SAN DIEGO (KGTV) -- With distance learning and the fall semester approaching, college students are struggling with what to do about apartments they are no longer moving into.Nicole Ah Mow lives on the Big Island in Hawaii. Ah Mow was excited to help her daughter move to San Diego, as she prepared to attend San Diego State University as a third- year transfer.“We heard that a lot of these apartments get filled up pretty quickly, so we wanted to get in on it quite early,” Ah Mow said.They found 5025 Apartments near the campus and signed a lease to move in later this month. As the pandemic got worse and universities started weighing between in-person or virtual learning, Ah Mow asked the complex if there was any flexibility.“Basically [they] just said at this time, there's no other option,” Ah Mow said.“Everyone is very stressed out,” said Erin Rounds, managing attorney with the Tenants Legal Center.She said they have been flooded with calls since the pandemic began.“Tenants do still have rights and they have enhanced rights right now,” Rounds said. “Landlords need to be understanding and sympathetic and follow the law.”She said its critical families go over their contract. Rounds said there are limited circumstances where you can break a lease. “The sooner you let them know, the better that situation's going to be,” Rounds said.She advised anyone looking to break a lease to contact an attorney.In Ah Mow’s situation, emails from the assistant community manager in early July said they are "unable to terminate [her] lease."In late July, the apartment complex managers gave her three options: move in and pay the rent, allow the complex to find someone to take over her daughter’s spot and pay the fees, or Ah Mow needed to find someone herself and pay a 0 reassignment fee.“I’m stuck between a rock and a hard place,” she said.Not knowing the area, she opted for 5025 Apartments to find someone. However, she told Team 10 she had to pay close to ,000 upfront including more than ,500 in rent difference.She understood some of the fees, but for her “to pay the difference, I think that’s really harsh on their side.”Team 10 called and sent several emails to 5025 Apartment managers. Nobody would answer any questions.“A lot of people are really having hard times and I would think some students couldn't even afford to go back to college if their parents had lost their jobs or something,” Ah Mow said. 2437
SAN DIEGO (KGTV)-- A San Diego mother says working from home during the coronavirus pandemic cost her her job. She claims she was fired because her kids were making noises in the background of her teleconference calls."We're letting you go," Drisana Rios said. That was what her Human Resources representative told her in a call earlier this month. She said she thought the call was supposed to help resolve her workplace problems. Instead, by the end of the call, she says she was fired.Rios says it all began in mid-March when her bosses at an out-of-state insurance firm told her to work from home and telecommute via conference calls. This was in response to the state's COVID-19 lockdown orders.Rios says all parents working from home received an email from the company's regional boss that read, "thank you for the incredible effort you are putting forth through these difficult times." She says it also said that they would avoid layoffs during the pandemic.Like many parents, Rios was unable to find childcare for her four-year-old daughter and one-year-old son. Despite juggling parenting and working from home, Rios claims she was able to complete all her tasks. She adds that her clients never complained about her kids being in the background of her conference calls. The only complaints, she says, came from her male, direct superior."I said, 'Do you want me to lock my kids in the room? My one-year-old in the room? Do you want me to do that?' And… he responded and said, 'Figure it out.'" Rios said.She says she tried to arrange calls to be during her children's afternoon naptimes but claims her boss continued to ignore and demean her."He would purposely overlap schedules," Rios said.Rios then reached out to her HR department and asked how she should deal with the harassment she says she was experiencing-- a move she says that backfired a week later."She was shamed for having children, so she first elevated it to Human Resources," Daphne Delvaux, Sr. trial attorney at Gruenberg Law, said. "Human Resources took the side of the abusive manager, and terminated her for complaining."Rios has since filed a lawsuit against both her direct boss and the company for Gender discrimination, Retaliation, Gender harassment, Failure to prevent gender discrimination, Negligent supervision, Intentional infliction of emotional distress, and Wrongful termination in violation of public policy.In her complaint, Rios claims her HR representative told her that the company was "...experiencing a reduced revenue due to COVID-19 and they were laying [the] plaintiff off as a result of the pandemic." But Rios believes this was retaliation."The fact that they tried to cover it up because I went to HR, it's obvious what they did," Rios said.ABC 10News reached out to the company headquarters for comment on this lawsuit. SAN DIEGO (KGTV) A San Diego Police officer was hit in the head with a cane and several officers punched during a protest following the shooting of a man in Wisconsin Sunday evening.Police say a group of roughly 50 demonstrators gathered at police headquarters, blocking entrance and exit driveways.Police say protesters blocked the entrance and exit of the station and as officers moved forward to clear the area, an officer was hit in the head with a cane and several officers were punched.RELATED: Protests take place in Kenosha, Wisconsin after man shot by policeThe department says one arrest was made for the assault on the officer with a cane and two arrests were made for resisting and obstructing the officers.The incident comes after Jacob Blake was shot by police in Kenosha, Wisconsin over the weekend.According to police, Blake is in serious condition following the shooting. 896
SAN DIEGO (KGTV) - While homes in California built after the mid-1970’s meet most seismic requirements, older homes can require significant upgrades to withstand a major earthquake. Moses Govea with Turnkey Contractors says the are required to upgrade older homes when they do renovations. It includes adding galvanized bolts to the foundation, forming sheer walls and adding metal braces to certain connection points. Geologist Pat Abbott said while viewing footage from the recent quake in Mexico he noticed the collapsed buildings likely were missing up-to-date joinery between the floors and walls. “As long as [the floor and walls] move as a unit, the structure is intact,” he said. SAN DIEGO (KGTV) - University of San Diego students had mixed feelings regarding their university's involvement in a national scandal. The complaint states Robert Flaxman paid 0,000 to get his son in the "side door" "through [the USD varsity coach] and [USD varsity sport]".Most students said they didn't know his son, an Industrial Systems Engineer Major. They did have opinions on the act itself.Former soccer athlete Lexi Phillips, who is a Sophomore, said it was like a slap in the face, "colleges, when you're applying, definitely ask if you're an athlete or not because they recognize how much work it is and so people who haven't been doing that and saying 'oh well I've been doing that' just to get into an elite school definitely isn't fair and isn't fair for someone who's been trying even harder to get in and they take their spot."Other students like Missica Derhalli, who is a Freshman, say it makes them sick, "I really can't believe that we would be doing something like that. I picked this college particularly because I felt like it was a good, holistic place for me to be and I was going to be getting a truly good education.""Just knowing that there are people who aren't putting in effort and I spent 13 years of my education just working so hard and these people aren't working at all and it's just it's very disheartening," Missica added. She volunteered more than 1,000 hours helping special needs children and has a merit scholarship.On the other side of the spectrum, some students weren't surprised at all. "This is basically like a smaller version of my high school and I saw this stuff like this happening there so this is all somewhat normal for me as bad as that sounds," Sophomore Jacob Asher said. When 10News asked the university who the varsity coach involved in the scandal was, they said they couldn't tell us, and that they're being as transparent as they can be.They sent this statement out yesterday:"The University of San Diego has been cooperating with the United States Department of Justice’s investigation involving an alleged criminal conspiracy to facilitate cheating on college entrance exams and admission into colleges and universities.We have no reason to believe that any members of our admissions team, our administration or staff, or our current coaching staff were aware of or involved in the alleged wrongdoing.
