SAN DIEGO (KGTV) - Newly unsealed court documents reveal how investigators were able to identify the suspected Church's Chicken shooter.Albert Lee Blake, 49, was arrested weeks after the shooting erupted inside of the Otay Mesa West restaurant. Blake is accused of shooting three employees and killing Maribel Ibanez. The shooting happened after an argument stemming from Blake allegedly trying to use a fake 0 dollar bill to purchase food. A number of witnesses gave similar descriptions of the man seen shooting inside of the Church's Chicken. Witnesses reported the man coming back into the restaurant after the argument, standing in line, then shooting at employees. They also said he calmly walked away after and got into a blue sedan.RELATED COVERAGE: Court documents reveal details in Church's Chicken murder investigationAccording to search warrant affidavits, surveillance footage from the area revealed the car used by the alleged shooter. Police ran the license plate through their database and found a match. The same vehicle was connected to a stop in September and the driver then was Albert Blake. Armed with Blake's name, investigators received “call data records” made from Blake’s cellphone on Nov. 6, the day of the shooting.The documents reveal the calls were made in close proximity to the Church’s Chicken on Del Sol Blvd.Surveillance footage showed a blue Dodge Charger in the area, matching the one Blake was stopped in before, at the same time the calls were made.RELATED COVERAGE:-- TIMELINE: Events that led to Church's Chicken shooting-- Worker dead, two employees shot at Church’s Chicken in Otay MesaOn Nov. 7, investigators traced the cellphone to Pomona where it was found abandoned. Investigators say Blake used the phone to contact his wife and a woman he was dating, right after the shooting.The car he was driving was registered to his wife. In the documents the wife, Amy Collins, says the two have been separated for three years, but she allowed him to use the car.She also told investigators that when she asked for the car back, Blake told her she would never get it back and that he would "blow the vehicle up."According to the documents, investigators later went to the girlfriend's apartment in Spring Valley. Blake was captured in Memphis, Tenn., and brought back to San Diego where he was formally charged.The documents don't reveal how he was tracked down to Tennessee.He was charged with one count of murder and two counts of attempted murder. He faces up to 114 years to life in prison. Blake is due back in court for a preliminary hearing in February. 3040

SAN DIEGO (KGTV) - Protesters are demanding a change to how sex education is taught to students in California. They say a law passed a few years ago and written by local Assemblywoman Dr. Shirley Weber is sexualizing young minds. The group of protesters is with the Alliance to Protect Children. They tell 10News they are for sex ed in school, but the law is teaching students more than what parents are comfortable with. “It feels like its a disrespect to all mothers and children everywhere,” said mother of two Domonique Hinton. Dozens of protesters stood outside Dr. Shirley Weber’s office downtown Friday morning, speaking against Assembly Bill 329 that was written and passed in 2015. The bill makes it mandatory for students 7th through 12th grade to be taught sex education, but it also gives schools the option to offer the age-appropriate curriculum to lower grades. AB 329 states, “‘Comprehensive sexual health education means education regarding human development and sexuality, including education on pregnancy, contraception, and sexually transmitted infections.”Protesters say graphic details of sexuality should not be taught in schools. “That is not the same as sex ed like we probably had in high school or middle school. That's something different,” says organizer America Figueroa. “Just that word, sexuality, it includes a lot of things in it like the teaching of other ideologies as well as sexual behaviors.”The group says a new bill will be introduced next year that will allow parents to review the curriculum online, so there is complete transparency. 10News reached out to Dr. Weber’s team. SAN DIEGO (KGTV) -- Police are looking into an apparent road rage-related chase and collision involving two women that spanned the length of Interstate 8 between Mission Valley and Ocean Beach.Officers said the women were traveling more than 100 mph on westbound I-8 in Mission Valley before they exited in the Ocean Beach area.When both women got to Sunset Cliffs Boulevard, police said the driver of a silver car rammed the other driver’s white SUV several times. The SUV then forced the other car to collide with a center divide.The SUV’s driver got out of her vehicle and confronted the other driver; she reportedly told police she pepper-sprayed the silver car’s driver because she became aggressive.ABC 10News learned the pepper sprayed driver told police that she and the other woman were dating the same man.However, the SUV’s driver claimed she did not know the silver car’s driver.There is no word if anyone was arrested, as police are still trying to sort out the details. 991

SAN DIEGO (KGTV) - On this holiday, some extra thanks for a Clairemont family, months after an expectant mother was placed on a ventilator from COVID-19."This Thanksgiving, I’m thankful to be here with my family," said Ashley Duque.That family includes Ashley, her husband Diego, their daughter Anna, 3, and the newest addition, three-month-old Lucas."He came out our miracle baby," said Ashley.The miracle emerged from a pandemic. In March, 17 weeks into her pregnancy, Ashley was hospitalized with coronavirus, before being placed on a ventilator for five days."It was very, very scary," said Ashley.She spoke to ABC 10News from her hospital bed while recovering. Ashley was discharged after more than two weeks, but she would be back for nine different surgeries from complications from the COVID-19 treatment.Most of the surgeries involved removing scar tissue in her throat caused by her time on the ventilator.Then in August, Ashley was back in the hospital, as she went into labor three weeks early."I was nervous and scared," said Ashley.Despite her COVID battle and her other health issues, Lucas Duque was born August 25, weighing 6 pounds, 6 ounces. He was healthy."We’re just very blessed that nothing happened to him," said Ashley.On this Thanksgiving holiday, there is a mix of emotions. Ashley is still having issues with the scar tissue, but Ashley and Diego are feeling an overwhelming feeling of gratitude."In a flip of coin, anything can happen. Just very grateful to have my family with me. They are my world," said Diego."Learned to cherish every moment. Definitely our most grateful Thanksgiving ever," said Ashley. 1645
