SAN DIEGO (KGTV) - Approximately 900,000 San Diegans who pay for sewer services may have had their rights violated.It’s part of what being alleged in a massive new class action lawsuit against the City of San Diego, its Public Utilities Department and the San Diego City Council.The suit calls it an “illegal financing scheme”. Attorneys who brought the suit claim the issue surrounds the city’s million smart water meter system and how it was paid for.  The lawsuit alleges the city knowingly used about million from the city's sewer fund instead of the city's water fund to help pay for that meter system.Subsequently, hundreds of thousands of San Diego sewer ratepayers were allegedly misinformed about what their money was being used for. Attorneys argue sewer ratepayers were quite possibly paying for a system that they did not necessarily benefit from- the smart water meter system. It’s still unknown whether there were any rate hikes directly tied to this.The suit claims the situation was an unconstitutional grab of million in funds.The San Diego City Attorney’s Office is reviewing the complaint and will respond through the court. 1183

SAN DIEGO (KGTV) - As coronavirus cases climb, a cancer patient faces an excruciating choice: Risk the trips to San Diego for potentially life-saving treatment or not.He was the picture of health, but in 2014 at the age of 45, Bryce Olson was diagnosed with an aggressive, stage 4 prostate cancer."I couldn't believe it. No family history of prostate cancer. Exercised every day," said Olson.Various treatments have kept his cancer at bay, but eventually, it began to grow again. About 10 months ago, the Oregon man began a clinical trial at Moores Cancer Center at UCSD, including IV immunotherapy treatment."Pretty ecstatic ... I've had pretty good success on it, kept the cancer contained," said Olson.As part of the trial, he must fly in to San Diego for treatment every three weeks, a trip suddenly fraught with risk. "Uber to the airport. Being in the airport. Being in an airplane. Getting an Uber to the hospital in San Diego ... makes me super anxious. Makes me feel like I'm a sitting duck," said Olson.Six years of cancer drugs have left son's immune system compromised."Here's the irony. I may die of cancer in the mid term or long term, but I will probably die of COVID-19 if I get it," said Olson.Olson recently made the painful decision to postpone his cancer treatments in San Diego."If I can get through this crisis - maybe miss some of my therapy - maybe I let the tiger a little out of the cage a little bit on the cancer thing. I feel like I could maybe reel that guy back in, but if I die of COVID-19, it's over," said Olson.His decision is one many others with weakened immune systems are also facing, whether to make that trip to a hospital for treatment."Folks like me are faced with Sophie's choice. We either go in and get the treatment that will extend our lives ... But by doing so, we could catch a disease that could kill us today," said Olson.There are some hoops to go through, but his San Diego doctors may be able to get him his infusion at an Oregon hospital. SAN DIEGO (KGTV) -- Authorities have identified the sailor who died after being struck by a spinning helicopter blade as 32-year-old Lt. James Mazzuchelli.Mazzuchelli was a flight surgeon assigned to Marine Light Attack Helicopter Squadron 267, Marine Aircraft Group 39 and was stationed at MCAS Camp Pendleton.Mazzuchelli is from Orange Park, Florida and was previously deployed to Japan.RELATED: Sailor hit by spinning helicopter blade at MCAS Camp Pendleton dies“Lt. His willingness to join the Navy and elect to serve faithfully with the Marines should give a sense of pride to all of us who serve our country that we are surrounded by heroes every day. SAN DIEGO (KGTV) - Conflicting instructions on the California mail-in ballot have confused some voters when it comes to signing their envelope."I laid it all out, and I looked at it and said, 'This doesn't match,'" says San Diego resident Theresa Lally. "It was red flags all over for me."The confusion comes from two separate instructions on how to sign your ballot envelope before submitting it. On the envelope itself, it says your "signature must match your voter registration record." But on the Voter Instruction form that comes with the ballot, it says, "Sign your name just like it appears on your driver's license or identification card."Lally says she can't remember how she signed her voter registration, and she wasn't sure if the instructions meant to include her full name or if she could just use a middle initial.ABC 10News took her concerns to Michael Vu, the San Diego Registrar of Voters. He says voters shouldn't stress over specifics, because the law allows for a fairly liberal interpretation of a signature."You do not have to have an exact match of your signatures," says Vu. "What we're looking for are the unique characteristics of a signature."Because signatures change over time, Vu says the people who verify each signature look at identifying markers to match the signature on the envelope to the signature on file."We look at the way that a person slants their signatures," Vu says. "Or the way that they loop their L's or J's or S's. Or how they may have a tail at the very end of their signature."He also says just initials can be enough to make a comparison and verify a signature.If none of that matches, Vu says the ballot goes into a "curing" process. The Registrar will have the voter fill out an affidavit that the office uses to verify the signature.And if a voter makes a mistake on their signature, Vu says they can contact the Registrar's office for a replacement ballot.Mail-in ballots must be postmarked by November 3 and received within 17 days to count. SAN DIEGO (KGTV) — California Highway Patrol investigators are correcting their initial findings of a fatal wrong-way crash on Interstate 5 in February.In March, CHP said 35-year-old Justin Callahan was at fault for the fatal collision on the northbound I-5 transition ramp to westbound I-8 on Feb. 26 just before 2 a.m.Investigators had believed Callahan, driving in a Volkswagen Jetta, was traveling eastbound in the westbound I-8 lanes when he collided with a Toyota Camry on the transition ramp — a finding Callahan's family had contested.RELATED: Family disputes CHP's details of I-5 wrong-way crashCallahan died at the scene while two female occupants inside the Toyota suffered major injuries.Friday, CHP said they've now concluded the Toyota was traveling in the wrong direction when it collided with Callahan's vehicle on the ramp.Investigators also said the driver of the Toyota, 22-year-old Lauren Freeman, was found to be under the influence at the time of the crash.Freeman turned herself into San Diego Superior Court Friday. She faces charges including murder, vehicular manslaughter while intoxicated, and felony DUI causing injury or death.RELATED: Driver killed in wrong-way crash on I-5 in Midway areaCallahan's family said following the crash he should have been heading to Ocean Beach from Chula Vista after work at the time of the crash, not away from it."It doesn't make any sense," his brother, Tommy Villafranca, told 10News in March.  "Why would he get back on the freeway and get back the opposite direction?"It takes 21 minutes just to get from his work to Sunset Cliffs Boulevard. He’s still got to turn around go back, and that would take even more time, so the timeline is not working at all."Callahan's parents, Lowell and America Callahan, sent 10News the following statement:"We are grateful for the many hours spent by the CHP investigators and especially officer Cliinkscales, who kept us informed over the last several months, concerning the investigation. Initially, Justin had been reported by CHP as the wrong way driver on I-5 north on the transition ramp to I-8 in San Diego. This took place early Monday morning at approximately 1:55 a.m. on February 26, 2018. We are pleased that his name is finally cleared in this horrible collision that took his life instantly. 2366
