SAN DIEGO (KGTV) — The deadline to register to vote in the upcoming election is this Monday, Oct. 19, but unlike most states, California offers a backup option for people who miss the deadline.It’s called conditional voter registration or same-day voter registration, a process that allows California voters to register in person through the last day to vote on Nov. 3. Voters who register conditionally must cast a provisional ballot, which takes longer to verify and appear in the final tally.In the November 2018 midterm election, 2,353 voters used the conditional registration process, according to the San Diego County Registrar of Voters Office.Starting Oct. 20, voters in San Diego County can register conditionally by visiting the Registrar’s Office in Kearny Mesa at 5600 Overland Avenue.“They would register, and then go over and receive their ballot and vote that same day,” said Registrar Michael Vu.Beginning Oct. 31, polling places will open, and voters can register conditionally and cast a ballot there. However, you will want to go to the polling place assigned to your address, which you can find at sdvote.com.Voters who go to the wrong polling place will be allowed to vote for certain offices, like president, but they could have selections for local offices like city council invalidated if the polling place is located in a different district.California started allowing conditional or same-day registration in 2017. It is one of 21 states to allow the practice.Individuals seeking to register conditionally must provide their driver’s license number or the last four digits of their Social Security number to prove they’re eligible, along with their address and other information.Voters do not need to show ID or proof of residency, except in rare circumstances.Once conditionally registered, the voter will be given a provisional ballot. A provisional ballot is just a ballot that’s placed in an extra envelope with a little more information from the voter so election workers do an added layer of verification before the ballot is counted. That takes time.“Generally they are counted last,” Vu said.There are other instances when voters might have to cast a provisional ballot: like if you’re registered but go to the wrong polling place, or if you want to vote in person and forget to bring your mail-in ballot to surrender. In some cases, poll workers can electronically view the status of your mail-in ballot without the need to surrender it, but in other cases the voter may have to vote provisionally.With conditional voters, election officials will first verify that the person is eligible to vote, then they’ll make sure that person hasn’t voted already before adding their ballot to the tally.Voters who successfully complete a conditional registration will automatically be considered registered for future elections. 2860

SAN DIEGO (KGTV) - The County of San Diego filed a lawsuit Wednesday against the heads of Homeland Security, Border Patrol, Customs and Border Protection, and Immigration and Customs Enforcement, calling for the reinstatement of the “Safe Release” program and reimbursement for the cost of treating a recent influx of asylum seekers. Homeland Security Secretary Kirstjen Nielsen, Acting Immigration and Customs Enforcement Director Ronald D. Vitiello, Immigrant and Customs Enforcement Executive Associate Director Matthew T. Albence, Commissioner of Customs and Border Protection Kevin K. McAleenan, and Chief of Border Patrol Carla L. Provost are named in the lawsuit. The lawsuit claims the county has been harmed as a result of what it describes as a “sudden and unlawful change” in policy, releasing asylum-seeking migrants from federal detention into the county while “denying them previously-provided assistance in reaching their final destination(s) outside the County.” RELATED: Reaction: County of San Diego sues federal agency chiefs over asylum seeker careFrom 2009 to October 2018, ICE implemented a policy described in the lawsuit as “Safe Release”, which provided asylum seekers assistance in reaching final destinations outside San Diego, attorneys say. The aid came in the form of phone calls and transportation to other areas of the U.S. ICE officials said the policy ended last fall due to limited resources to support the program, according to the suit. The lawsuit claims some 40 asylum seekers and family members were dropped off at a San Diego bus station within 24 hours after the end of Safe Release. County attorneys say since then, as many as 80 parents and young children have been released into San Diego County each day. County attorneys wrote the vast majority of asylum seekers and family members must remain in the area without sufficient means to support themselves. Projected costs of the County’s assistance exceed .1 million as of Mar. 22, the county reports. County officials are calling for a judge to reinstate the Safe Release policy and rule that the change in federal government policy violated Administrative Procedure Act. The County of San Diego also wants a preliminary and permanent injunction requiring the defendants to resume providing asylum seekers and their family members assistance in reaching destinations outside the County. SAN DIEGO (KGTV) - The mother of Rebecca Zahau testified Thursday in the second day of the civil lawsuit surrounding the Coronado mansion death.Rebecca Zahau died in July 2011. Her nude, bound body was found hanging from the balcony of the Spreckels mansion.The death was officially declared a suicide but Zahau's family disagreed. They filed a wrongful death civil lawsuit against Adam Shacknai, the brother of Zahau's boyfriend.Shacknai’s lawyers argue there is no physical, eyewitness, or scientific evidence linking him to Zahau’s death.Zahau's mother, Pari Zahau, took the witness stand Thursday morning and gave an emotional testimony as she was asked questions about her daughter.She remembered her as a sweet, loving and religious woman. The jury has three days off and will hear testimony again Monday.The family’s attorney Keith Greer handed Pari Zahau a piece of evidence and asked her to describe what it was.It was an envelope full of cash from Rebecca Zahau addressed to Pari Zahau and her late husband.Pari Zahau explained to the jury her daughter would support her financially by sending cash every month. That envelope was never sent, although one of the final times Pari Zahau talked to her daughter, she was told it would be on the way soon.Pari Zahau had to take a break from testifying when lawyer Keith Greer asked, “Did you ever think Rebecca would kill herself?”She gave a tearful response saying, “No. No, never. Never. My daughter? No. She is very sweet girl and she is very strong. No no, not suicide, they killed her.”After Pari Zahau broke down in tears, the lawyer asked for a brief break.The trial is expected to last a month. The Zahau’s family’s goal is to get the Sheriff’s Department to reopen a criminal investigation. 1802

