SAN DIEGO (KGTV) - A gray whale spotted frolicking in shallow waters attracted dolphins and a crowd of swimmers and surfers in the ocean off Mission Beach Wednesday. Lifeguards got a call about the whale possible tangled in fishing line about noon, an official said. A lifeguard who swam toward the whale to investigate determined it was free. The gray whale was young, possibly a year and a half old, whale watcher and photographer Domenic Biagini told 10News. Gray whales are starting to migrate north from Mexico during the spring. There is a good chance San Diegans will see more mothers and juvenile whales closer to shore, Biagini says, because the shallow waters keep the whales safe from orcas. "It's some of the most exciting times for us as professional whale watchers to see these animals, but it's also when we see the most conflicts with these animals coming in with people," said Biagini.Sky10 was above the whale as a group of surfers and swimmers approached it near Mission Beach, coming close to the giant mammal.Biagini warns that can be extremely dangerous for humans and can also stress the animal."These gray whales, despite not being the largest of the great whales we see out here, they can still get 50 feet long and weigh up to 80,000 pounds, so you're talking very large animals. All it takes is one flick of the tail and you have a catastrophic accident. And moms are naturally protective of their young," said Biagini. The National Atmospheric and Oceanographic Administration adopted in 2011 new regulations under the Marine Mammal Protection Act and Endangered Species Act to encourage the public to ‘be whale wise.’ The NOAA guidelines include:DO NOT APPROACH or position your vessel closer than 200 yards to any killer whale in the U.S. DO NOT APPROACH or get closer than 100 yards to any other marine mammals or birds, whether on the water or on land.BE CAUTIOUS, COURTEOUS and QUIET when around areas of known or suspected marine wildlife activity, in the water or at haul-outs and bird colonies on land. Especially from May to September during breeding, nesting and seal pupping seasons.LOOK in all directions before planning your approach or departure from viewing wildlife.SLOW DOWN: reduce speed to less than 7 knots when within 400 yards of the nearest marine mammal and reduce your engine’s noise and vessel’s wake.ALWAYS approach and depart from the side, moving parallel to their direction of the animal’s travel. If the animal(s) are approaching you, cautiously move out of the way and avoid abrupt course changes. DO NOT approach from the front or from behind.IF your vessel is not in compliance with the 100 yards approach guideline (#1), place engine in neutral and allow animals to pass.PAY ATTENTION and move away, slowly and cautiously at the first sign of disturbance or agitation from any animal.STAY on the OFFSHORE side of the whales when traveling close to shore.ALWAYS avoid going through groups of porpoises or dolphins and hold course and reduce speed gradually to discourage bow or stern-riding.LIMIT your viewing time to 30 minutes or less. This will reduce the cumulative impact of all vessels and give consideration to other viewers.DO NOT disturb, swim with, move, feed or touch any marine wildlife. If you are concerned about a potentially sick, stranded animal, or entangled animal, contact your local stranding network. 3394

SAN DIEGO (KGTV) -- A 40-year-old San Diego cold case was solved with the help of a genealogical database, the San Diego Police Department said Thursday. 37-year-old Barbara Becker was murdered in her La Jolla home on March 21, 1979, police said. According to the department, Becker’s two young boys came home from school to discover their mother’s body. RELATED: Genetic genealogy results solve new cold case as privacy concerns continueBecker died from “numerous sharp force injuries” but, based on evidence, police say she put up a fight, injuring the suspect in the process and causing him to leave behind a trail of blood. Detectives worked to solve the crime, but police say eventually all leads were exhausted and the case went cold. In October of 2018, the San Diego Police Cold Case Unit and San Diego County’s District Attorney’s Office reached out to the FBI’s genealogy team for help solving the case. Police say the team was able to identify a possible suspect using the public-access genealogical database as well as several family members of the suspect. RELATED: Suspect in 1986 Escondido cold case homicide arrestedAfter family gave DNA samples to investigators, Paul Jean Chartrand was identified as the source of blood from the crime scene. Members of Chartrand’s family told investigators that he lived in the San Diego area at the time of Becker’s murder. Investigators also learned that Chartrand died in Arizona in 1995. “The entire investigative team is grateful the case has been solved however, it is tempered by the fact it took forty years to give Barbara Becker’s family the answers they deserved and that Chartrand was able to avoid justice for 16 years after Barbara Becker’s murder,” the San Diego Police Department said in a statement. 1777

SAN DIEGO (KGTV) -- A 2-year-old boy who was reported missing by his stepfather in San Diego in 2002 suffered a fatal injury and died while in the sole custody and care of the stepfather, who disposed of the body, a prosecutor said Thursday, but a defense attorney said her client loved the child and didn't kill him.Tieray Jones, 39, told police that Jahi Turner disappeared from a park near the southern end of Balboa Park the afternoon of April 25, 2002.Deputy District Attorney Bill Mitchell told a jury that Jones married Jahi's mother -- Tameka Jones -- after Jahi was born and the couple moved to San Diego from Maryland in February 2002.The defendant was left to care for Jahi when Tameka Jones -- who was in the Navy -- went out to sea on April 22, 2002, the prosecutor said.Three days later, the defendant called 911 and said his step son disappeared in the park when the defendant walked to a vending machine."We will piece together what happened that week," Mitchell told thejury. "You're gonna know what happened to Jahi based on the evidence."Two days before he reported the child missing, Jones told his wife that Jahi had fallen off the bed and bumped his head, but it was "no big deal," the prosecutor said.Jones also complained that Jahi had wet the bed, according to Mitchell. Witnesses at the apartment complex where Jones lived said they saw the defendant carrying three large trash bags to a Dumpster just before the trash was to be picked up the day before the child disappeared, the prosecutor told the jury. One neighbor commented, "It didn't look like regular trash," Mitchell said. The prosecutor pointed to "glaring inconsistencies" in the defendant's statements to police about what happened.Mitchell said there was "no credible evidence" that Jahi was at the park that day. Despite a massive search, the child's body was never found.Jones was arrested in April 2016 in North Carolina and brought back to San Diego to face a murder charge.Deputy Public Defender Courtney Cutter told the jury that her client was a suspect in his stepson's disappearance almost immediately.Cutter said the defendant and Tameka Jones were used to just "getting by" and had very little when they moved to San Diego. The attorney said her client loved Jahi as if he were his own. "Tieray did not kill this child," Cutter told the jury."He was an imperfect father, yes, but not a reluctant one." At the end of the trial, there will be more questions than answers as to what happened to Jahi, Cutter said. Jones faces 25 years to life in prison if convicted. 2570
