(CNN) -- A Michigan lottery winner must share the million windfall with his ex-wife, even though they were in the process of divorcing when he bought the ticket.Richard Zelasko won an million Mega Millions jackpot in July 2013 -- after taxes and fees his prize was ,873,628, according to an opinion issued last week by the Michigan Court of Appeals.The suburban Detroit man and his then-wife, Mary Elizabeth Zelasko, filed for divorce in late 2011. The case had gone to arbitration, and they were waiting for the arbitrator's opinion when Richard Zelasko won the prize.The couple were married in 2004 and have three children.The arbitrator ruled that the ticket was part of the couple's marital assets and awarded million to the wife and divided the rest of their assets, according to the opinion. He said that the "marital property includes all property acquired from the date of marriage until the date of entry of the divorce decree," including property acquired during a separation.The court also cited the arbitrator's opinion that the winning lottery ticket was probably not the first that Richard Zelesko had purchased during the marriage and that "(a)s losses throughout the marriage were incurred jointly, so should winnings be shared jointly."It's true that Zelasko spent to buy the winning ticket; however, "the dollar spent was arguably marital money and, as such, a joint investment," the arbitrator said.The appellate court said it found no errors that would require it to change the award."It's very difficult to overturn an arbitration," said Michael Robbins, who's represented Richard Zelasko since 2015.Robbins told CNN that the couple had been separated since 2009.An attorney for Mary Elizabeth Zelasko told CNN that he would not comment on the case because it is confidential.The couple's divorce was finalized in 2018.Robbins said his client can appeal the ruling and is "considering his options." 1945

Most of its runs have shown the storm moving across the Florida peninsula. The European model has been a little more consistent, showing a tropical or subtropical storm drifting ashore near New Orleans.No matter where this storm moves or how strong it becomes, it will continue to bring tropical moisture into the South from Louisiana to North Carolina. The heaviest rain will fall near the Gulf, with Florida, Georgia, Louisiana, Mississippi and Alabama seeing seven-day rainfall totals of 4 to 7 inches.If it gets strong enough to become a subtropical or tropical storm, with sustained winds of 39 miles per hour (63 kilometers per hour) or greater, it will be named Alberto.As we have seen in years past, environmental conditions sometimes allow for development before the hurricane season begins. The last time a tropical cyclone was named Alberto was in 2012; it also formed before the season began, on May 19. It became a tropical storm that meandered off the cast coast of Georgia and South Carolina.Just last year, we had a named storm -- Tropical Storm Arlene -- east of Bermuda in April.This early development doesn't necessarily mean we are in for a busy hurricane season. Throughout the filming of the pilot, I experienced Racial Discrimination/Racially Charged inappropriate comments from the hair department and bullying from Executive Producers. During the Season, it continued along with Sexual Harassment from a recurring guest star and the racist commentary & bullying from the Hair Dept. Head escalated into Sexual Assault at our Wrap party.The Sexual Harassment though reported directly to the Showrunner/EP remained undocumented and was not reported to HR as promised. The Hair Dept. Head was fired ONLY after the sexual assault and NOT for an entire year of outward racism/racially charged language and bullying behavior in and out of the Hair and Makeup trailer. HR protocol was never adhered to following the above reports given by me to my Showrunner/EP and an investigation was never issued for any of my claims. The only time I was asked to participate in an investigation was after a meeting I called in June following our Season 2 announcement. This meeting included the Showrunner and two other producers as well as my agent and SAG-AFTRA Union Rep. It was clear to all present in the meeting that the Showrunner had not shared my reports with the any of the producers. After my initial report of sexual harassment, I was assured that the actor would be fired. I was also asked to film with him the very next day as a courtesy to the script, even though we had not begun filming the episode yet. This actor reappeared on our call sheet at the end of the season, I was even written in scenes with him. I asked the Showrunner about this and he admitted to me that the actor had not been fired nor had he gotten HR involved. I was asked to return this season, and promised that “everything was handled.” The investigation hadn’t even begun and Season 2 had already started filming. I turned it down and I walked. (CNN) -- An American Airlines flight was diverted to Oklahoma after a man grabbed a passenger seated next to him "by the crotch," according to a federal criminal complaint filed Friday.James Clayton Cholewinski-Boy was charged with abusive sexual contact after Tuesday's reported assault aboard American Airlines Flight 807 from Charlotte, North Carolina, to Salt Lake City, Utah, the complaint said.It's unclear whether Cholewinski-Boy has an attorney.The alleged victim, identified as "E.J." in the complaint, was seated between Cholewinski-Boy and her daughter. Shortly after takeoff, he began touching the woman's arm and she repeatedly pushed his hands away, according to the complaint.Cholewinski-Boy then "forcibly grabbed her by the crotch," the complaint said. The woman again pushed his hand away and demanded that he stop."Cholewinski-Boy threw up his hands and said 'sorry,'" according to the complaint.The woman notified the flight crew, who moved mother and daughter to another part of the aircraft.The pilot diverted the flight to Tulsa International Airport, where Cholewinski-Boy was arrested by airport police for public intoxication, the complaint said.He was released Wednesday on his own recognizance, the Tulsa Municipal Jail told CNN."The public should know these allegations pertain to criminal sexual misconduct by Mr. Cholewinski-Boy against a female passenger, not a threat to the plane or air travel," U.S. Attorney for the Northern District of Oklahoma, Trent Shores, said in a statement.American Airlines, in a statement, said: "The quick actions of our crew ensured the safety and wellbeing of our customers on the flight." 1662