  

SAN DIEGO (KGTV) - The family of a YouTube star who drove his McLaren the wrong way on the 805 last year, killing a mom and her daughter, are suing the City of San Diego, County of San Diego, and the Psychiatric Emergency Response Team (PERT).The lawsuit claims the “horrific and tragic event” was entirely preventable.Eighteen-year-old Trevor Heitmann, known as McSkillet, drove his McLaren the wrong way on the freeway in August 2018, killing Aileen Pizarro and her 12-year-old daughter Aryana. The sports car collided with the family's SUV, which burst into flames.RELATED: Autopsy details mental state of McSkillet before deadly crash on Interstate 805 in San DiegoIn the lawsuit Heitmann's family claims "SDPD was warned by Plaintiff's on the day of, but before his death, that Trevor intended to drive his McLaren at a high rate of speed in the wrong direction on a public roadway, under the delusion that he (Trevor) could drive through vehicles traveling in the opposite direction without incident."Worried about their sons' dangerous intentions and fearing for his well-being, as well as the safety of others, Dr. Mary Rusher, a board-certified psychiatrist, called 911 and made a 5150 request for a psychiatric hold, the lawsuit alleges.The lawsuit claims, "Defendants' purported PERT response team conducted either or both no assessment or the wrong assessment of the mental health status of Plaintiffs' son Trevor, pursuant to and under California Welfare and Institutions Code 5150."RELATED: YouTuber's parents requested psychiatric evaluation before deadly I-805 crashIt alleges, defendants also failed and refused requests to take Heitmann into protective detention to transport him to a designated evaluation and treatment facility."As a consequence, and despite Plaintiffs' attempts to ensure their son's safety and the safety of others by blocking the driveway of their residents, Trevor later that day left his residence and drive the McLaren to the Interstate 805 Freeway where he was killed in the beforementioned collision, which also tragically took the lives of the Pizarros."A spokesman for the County of San Diego told 10News they couldn't comment.RELATED: Son remembers mother and sister after release of driver's autopsy in deadly 805 crashAs of this writing, officials with the City of San Diego and PERT have not responded to 10News requests for comment.This is the third lawsuit filed regarding the 2018 crash.
