SAN DIEGO (KGTV) -- On January 1, it will be legal for businesses to sell pot in California. With that, the questions and concerns about what that means for drivers out on the roads.“I think we will see an increase in DUI marijuana’s,” said Officer John Perdue, a San Diego Police officer in the traffic division.Perdue is an expert at DUI and drug recognition. Since November 8, 2016, when California voters approved Prop. 64, or the adult use of marijuana act, he’s been hearing the same thing when he comes across drivers he suspects are driving high.“Their first reaction is one of two, either A. ‘I have a medical marijuana card’, or B. ‘marijuana is legal.’ And I have to remind them, so is alcohol, but you still can’t drive under the influence of it,” Perdue said.How exactly will police be able to tell if someone is driving high?One tool that officers will use to help is the Drager Drugtest 5000, a presumptive drug screening test that can detect seven types of drugs in a person’s system.Like an alcohol breathalyzer, Perdue said, “the person has every right to refuse this.” But unlike alcohol, it doesn’t have a percent limit.If the Drager reads positive, Perdue said, “it doesn’t necessarily mean they’re impaired or under the influence, it just says that chemical or drug is in their body.” So to be arrested for DUI, it’s still up to the officer to decide if the driver shows impairment.But that can be tough. Look at the Drager as an extra tool that’s used along with field sobriety tests, what an officer smells, sees or finds in the car, to formulate that officer’s opinion of whether a driver is high.“The hardest thing will be, because there is no per se limit right now, the officers are really going to have to be aware of the signs and symptoms,” Perdue said. 1808
SAN DIEGO (KGTV) – Monday, community leaders demanded reforms following the release of body camera video showing San Diego police officers shooting a robbery suspect over the weekend.Monday, SDPD said he was in the ICU with life-threatening injuries.“I'm asking for SDPD to put an aggressive plan together to ensure that [with] any officer-involved shooting that within 48 hours to 72 hours a video from the body worn camera footage is released,” said Rev. Shane Harris with the People’s Alliance for Justice.Body camera video released on Sunday by SDPD shows the moment leading up to Saturday's shooting. Police said they were patrolling Downtown when they saw Leonardo Hurtado Ibarra in a red jumpsuit and recognized he was wanted for a robbery.From a street camera, Ibarra is seen reaching in his waistband and raising his arms toward officers. Under Ibarra, body camera footage shows what police said was a gun wrapped in a bandana.“They went in guns blazing and this is not the training that they have,” said community activist Tasha Williamson on Monday. She added that the police should have called for back-up before the confrontation.“People are saying he pointed the gun at the officer and we're simply saying how is that because the officer on video show him running sideways behind the suspect to a cover which was the vehicle,” she said.“They used verbal commands. They followed what their training is and they did an exceptional job,” said former SWAT commander and lethal force instructor Ray Shay when he spoke to ABC10 News on Sunday.“It's unfortunate the gentleman was shot but you'll see that the police officer- after shooting the suspect and getting him handcuffed- immediately calls for an ambulance and here are these two young officers doing CPR to try to save the life of the man who just tried to kill them,” he added.Activists are now urging SDPD to release videos of future shootings as quickly as they did they this time and to release videos before still images.“We want a whole perspective of a situation. Not a half-perspective,” added Harris.Harris also wants the DA’s Office to form a special unit to investigative police misconduct and officer shootings. He’s also calling for more officer training on racial and implicit bias.ABC10 News asked SDPD about the calls for reforms and we are waiting for a reply.SDPD is still investigating Saturday’s shooting. SAN DIEGO (KGTV) — President Trump's pardon of former Congressman Duncan Hunter came as no shock to the man who successfully prosecuted the case.“While I am appalled as a citizen, I am not surprised given the prior conduct of the president,” said Phil Halpern, who left the Justice Department after the case concluded.Halpern was one of the Assistant U.S. Attorneys who prosecuted Duncan Hunter and his wife Margaret in 2019. His 11-month prison term was set to start in January, but President Trump pardoned him Tuesday.Halpern said seeing the case through was still worth it to demonstrate that the people who write the laws are not above them.“It was important not only that he be convicted, but he admit his wrongdoing. They’re going to try to put this guy in jail for that? Zillow?recently released some statistics on what new home buyers can expect to see when getting into the San Diego market.
