanent fixture."I hope it becomes a permanent thing, a lot of the restaurants do," Nestor said, hopeful business will continue to climb, helping them recover from the pandemic. 2592

SAN DIEGO, Calif. (KGTV) - A former assistant at a local nursing home is accused of raping a disabled patient. In a story that you'll first see on 10News, Team 10 investigative reporter Jennifer Kastner discovered the patient was a stroke victim who uses a wheelchair. What may have happened behind the walls of the Paradise Hills nursing home is difficult to process. An accusation of rape seemed to have slid under the radar for almost a year, until now. It was a few months ago when 10News was tipped off about Reo Vista Healthcare Center, which touts being named one of Newsweek's top nursing homes and having a Medicare 5-star rating.This week, San Diego Police confirmed that detectives referred the case to the District Attorney's office, which is charging 26-year-old Ariel Chavarin-Camargo with forcible rape and a "lewd act upon a dependent adult by a caretaker". He is now sitting in a South Bay jail. According to state documents, it happened last February to a 58-year-old woman who uses a wheelchair and was living in the nursing home after suffering from a stroke and panic disorder. The documents report that the morning after the alleged assault, she reportedly came "crying" to a nurse, claiming that the night before, when she was returning from the kitchen and on her way back, "one of the CNAs (Certified Nursing Assistants) stated that one of her breasts was exposed." According to the documents, he “followed her and he exposed his private parts to her". She reportedly said, "the CNA raped her" for up to three minutes. A forensic exam reportedly found male DNA in her private area. According to the documents, when he was later questioned, he suggested that she came onto him but admitted "it happened” and “there was penetration". He reportedly said, "I feel bad. It happened so fast." Prosecutors believe that man is Chavarin-Camargo. He resigned after the reported rape. The administration of Reo Vista Healthcare Center sent 10News the following statement on Tuesday."We are grateful to local law enforcement and the District Attorney’s Office for successfully prosecuting this individual for their crime. Our team took immediate steps last February to suspend the individual, to notify, and to fully cooperate with authorities. We take all matters regarding patient safety and the conduct of staff seriously. Moreover, the actions of this individual do not reflect the values we hold at our facility. SAN FRANCISCO — A California appeals court has upheld an order requiring Uber and Lyft to treat their California drivers as employees instead of independent contractors, less than two weeks before voters will be asked to exempt the ride-hailing giants from the state’s gig economy law. The two companies have more than 400,000 drivers in California alone. Treating Uber and Lyft drivers as employees would guarantee benefits such as overtime and sick leave.Uber and Lyft had appealed an August ruling by a San Francisco judge, but the appellate ruling found "no legal error" and allowed the earlier ruling to stand. The legal fight started after state lawmakers passed a law that says companies can classify workers as contractors only if they perform work "outside the usual course" of the company's business.
