SAN DIEGO (KGTV) - Two women who worked as massage therapists at the Grand Del Mar are suing the resort’s parent company, claiming the spa allowed them to be sexually harassed by male clients. Christina Murphy and Madeline Flores made allegations this week of sexual harassment, failure to prevent harassment, wrongful termination, and retaliation against FHR GDM Hotel Management Company LLC. The women’s claims involve two spa clients, Steve Hodsdon and Juan Pablo Mariscal, who the women say made inappropriate advances during scheduled massage appointments. The Grand allowed clients to disregard protocols for keeping themselves covered and repeatedly exposed themselves to therapists, according to a court document filed by the women’s attorney. The male clients also made sexually suggestive comments and gestures and propositioned their therapists for sexual favors, the document said. The legal complaint also details issues Flores and Murphy said they addressed to the spa’s lead massage therapist, manager, director, and human resources representative. The Grand “ignored the complaints and tried to brush them under the rug to keep these male clients coming to the Spa,” the document reads. Both Flores and Murphy used administrative channels to make complaints in Aug. 2018, filing sexual harassment complaints with the California Department of Fair Employment and Housing. On Feb. 26, 2019, Murphy and Flores amended their complaints to include a claim of construction discharge in violation of FEHA or wrongful termination, respectively, and the DFEH closed their cases. The women say they suffered emotional distress, mental anguish, nervousness, grief, anxiety, worry, shock, humiliation, and shame.In a statement sent to 10News, Murphy said, "From the beginning, the Grand Del Mar makes it clear that as massage therapists, we should feel privileged to work on such high-end clientele. This creates a power differential where the guests have all the power and the therapists are powerless to challenge inappropriate conduct. The sexual intimidation by these male clients caused me so much fear – fear of what these men were capable of and fear of retaliation by the Grand for reporting them. But I had to speak up to protect myself and my coworkers. When it became obvious that the Grand was not going to protect me, I did the only thing I knew would keep this from happening to me again – I quit."Flores said in the same statement, "What happened to me and Christina never should have happened. The Grand should have taken action to stop this harassment the first time it received complaints about these men. But the Grand did nothing and we ultimately paid the price. The Grand made me feel unsafe at work when they were supposed to be the ones to protect me. This was a profession that I went to school for and that I loved, and now, I have lost my passion for it. I was scared to come forward but ultimately, I felt I had to come forward because I do not want what happened to me to happen to other massage therapists."Their attorney, Alreen Haeggquist, with Haeggquist & Eck, LLP said, “The law is simple and straightforward: an employer has a duty to protect its employees from harassment. But in the face of multiple detailed complaints by its female massage therapists over a period of years, the Grand has chosen to instead protect the perpetrators. The Grand has made a clear choice: the tens of thousands of dollars its predatory male clients spend at the Hotel is far more important than the safety of its female employees. For the right amount of money, the Grand will ignore clients who remove all draping, grind on the massage table, expose their erect penises and ask its therapists for prostate massages. Over the past few years, the Grand has refused to accept any responsibility for its systemic failures. They have had multiple opportunities to do the right thing and protect their female massage therapists – and time after time, they’ve failed to do so. Well, time’s up.”The plaintiffs believe no fewer than six massage therapists may have been victimized, the court document says. The hotel responded in a statement of its own, "Fairmont Grand Del Mar acts diligently to investigate employee complaints and is confident that there was no wrongdoing by the hotel in connection with this matter. The safety of our guests and our colleagues is a top priority and providing a healthy work environment remains paramount. As this matter is currently in litigation we are not able to further comment."10News attempted to speak with Hodsdon and Mariscal and were turned around at the gate to their neighborhood. 10News also attempted to contact Hodsdon at his workplace and he was not there. 4736

SAN DIEGO (KGTV) - When President Trump visited San Diego in September, he made a special trip down to the border to tout the wall and its technological advances. The president has made border security a major part of his term, even calling for the addition of 5,000 border patrol agents.A new study from San Diego State University says the increased emphasis on stopping illegal crossings and drug smuggling could make those very agents the targets of corruption and bribe offers. "When one door is closed, they try to find another one which is open," said David Janscisc, the public affairs professor at SDSU who authored the study. Janscisc says the harder it gets for smugglers to get people or drugs into the U.S., the more likely they are to seek help from agents at ports of entry. "You can clear a car full of drugs just by not inspecting it," he said. Janscisc isn't saying Customs and Border Protection is corrupt, but wanted to study how corruption occurs. He based his study off of 160 cases of CBP corruption over 10 years, noting the agency has 60,000 employees. Janscisc found the employees with less than five years of experience were more likely to be involved in drug-related corruption. However, those who were there longer were more likely to commit immigration-related offenses, such as falsifying paperwork to help get someone into the country. In a statement, Customs and Border Protection said applicants go through a strict hiring process that could include polygraph tests. "After the hiring process, CBP applies proactive measures in the form of training, rules geared to ensure workplace integrity and oversight and management of frontline officers and agents by CBP leadership at every level," the statement said. Janscisc said it took two years to complete his study, relying largely on court documents and investigative news reports. 1873

