SAN DIEGO (KGTV) -- A San Diego gym owner said he is keeping his doors open despite state restrictions on indoor operations that took effect early Wednesday morning.For Shawn Gilbert, the owner of Boulevard Fitness in University Heights, keeping his business open is a matter of survival."I took a huge financial hit in May. Money out of my pocket that's never coming back. We have bills to pay, we have rent to pay,” Gilbert told ABC 10News.Gilbert said he believes his gym can operate safely with face covering and social distancing guidelines because it is a large, open space with high ceilings. The gym also has an outdoor space that Gilbert plans to also utilize.According to Gilbert, none of his gym members or employees have tested positive for coronavirus.Gilbert told ABC 10News he’s prepared for any possible citations for staying open."We have a lawyer with six other gyms, all representing us gym owners. What [Gov. Gavin] Newsom did this time is unlawful. I find it criminal,” said Gilbert.Boulevard Fitness is closed Wednesday for cleaning, but the facility will reopen Thursday at 6 a.m. 1111

SAN DIEGO (KGTV) -- A group of activists are upset after the San Diego Police Department rescheduled a Black History Month celebration for the department's current and former black police officers.The department's celebration was scheduled to take place Saturday, February 24th, but was canceled just days before. The group says a committee of officers was appointed to plan the event in January. They think the cancellation was politically motivated. Monica Montgomery spoke during a brief press conference on Monday at the Civic Center Plaza. She thinks the decision to reschedule the event was made after the keynote speaker was announced. The speaker was supposed to be Geneviéve Jones-Wright, the candidate for San Diego district attorney. She's running against interim D.A., Summer Stephan. The police department told 10News the event was rescheduled due to planning conflicts. Lt. Scott Wahl said they plan on notifying officers when a new date is set. The D.A. sent 10News the following statement: "District Attorney Summer was not involved in the planning or the rescheduling of this event." 1143

SAN DIEGO (KGTV) – A new initiative in Pacific Beach could keep many businesses afloat but may make parking in the area even harder to find.Twenty-six parking spaces on Ocean Boulevard between Grand and Thomas avenues will be temporarily converted to outdoor dining for nearby businesses.Signs posted near the parking spaces show there will be no parking starting Friday, Aug. 21, until Dec. 30 for a special event.PB Shore Club owner Doug Sondomowicz worked with the city’s permits department, local police and fire departments, and the Coastal Commission for five weeks to get permits approved.The area where the parking spots used to be is now where cars and emergency vehicles can drive through along Ocean Boulevard.PB Shore Club will add 22 tables to the patio, bringing them to about 2/3 of their pre-COVID seating capacity.Sondomowicz said he thinks this will allow him to bring almost 100 percent of his employees back. The tables will be ready to go by lunchtime on Saturday."Originally, we laid off every employee we had here … hopefully with this we will get closer to that 100 percent employee mark,” said Sondomowicz. "During these trying times with COVID-19, the city has been gracious to let us use this and be able to keep us open and try to employ more people. And give locals and tourists still options to be able to eat outside beachfront."Waterbar will add around 20 tables and have their patio ready to go by 4 p.m. Friday.Some people in Pacific Beach say finding parking in the area is already difficult and this restriction will make it even harder.Pacific Beach resident Robert Gally opposes the idea, and he told ABC 10News, "A lot of times, I see police responding out here. I see fights. There's loud music. Knowing that they're going to be outside is just making it even worse. So, I'm very upset."PB resident Cindy Palus, who supports the idea, said, "I think it's advocating for people to get outside and walk, it's not a big deal and I think the businesses need it. San Diego needs it. I think it's great. I think we're supporting the economy."A spokesperson for San Diego City Councilwoman Jennifer Campbell’s office confirmed to ABC 10News that the space will be for outdoor dining.The spokesperson says the request was made and voted on by a group called Discover PB. She tells ABC 10News that the change was approved by the Coastal Commission.ABC 10News reached out to the group Discover PB, but have not heard back. 2460

  

SAN DIEGO (KGTV) - A hot air balloon with 14 passengers and a pilot on board made an unplanned landing in Rancho Pe?asquitos Sunday night.The balloon set down on a hillside at Pe?asquitos Drive and Del Diablo Way west of Interstate 15 about 7:15 p.m.The community jumped in to help, keeping the basket stable and helping the passengers exit safely, according to the San Diego Police Department.RELATED: Hot air balloon pilot talks to 10News about landing in Sabre Springs parkWitnesses helped the pilot bring the basket down to the street where it could be picked up by the owner, police said. The owner's name was not released.No one was injured.The NTSB said they are not investigating the incident. SAN DIEGO (KGTV) - A judge declared a mistrial Monday in the retrial of an undocumented immigrant accused of being the driver in a San Ysidro, California hit-and-run crash which seriously injured a young boy.Constantino Banda Acosta was charged with the crash  on May 6, 2017.Investigators said Banda ran a stop sign and crashed his pickup truck into the Lake family’s Honda Accord.6-year-old Lennox Lake was in a child safety seat at the back of the car. He suffered serious head injuries.Banda left the scene but was arrested about two miles away after Border Patrol agents spotted his damaged truck parked on a street, police said.During Banda's first trial, his passenger, Jorge Adame Ariza, also an undocumented immigrant from Mexico, testified under a grant of immunity during the defendant's two-day preliminary hearing in June that he and Banda had a number of beers that night before the accident.Adame said Banda got into a fight with another man outside a Chula Vista restaurant. Adame told them he picked up Banda but later moved into the passenger seat with Banda behind the wheel during the crash.San Diego police Officer Michael Muniz testified in the first trial that Banda's blood-alcohol content measured .151 and .152 percent -- the legal limit is .08 -- during two breathalyzer tests.Federal immigration officials said Banda has been deported from the United States at least 15 times over the past 15 years, most recently on January 18.A judge will decide Friday whether a third trial will take place. 1544
