ESCONDIDO, Calif. (KGTV) -- It was a murder-mystery that gripped San Diego County. The family of 12-year-old Stephanie Crowe, waking up on the morning of January 21, 1998, to a horrifying discovery.Stephanie - lying dead on her Escondido bedroom floor in a pool of blood, after being stabbed multiple times.Her family told detectives they were asleep inside the house when the murder happened and heard nothing. Detectives say they found no signs that someone forced their way inside.The investigation and court battles that followed would change the way law enforcement collects evidence and performs interrogations."It was a case where there were clearly major problems with the investigation," said Brad Patton, Richard Tuite's criminal defense attorney. "The problems with the investigation related to the crime scene."Patton spoke with 10News on Thursday, nearly 20 years after Stephanie's death. He told 10News the problems surround the case were how police collected evidence and how detectives interrogated suspects. Problems that caused the case to turn cold - letting Stephanie's true killer continue to walk the streets in San Diego County.  "I don't think the Crowe family will ever get closure," Patton said. Who killed Stephanie Crowe?In the months after her death, Stephanie's 14-year-old brother, Michael and two of his friends would be charged with the murder. A knife was found under the bed of John Treadway. Both he and Stephanie's brother Michael later confessed to detectives during videotaped interrogations.The boys were subjected to intense, prolonged questioning and deprived of food and sleep. The confessions were later judged to be coerced and the charges were dropped. Then, a new suspect. Richard Tuite. He was a transient and diagnosed schizophrenic. Brad Patton was his defense attorney. Tuite was seen in the Escondido neighborhood that night - banging on doors, looking for an old girlfriend. Most damning of all, he was seen wearing a sweatshirt with Stephanie's blood on it. "Mr. Tuite could not, did not, go into that house. There was no forensic evidence of him being in that house," Patton said. There were no hairs, no fibers, no DNA. Tuite claimed he found the sweatshirt while dumpster-diving. Tuite was convicted and would spend more than a decade behind bars. Then, he got an appeal.  An appeal where he was found not guilty of voluntary manslaughter. Stephanie's parents never suspected her brother. Years ago, her mom had this to say to 10News, after Tuite was cleared:"I just hope that North County is aware that he's going to be out walking the streets and that people lock their doors."The murder of Stephanie Crowe is still unsolved.Patton says there's only one way he sees the mystery solved. "You're probably never going to find the actual killer unless that person comes forward at some time," he said. The Crowe family has since moved to the Pacific Northwest. Patton is now living in the South Bay. 3027

(KGTV) - A driver under the influence of a drug struck and injured a Caltrans worker on Interstate 15 in Escondido Thursday, the California Highway Patrol said.A Nissan Sentra driven by a 26-year-old man was headed south on the freeway south of 9th Ave. about 10 a.m. and struck the Caltrans-owned Dodge Ram truck which was stopped in the center divider near the HOV lane. Officers said the Nissan’s driver allowed his car to drift into the center divider.The Caltrans worker had moderate injuries. The Nissan’s driver complained of pain but refused treatment at the scene. One of his male passengers suffered major injuries; other had moderate injuries.CHP officers evaluated the Nissan driver and arrested him at the scene on suspicion of DUI. 776

(KGTV) -- Fire crews Tuesday battled a small brush fire that threatened a structure in Fallbrook.According to Cal Fire, the four-acre blaze, dubbed the Cathy Fire, started on Daily Road and Lynda Lane. Cal Fire later tweeted that the forward rate of spread had been stopped. By 7 p.m., containment had reached 100 percent. 378

Facebook announced on Tuesday that it would no longer accept ads that discourage people from getting vaccinated onto its social media platform.In a press release, Facebook said they were launching a campaign to give its users useful information regarding vaccines and keep them safe and healthy during the pandemic.The social media company said Tuesday that they would roll out the ad ban in the "next few days.""Today, we're launching a new global policy that prohibits ads discouraging people from getting vaccinated. We don't want these ads on our platforms," Kang-Xing Jin, Facebook's head of health, and Rob Leathern, a Facebook director of product management, wrote in a blog post.Along with the ad ban, Facebook also launched an initiative that'll include new flu product features that provide additional vaccine-related content and work with global health partners on campaigns to increase immunization rates.Ads are still allowed if they advocate for or against legislation or government policies around vaccines – including a COVID-19 vaccine, Facebook said.Facebook also said it would be rolling out the ad ban in the coming days. 1149

(KGTV) - Escondido restaurant owners made the decision to stay open for indoor and outdoor dining after a court ruled Friday evening they must be take out only.On Grand Avenue, it looked like a time warp. People were back under tents and umbrellas eating and drinking on the patio and some indoors.At Tony Pepperoni Pizzeria, the sign in the window blinked "Open.""The restaurant business isn't something you can say hey close, open, close," Tony Pepperony Pizzeria Owner Joe Locricchio said.That's exactly what he's been dealing with for the last 10 months."We have livelihoods on the line... I have single mothers okay, they need to buy diapers. I have guys that haven't had a job and they're walking out of here with money every night in tips." Locricchio said his 80+ employees are like family.Staying open hasn't come without challenges.He said he was criminally cited by Alcoholic Beverage Control and issued a cease-and-desist order by the City of Escondido.His restaurant on Grand Avenue just opened 17 days ago.When asked what he had to say to critics who think he should close and are worried about the coronavirus killing San Diegans, he said, "listen, my heart goes out to everybody that's passed away, one death is too many. To those critics who have something to say about my decision, listen I respect their decision. I respect that they have the choice to not have to come here they don't have to support me, all I ask is to support my decision."He said strangers have yelled and ranted to him about his decision.He said what is more compelling, is how the community has shown their support, "it's been an overwhelming response. It makes my hair stand up, I'm going to be honest with you, the community has been unbelievable."Other restaurants are staying open too and Locricchio encourages more to follow their lead.This while hospitalizations continue to soar and health officials say it's safest to stay home.Locricchio said the choice is yours.He said the criminal citation means he could have his Liquor License temporarily taken away.