SAN DIEGO (KGTV) - Union workers rallied Wednesday across California after notices went out to hundreds of University of California workers who will be temporarily laid off.About 200 University of California, San Diego Housing, Dining and Hospitality employees will be temporarily laid off during the summer months."Like many other organizations, UC San Diego is facing financial losses as a result of the pandemic. In particular, Housing, Dining and Hospitality saw an 85% reduction in undergraduate housing for the 2020 spring quarter, and a 90% cancellation in summer season occupancy. HDH implemented numerous cost saving measures, including hiring freezes and project deferments, but due to a substantial decrease in summer duties, HDH made the difficult decision to place some of their staff members on temporary layoff for the summer months. We understand the pain and uncertainty this will cause during an already trying time. However, we must acknowledge and respond to the challenges our campus is facing, operationally and financially, as a result of the pandemic," a representative from UCSD said.While these employees mainly work with students, serving food, UCSD Health employees are concerned this is the tip of the iceberg and more layoffs are coming."I don't want to lose my benefits, I work too hard and I deserve it," Teri Taylor said. She was hired at 20-years-old and is now a Nursing Assistant."For me to be able to branch out on my own and make something of myself is amazing." Taylor said she grew up in a low income neighborhood and faced adversity.She's a member of local labor union AFSCME 3299.The union started the day with a cacophony of honking in the UCSD chancellor's neighborhood.Then, at noon they held rallies at UCSD Medical Center in Hillcrest and Jacobs Medical Center in La Jolla."We come here day in and day out and do the work basically and to know that we can be let go at any time, it's scary, it's sad. We're in the middle of a pandemic," Taylor said."You don't have to lay people off, there's work here, there's work at other campuses. This is a UC system throughout the state," she added.The University said, "DH has a tremendous appreciation for the dedication and contribution of their staff. Our hope is that the impacted employees—and the students they serve—can return to campus. The temporary layoff is expected to end in September, when HDH anticipates bringing back all of their staff members.The university will provide support to impacted employees in the following ways:· Two weeks of full salary will be paid during the notice period, June 15 through June 30, as part of University of California’s pay continuity [universityofcalifornia.edu] program.· Health benefits will be maintained, with the university continuing to pay its portion of the expense during the temporary layoff.· Individual support and guidance will be available to impacted employees through UC San Diego’s Faculty and Staff Assistance Program [blink.ucsd.edu] this week and beyond.· UC San Diego Human Resources shared information on unemployment benefits and other community resources for those whose income has been affected by the pandemic, and will continue to serve as a resource to assist temporarily laid off employees who have questions."Union members say they need to cut from the top, not the bottom, "it is the low wage earners which are brown and black folks, [who are cut]" Executive Vice President of the Union, Michael Avant said.ABC 10News asked UCSD what the demographics are of those positions being cut and we have not had a response.The Union created a gofundme to support those employees being laid off. 3663

  

SAN DIEGO (KGTV) -- With COVID-19 pandemic-related regulations in effect across California, San Diego County leaders are putting together a task force to make sure local businesses following proper guidelines.County Supervisor Greg Cox announced the county’s plan for a “Safe Reopening Compliance Team,” which will assist businesses as they navigate how to safely operate during the pandemic.“This is going to be the carrot approach, not the stick approach. But I emphasis we still have the stick and other tools available to us and we will use them if necessary,” Cox said.The team will also help with the businesses that don’t seem to be complying with the new rules.Though county leaders haven’t spelled out exactly what role this team will play in enforcing the rules, the county has already received many public complaints about these types of businesses.Erick Hudson, a head coach from CrossFit Humanity, said it’s frustrating to hear about these complaints as they try to adhere to the rules that everyone is being asked to follow.“If a business is just blatantly ignoring the rules, a lot of people congregating without those masks, without having to socially distance, then it’s like who knows how much longer this situation is going to last,” said Hudson.The county has not released a timeline as to when this team will hit the streets. 1354

  

SAN DIEGO (KGTV) --  On Monday a settlement was reached in two cases against San Diego Sheriff's Deputy Richard Fischer. Those settlements come to a total of more than 0,000. 10News has been covering the story since November when a victim shared her story with Reporter Steve Fiorina. The Sheriff's Department opened an investigation into Fischer last fall after a woman claimed he groped her while responding to a service call.The investigation then expanded to more than a dozen incidents against Fischer dating back to 2015.RELATED: San Diego County sheriff's deputy accused of sexual misconduct pleads not guiltyThe 32-year-old deputy is on unpaid leave and out on bail pending criminal court cases. At his February arraignment in a Vista courtroom, Fischer pleaded not guilty to all charges.
