SAN DIEGO (KGTV) - A local business owner is warning others about a phony debt restructuring company that he said cost him thousands of dollars.Hugh Herrera owns Pacific Beach Vinyl."What we're selling is music, which is one of the uplifting things of life," Herrera said.A couple years ago, Herrera needed help managing his debt with the business. After a situation with a lender, he eventually turned to what he thought was a legitimate debt restructuring company. He received a solicitation in the mail and gave the company a call."It sounded like something viable to me," Herrera said.He started working with Corporate Restructure, Inc. He said he paid about 0 a week."In the end, the net result, we'd pay about half of whatever we owed through making weekly payments to this firm," Herrera said.  Instead, Herrera said Corporate Restructure took about ,000 and ran."They just disappeared. Couldn't get a hold of them," Herrera said.According to news releases from the Department of Justice in New York, the men behind Corporate restructure faced dozens of charges related to bank and mail fraud. The news release dated late last year said there were approximately 200 victims that lost a total of .2 million."Somebody should really look out for predatory-type people, obviously, because that's what happened to us," Herrera said.He is now working to pay off his existing debt after he learned an expensive lesson."Things are looking better. Light at the end of the tunnel," Herrera said.Herrera started a GoFundMe campaign, which has helped keep the business afloat. He has hopes of getting some of his money back after the criminal proceedings in his case are finished.The Federal Trade Commission recommends people to contact creditors directly for assistance with debt. SAN DIEGO (KGTV) - A pair of recent restaurant closures are highlighting some of the struggles owners are facing as the industry grapples with major shifts in the way it does business.Last month, Brooklyn Girl in Mission Hills and Urban Solace in North Park both closed their doors. Facebook posts thanked long-time customers but gave few answers as to why.Industry experts think it's a sign of bigger problems in the hospitality sector, as rising costs and changes in people's behavior are combining in a "perfect storm" of problems.RELATED: El Pollo Grill to open new location in Chula Vista"These are seasoned operators, people who have been in business for a long time. And for one reason or another they're just stumped," says Stephen Zolezzi, the President and CEO of the Food and Beverage Association of San Diego.His association tracks the total number of licenses given out in San Diego to food and beverage vendors. Zolezzi says over the last three years, there's been an increase of 300 licenses. The prices of rent, insurance, and goods have all gone up in the past year. There are also higher labor costs because of minimum wage hikes and low unemployment creating favorable hiring conditions for employees.But cost isn't the only factor."Customer loyalty, today, is really at a low," says Zolezzi. His members say diners now would rather go to multiple places once than become regular, dependable customers at a few spots."You could be doing everything right," he says. Zolezzi says these apps can charge restaurants as much as 30% of the total bill, plus delivery fees, to carry their food. That cuts into already razor-thin margins and in some cases cause restaurants to lose money on each delivery order."If you don't have that factored into your business plan, it could create a negative," he says.Zolezzi says it's now up to the industry to adapt, as restaurant owners need to constantly reinvent their location, menu, and marketing to bring in more customers. 2568

SAN DIEGO (KGTV) -- A human smuggler reportedly used two children as decoys by dropping them over the border into concertina wire, according to U.S. Customs and Border Protection. CBP reports that two Salvadoran girls, ages six and nine, were dropped roughly eight feet from the San Diego border behind concertina wire late Monday night. “Agents responded and moments later, a group of 10 individuals crossed the border in the area agents vacated,” said Rodney Scott, Chief Patrol Agent for the U.S. Border Patrol. Scott said on social media that the group eluded capture. The two young girls were given medical attention for what CBP called minor injuries. The agency is working with the consulate in El Salvador to locate the girls’ parents, the agency said. SAN DIEGO (KGTV) -- A San Diego man convicted of murder will be a free man, decades before his scheduled release.Donnell Fulcher’s conviction for a Barrio Logan murder in 2006 was overturned due to changes in DNA standards, said Deputy District Attorney Hector Jimenez.On Tuesday, Fulcher pleaded guilty to voluntary manslaughter and assault with a firearm rather than go through a third trial. The judge sentenced Fulcher to 14 years, but he received credit for time he already served.Because of that, Fulcher will be released from custody tonight or tomorrow. This result comes after the San Diego County District Attorney’s Conviction Review Unit took a second look at cases involving DNA mixtures, meaning more than one DNA source is found in a sample. Fulcher’s case relied heavily on this type of evidence.The top forensic science group that analyzes DNA released guidelines that are now more conservative, which affected Fulcher’s case. Earlier this year, the District Attorney’s office agreed to give Fulcher a new trial.“We still believe that we have the right guy, but we lost confidence in the conviction so we wanted to give the defendant a chance to have a new trial if he wanted. He chose to plead guilty instead, so at the end of the day, I believe justice was done,” Jimenez said. Fulcher has always maintained his innocence.“I don’t think you can put any limit on the happiness that going free can have for someone who’s serving a life sentence. He is very, very happy. His family is very happy. This is really a joyous moment for all of them,” said Fulcher’s defense attorney Knut Johnson.This would have been Fulcher’s third trial. SAN DIEGO (KGTV) - A Portland nonprofit is spreading hope and strength where it's needed most, to children and teens battling cancer, living with special needs, or coping after trauma.The Capes and Crowns Foundation gives these warriors a chance to live out their superhero fantasy for a day, dressing them up in the hero, princess or athlete of their choice.With the help of imagination and Photoshop, the result is a captivating photo the family can cherish forever. “It reminds these kids they are the real superheroes," said Kylie Cole, Founder and President of the foundation.Because many of the children have a terminal illness, Cole says every photo shoot must be perfect.Her team goes the extra mile, not only with staged photo shoots but also photographing hospice sessions and memorial services.“It's very obvious, this is what my entire life was meant for," said Cole.Capes and Crowns is touring the country to reach as many kids as possible.For the Los Angeles/San Diego trip, costumes alone cost ,000.The team hopes people watching will be inspired by their mission and donate to help more kids live out their wildest imaginations.  1165
