San Diego will seek to invalidate its landmark pension law, a citizens' initiative 65 percent of voters approved in 2012.The City Council voted 6-3 Monday to go to court to invalidate 2012's Proposition B, which switched most new hires from a pension to a 401(k) style plan. The decision came after multiple courts ruled the city skipped a key step in the campaign. The courts said then-Mayor Jerry Sanders' involvement meant the city needed to meet and confer with unions, but didn't. The courts required the city to make employees whole plus a seven percent penalty, but didn't invalidate the law. The city will now to go to court along side its employee associations to get it off the books. "It's illogical for the city to believe that having broken the law in order to get Prop B into the charter that you should be allowed to keep it in there," said attorney Ann Smith, representing the Municipal Employees Association. Firefighter John Hernandez II said he's seen a number of his colleagues leave for other departments, which offer better benefits - namely a pension."In my line of work, we can't work as long as most people, and that's why we need pensions," he said. But Councilman Scott Sherman, who voted to protect Prop B, said ultimately going back to pensions could cripple the city. "Every single year we make a 0 million minimum payment on our pension debt from the old system that too us to that point, and now they're asking us to go right back to that system," he said.Sherman said it's low unemployment, not a lack of benefits, leading to the city's worker retention issues. SAN DIEGO (KGTV)-- President Donald Trump announced in a tweet that he is rolling back on federal fair housing requirements, saying suburbanites will no longer be "bothered" by low-income housing. But some experts say this may not have a significant effect in San Diego County.It all began with the 1968 Fair Housing Act (FHA), a law that came out of the Civil Rights Era, abolishing lending discrimination and redlining neighborhoods according to race and other factors."A lot of communities here in San Diego, you can look at your deeds, and if you look in a pre-war neighborhood here, you are very likely to see that in the past, there was covenant against selling to a person of color," Stephen Russell, Executive Director of the San Diego Housing Federation, said. "That history is not that old."Then came the Obama-Era Affirmatively Furthering Fair Housing (AFFH Rule). This was a supplement to the FHA that required local governments receiving federal funds to create plans to fight continued housing discrimination.But on Wednesday, President Trump tweeted:"I am happy to inform all of the people living their Suburban Lifestyle Dream that you will no longer be bothered or financially hurt by having low income housing built in your neighborhood ... Your housing prices will go up based on the market, and crime will go down. I have rescinded the Obama-Biden AFFH Rule. Enjoy!"While this may seem like a blow to local affordable housing advocates, Russell believes this tweet is more of a political stunt to appeal to Suburbanites outside of California."Housing policies are largely enacted at the local level. At the state and local level," Russell said. "The state has reaffirmed its commitment to fair housing time and again."Encinitas has been a local municipality with a history of resisting affordable housing. But in the last few years, Russell says it has started to turn the corner.With or without this change in the federal mandate, he says municipalities here, still must continue to follow local rules."Regardless of what the man tweets, it's not going to change the way the State of California does business," says Russell. 2153

SAN DIEGO, Calif. (KGTV) - A couple in San Diego are spending the holiday telling everyone they know to register as an organ donor."People don't like to talk about their death, but rather than bury these organs or burn them up, you can save lives," says Nancy Marlin, who is recovering from a kidney transplant.Marlin had a genetic kidney disease and would have needed dialysis if not for the donation. Her new kidney came from a co-worker."I was so fortunate," says says. "Someone gave me the most amazing gift."It's a gift her family knows well. Marlin's husband, Fred Kolkhorst, had a heart transplant just 18 months ago after being diagnoses with heart failure."It changes you immensely in ways that are difficult to describe," he says.Kolkhorst and Marlin are rare in that they're a married couple who have both received donated organs. Sharp Memorial Hospital Transplant Coordinator Tammy Wright says she can't think of any couples in her 25 years in the field.Wright says the holidays are the perfect time for families to talk about their wishes in regards to organ donations."It's a time of giving," she says. "The simple thing is to tell your family what your wishes are. If they know what your wishes are, they usually will follow that if something does happen."Wright also says to consider being a living donor for organs like kidneys, which have an 8-12 year wait list for donors."The simple act of saying 'yes' can make somebody live," she says.More information on organ donation can be found here. 1520

SAN DIEGO, Calif. (KGTV) - With car horns blaring, cellphone video captured a fight breaking out at a busy intersection in San Diego near Montgomery High School.The incident played out at Palm Avenue and Beyer Way - just feet from the high school - as school let out Friday afternoon. In the crosswalk, there was a flurry off punches. A teen in a hoodie is recorded battering another student on the ground. Some other teens joins the fray and more punches are traded."It's stupid. Why have a fight so dramatic like that? It could cause a car accident," a student told 10News. We are not naming the student at the request of their family.The student doesn't know what sparked the fight, but says those involved were juniors. The student told 10News this was the third big fight on campus this year. "Just make us look bad. Students should set a good example for our school," the student said.There were no accidents, but some of those drivers did get out of their cars. A witness tells us some tried to stop the fight. In the now-viral video, a crowd of people spill across the crosswalk. The melee lasted more than 20 minutes before it broke up. Police arrived but did not make any arrests.Janet Paz, a mother of two students at the school, says it sends a bad message."Makes me feel worried that kids aren't safe in school," said Paz.A spokesperson with the Sweetwater Union High School District says they believe they've identified the three-to-five students involved and are mulling possible discipline. Part of the investigation will include determining the cause of the fight and addressing any campus-wide issues. 1628

SAN DIEGO, Calif. (KGTV) -- Three people are dead following a crash on Interstate 805 in University City.The California Highway Patrol says the crash happened in the northbound lanes of I-805 at Miramar Road around 4:30 p.m.According to CHP, the crash happened after a wrong-way driver drove onto the road at a high rate of speed."Through the investigation, we will try to determined where this individual, if they got on the freeway the wrong way, where they got on," CHP Officer, Jake Sanchez said. Hector Puga was on his way to Los Angeles when the car in front of him combusted. He somehow managed to escape the crash and flames. "All I can do is hold onto the steering wheel and run over everything that exploded," Puga said. He escaped with just a flat tire and broken windshield.10News also spoke to a pair of sisters who had just finished up a fun day of shopping at UTC Mall when hopped into their car. Minutes later, they endured a near-death experience. "It was like a scene from a movie," she said. "All the cars were stopping. There was smoke. Fire. Loud noise. As soon as I look up in front of me, that car other there was flying and tumbling down the freeway."They said the driver of the flipped over SUV managed to crawl out of the car.  The survivors carried him to the shoulder, where an ambulance later picked him up. CHP said he endured broken bones, but is expected to recover. All lanes on the interstate were closed for several hours following the crash. Click here for traffic updates. Though it remains unclear if police are investigating the scene as connected to the incident on I-805, Thursday night police investigated a scene at Ashley Falls Elementary School in Carmel Valley. That's where a car rammed a campus gate, according to police.
