SAN DIEGO (KGTV) — An 18-year-old San Diego student who has already cemented her place in climbing has now grabbed a historic Olympic accolade.Sunday, Brooke Raboutou, of Boulder, Colo., qualified for the Tokyo 2020 Games to become the first-ever American to qualify for Olympic climbing, according to the U.S. Olympic Committee. The University of San Diego sophomore finished ninth in the combined qualification round at the IFSC Climbing World Championships in Hachioji, Japan, according to Team USA. She had the sixth-fastest time in the speed round and ranked seventh- and tenth in lead and bouldering, respectively.RELATED: Vista skatepark draws 2020 Olympic hopefulsThe Tokyo 2020 games will mark the first time climbing is included as an Olympic sport, following a 2016 vote to add the sport to the Olympic program.She was named to the first U.S. national climbing team earlier this year.In Tokyo, Raboutou will compete in the combined event, which includes competitions for speed, bouldering, and lead. Her final rank will be based on the results from all three events.U.S. athletes will have two more chances to qualify for the 2020 team. Next in the fall at the Olympic Qualifying Event and in 2020 during continental championships. The Tokyo games will take a maximum of two qualifying athletes from each country, featuring 20 athletes per gender.Raboutou has been competing from a young age, beginning her climbing career when she was 7 years old, according to Team USA. At 11, she became the youngest person in the world to complete a 5.14b-grade climb. She is also 2018's lead youth world champion, 2016 combined youth world champion, and 2017's combined youth Pan American champion. Raboutou skills come across as a genetic trait, as her parents were each multiple-time climbing world cup champions and her older brother is also an accomplished climber. SAN DIEGO (KGTV) — A Scripps Ranch woman who contacted Team 10 about problems with her Samsung refrigerator is now receiving a full refund after Team 10’s story aired.Stephanie Nivinskus bought her Samsung french door refrigerator in December 2014. It cost her nearly ,000. She said she had issues roughly six months after she bought it. "It's been a headache since the beginning," Nivinskus told Team 10 in September.The first problem was the ice maker does not function properly, according to Nivinskus."The ice just gathers and collects up there. It makes it so it doesn't work," Nivinskus said.She also has issues with the temperature of the refrigerator. The FDA says a safe temperature inside a refrigerator is 40 degrees or below. During the initial interview with Team 10, the thermometer inside of Nivinskus' refrigerator read about 56 degrees."Having spoiled food is a real problem," she said. Shortly after, a full refund for her refrigerator was processed.“Thank you so much for helping us because fighting by myself, I was getting a whole lot of nowhere,” Nivinskus said.Samsung is currently facing a class-action lawsuit regarding the broken ice makers. There are also more than 5,400 people in a Facebook group demanding a recall of Samsung refrigerators.In an email, a Samsung spokesperson told Team 10 in response to the initial story: "At Samsung we stand behind all of our products, including our refrigerators, and want to ensure our customers are completely satisfied. If a customer encounters any problem with their product or service, we encourage them to reach out to us directly at 1-800-SAMSUNG so we can provide assistance."Nivinskus said she spoke to customer service before contacting Team 10. SAN DIEGO (KGTV) — A San Diego veteran is suing 3M Company alleging earplugs he wore while in the military were defective. He’s the latest in a series of lawsuits that have been filed against the company by service members across the country.Kevin Alicie filed a lawsuit on Wednesday claiming he “used Defendant’s dangerously defective Dual-ended Combat Arms? earplugs during tank firing, training firing, other live fire training, vehicle maintenance, and during other training and combat exercises.” According to the lawsuit Alicie wore the earplugs while at Camp Pendleton and was first diagnosed with hearing loss in California. Alicie tells 10News during his military carrier he started having problems with his hearing. He’d hear ringing. He says he didn’t think much about it until the ringing started to become more frequent.“I mentioned it to the doctor when I was doing my final physical, and sure enough when they did that last hearing test they found that there was hearing loss,” Alicie said.The lawsuit says 3M did not inform the military or Alicie that the earplugs were defective and failed to adequately warn that the earplugs did not meet the military’s sound requirements."The biggest defect is they don't do what they are advertised to do,” said Alicie’s attorney John Gomez. “Essentially they are supposed to protect your ears and your hearing in proximity to loud sounds that can cause hearing loss or damage.”Attorney John Gomez says the earplugs were standard issue in certain branches of the military between 2003 and 2015.“Without question, I think tons of users-consumers and potential victims reside right here in San Diego County,” Gomez said.According to a July 2018 press release from the United States Department of Justice, 3M agreed to pay .1 million to resolve allegations that it supplied the United States with defective dual-ended combat arms earplugs.The release says, “the United States alleged that 3M, and its predecessor, Aearo Technologies, Inc., knew the CAEv2 was too short for proper insertion into users’ ears and that the earplugs could loosen imperceptibly and therefore did not perform well for certain individuals. SAN DIEGO (KGTV) -- Amid ongoing dockless scooter injuries, Mayor Kevin Faulconer Thursday proposed new rules for the devices.The new rules would force companies that provide the dockless scooters to educate riders, provide data to the city, enforce speed limits and purchase permits.Riders would also be required to sign away any of the city’s legal liability should something happen.Speed limits would need to be enforced by the companies using “geofencing technology,” Faulconer said. SAN DIEGO (KGTV) - An inmate at R.J. Donovan State Prison has filed a lawsuit against the California Department of Corrections and Rehabilitation.Anand Jon Alexander filed the complaint on Monday, alleging prison officials failed to keep him safe and to provide adequate medical care after he was assaulted behind bars.In the complaint, Alexander claims he was attacked by another inmate while waiting to make a phone call on May 18, 2019. He was allegedly stabbed multiple times in the face and kicked on the ground.After the attack he sustained “five facial fractures, a lower orbital floor blowout, sinus and nasal fractures, a deviated septum, a 50% abrasion to the right cornea, long term impairment of his vision and respiration, serious nerve damage, PTSD” according to the complaint.Alexander is 12 years in to a 59 year sentence after he was convicted of rape in 2008.An up and coming fashion designer, Alexander had been featured on “America’s Next Top Model” and was listed in Newsweek’s “Who’s Next in 2007.”But his career was put on hold after being accused by multiple women of sexual assault.Many of the charges were dropped, but he was convicted on one count of rape and 15 other counts following a trial in Los Angeles. The jury found him not guilty or were hung on several other counts.Alexander has maintained his innocence. In the complaint, his lawyer writes he “has acknowledged the existence of blurred lines between his personal and professional relationships…Nevertheless, he holds steadfast to his innocence.”The American Justice Alliance, a group which seeks to free prisoners who have been wrongfully convicted, submitted an amicus brief to the Federal Central District Court.In it, they wrote Alexander “was targeted by a collusion of disgruntled business associates and some former girlfriends, who have admitted they were out to “bring him down,” and “get revenge,” seeking notoriety and monetary benefits. He was then subject to a prosecution and trial riddled with extraordinary police misconduct.”The lawsuit names CDCR as well as Marcus Pollard, the Warden of R.J. Donovan Correctional Facility and Daniel Paramo, the former Warden.It alleges prison officials failed to protect Alexander from harm and after he was injured gave “deliberate indifference to Mr. Alexander’s medical condition.”They are seeking unspecified monetary damages and a jury trial.So far, no criminal charges have been filed against the assailant. 10News reached out to CDCR for comment but had not heard back before the story was published. 2557
