SAN DIEGO (KGTV) - A final report from the National Transportation Safety Board points to the probable cause of a 2016 crash into the Navy Pier and dock in downtown San Diego.The Adventure Hornblower collided with the seawall sending people on shore scrambling for safety.According to the August 2017 report, the probable cause is listed as “failure of the port transmission to disengage from the forward propulsion position due to the operating company’s lack of adherence to the transmission manufacturer’s recommended periodic maintenance schedule and the lack of routine maintenance and upkeep of the propulsion system’s equipment.”It also says that the lack of instrumentation to provide a positive indication of thrust direction or an alarm to indicate the propulsion control system was not responding properly to the captain's commands."it was shocking,” said passenger Susan Pendergast. “I mean it was just shocking.”Pendergast says when the vessel hit the dock she was thrown to the ground, re-injuring an already bad back.She eventually had surgery in two different places.“It’s left me certainly not with the life I once had,” she said.Following the collision, an official with Hornblower told 10News it could be related to a possible mechanical failure.A few months later court documents pointed toward an unforeseeable and unpreventable mechanical failure despite proper maintenance, the fault was caused by the neglect of others.The NTSB report disputes that finding.When talking about the collision, the report states,  “As the Adventure Hornblower approached the pier on the accident date, the port transmission failed to respond to the captain’s helm orders. Investigators believe that the fault occurred between the servo-actuator, the mechanical linkage, and the control unit, most likely due to neglected maintenance to the port transmission and control system.”In a statement, a spokesperson for the Hornblower disputes the NTSB’s findings writing, “Hornblower Cruises & Events continues with safe, daily operations, following the allision of Adventure Hornblower back in 2016. On that day, the initial response of our captain and crew to address all immediate safety concerns and ensure the well-being of all guests aboard, was exceptional. Hornblower has noted several inaccuracies in the NTSB report on this matter, and therefore disagrees with its determinations as to the probable cause of the allision.  Due to ongoing product defect litigation, Hornblower cannot comment further at this time. Hornblower, deeply appreciates the amazing loyalty of our customers and guests over the years, and we continue to work with care and diligence, every day, to deliver on that trust.” 2739

Ferrell's SUV then struck the center divider median and subsequently overturned.On Thursday night, Ferrell appeared at a Funny or Die event at Oceanside High School called Glam Up the Midterms. He appeared as his "Anchorman" character Ron Burgundy alongside Billy Eichner, who hosted the evening.Ferrell, best known for playing anchorman Burgundy and various other "Saturday Night Live" characters, was reportedly returning from that event at the time of the accident.The statement from Ferrell's representatives added that the actor is "grateful for all the well wishes he and his friends are receiving." 1902

SAN DIEGO (KGTV) - A Hillcrest man in search of his stolen bikes made a startling discovery when he stepped into an abandoned church.Early Wednesday morning, surveillance video shows two men stealing three pricey bikes after cutting a metal lock for a garage, as Wilbur Kookmyer slept inside his condo on Georgia Street."Felt angry, felt violated," said Kookmyer.A day later, Kookmyer went in search of his bikes and he didn't go far. Next door - inside an abandoned church at Park Boulevard and Meade Avenue - a security guard agreed to let him have a look.Room after room, he found belongings left behind: clothes, food, and even a drone. In one room is a makeshift bed. There is a bike in another, but it's not his."It's a homeless hotel. They come and go as they please. Free of charge," said Kookmyer.But mostly, what Kookmyer sees is filth."Smells like urine and feces. Needles and trash. It's just disgusting. Looks like a landfill and a health hazard," said Kookmyer.The church was sold last year to a developer. LMC North Park Holdings is still awaiting permits to demolish the site. In the meantime, it's become a campground for transients."Constantly coming and going. Get everything boarded up, but breaking back in every time," said Kookmyer.While Kookmyer was recording, they ran into several people, who were escorted off the property. Kookmeyer says since the church was sold, he's seen a spike in crime - from vandalism to home and car break-ins."My next-door neighbor caught someone breaking in and using his shower," said Kookmyer.Wilbur says it's time for the demolition to happen and for security to be stepped up. "There's no excuse for it being this filthy and creating that much trouble for people around the church," said Kookmyer.A spokesperson for LMC North Park Holdings issued this statement:“We share the concerns of the neighbors and are working diligently to better secure the site until we are able to obtain the permits necessary to begin demolition. The security team, which is contracted to be on site 24/7, is having some difficulty, so we are in the process of obtaining additional resources to better control access. We have also scheduled contractors to repair damage to the fence and given the police the authority to make arrests.” 2284

  

SAN DIEGO (KGTV) --  It was a normal Thursday night for Rob Perelman. His Uber app was on and he was picking up passengers in San Diego. Then suddenly, things changed and his passengers got violent. You may have seen the video by now - a car crashing in Banker's Hill after the passengers began violently beating the driver.RELATED: Uber driver attacked by drunk passengersFriday, Perelman spoke for the first time about his early-morning attack. He told 10News what happened Friday morning isn't an Uber problem - they were just bad apples. "I've done 4,999 rides with good people," Perelman said. "And one with a bad person."Perelman gave that bad ride sometime after 1:00 a.m. Friday. He picked up the passengers in Banker's Hill and almost immediately realized they were drunk. "My gut feeling said to drive away," he said. "But I'm here to give people rides home, and I said you know what, 'we've all been the drunk guy just trying to get home from the bar, let me give these guys a ride home.'"MAP: Track crime happening in your neighborhoodHe only made it two blocks. "The guy in the back seat starts puking out the window...and if he can't make it two blocks, he's definitely not going to make it 10 minutes," Perelman said. So he pulled over and asked the two to get out of his car. He told 10News that he even tried opening the door for one of them."Still nothing happening, so I say a third time, 'get out of the vehicle or I'm calling 911,'" Perelman said. That's when things got dangerous, and the passenger next to him attacked with a fury of punches."And he's not stopping, he's just beyond the point now," Perelman said. "Probably doesn't know what he's doing, just starts throwing punches at my head, I can't get him to stop. I've got my glasses on, he knocks my glasses off."Perelman says he was left with two options. Take the beating or jump out of the car. He took option two, jumping out of the car while it was still in drive and running to a nearby house to call the police.After the car crashed, the passengers seemed to have a moment of clarity and took off. Perelman says he left behind a shoe, a cell phone and ,000 dollars in damages to his car.Even though he had a bad experience, Perelman says he just wants to get back on the road. "I'm just happy that I was able to get out safely and I've got a few bruises on my head, but I was able to walk away, so I'm lucky that it didn't escalate," Perelman said. "I don't know if he has a gun or knife, I just said let me get out of the car I don't care about the vehicle right now."Since Uber knows who the men are, the plan now is to find them and press charges.10News reached out to Uber about the attack. SAN DIEGO (KGTV) -- A 63-year-old man was hospitalized after being stabbed in Sherman Heights Saturday night.The stabbing happened on the 2200 block of Imperial Avenue around 8:30 p.m. Saturday.Authorities say the man was arguing with a 19-year-old when the teen stabbed him in the ribs below his armpit.RELATED: PB man stabbed six times, suspect apprehendedAfter the stabbing, the suspect fled the scene, police say. The teenage suspect is described as a Hispanic man about 5 feet, 8 inches tall, thin and was reportedly wearing a brown jacket and gray hoodie.The victim was taken to the hospital with non-life threatening injuries. 646
