SAN DIEGO (CNS) - A man who was operating a panga boat carrying several undocumented immigrants when it capsized off the coast of southern San Diego County earlier this year, killing two men aboard, was sentenced today to nearly seven years in federal prison.Julio Cesar Murillo-Arce, 42, pleaded guilty earlier this year to federal charges stemming from the Feb. 3 boating accident off the coast of Imperial Beach.He was sentenced to 78 months in prison in connection with the boat fatalities, and an additional five months for violating the terms of his supervised release stemming from a separate maritime alien smuggling conviction last year, according to the U.S. Attorney's Office.According to court papers, Border Patrol agents spotted the boat in the early morning hours of Feb. 3. It began experiencing engine trouble about 150 yards off the coast, prosecutors said, then eventually became inoperable.Prosecutors say Murillo-Arce told the others aboard not to identify him as the boat's captain, then dove into the water.The boat was capsized by a large wave, sending all six occupants into the sea. Four were able to make it to shore, but Ramon Ponce-Rodriguez and Modesto Rodriguez-Ballesteros did not.Ponce-Rodriguez was pronounced dead on arrival at a hospital, while Rodriguez-Ballesteros was initially hospitalized in critical condition and died Feb. 4.The surviving occupants of the boat told investigators that the boat's captain abandoned the vessel and swam away, despite being told some of the people aboard could not swim. SAN DIEGO (CNS) - A man accused of ambushing a janitorial worker at a Little Italy coffee shop and trying to sexually assault her pleaded not guilty Wednesday to a half-dozen felony charges, including kidnapping with the intent to commit a sex offense.Christopher Merron, 28, was ordered held on million bail. He faces life in prison if convicted, said Deputy District Attorney Nicole Roth.Merron allegedly attacked the woman as she was cleaning the coffee shop in the 1700 block of India Street about 4:30 a.m. last Sunday, pushing her into a back room, taking her car keys and threatening her with a knife.Following a struggle, the victim, whose name was withheld, was able to break free and run out of the building, said San Diego police Lt. SAN DIEGO (CNS) - A suspected drunken driver crashed into a house in the Miramar Ranch North area of San Diego Saturday morning and was hospitalized with life threatening injuries.The man was driving his 2014 Hyundai eastbound in the 11700 block of Cypress Canyon Road when he made a left turn onto the 11500 block of Sun Ray Court about 12:30 a.m., according to Officer Robert Heims of the San Diego Police Department."As (the driver) was turning, he made an unsafe movement to his left, lost control and crashed into a house," Heims said.The driver was taken to a hospital with major head and face injuries, considered to be life threatening, Heims said.DUI was suspected and the crash was being investigated by SDPD Traffic Division.The name of the driver was not disclosed.No other injuries were reported. 817

SAN DIEGO (CNS) - An ex-con and repeat DUI offender who was drunk when he drove on the shoulder of the freeway near Tierrasanta, striking and killing a tow-truck operator tending to a disabled trash truck, was sentenced Friday to 15 years to life in prison plus 10 years.Michael Gilbert Gray, 50, pleaded guilty in August to second-degree murder and admitted two serious felony priors, including a domestic violence conviction for hitting his wife and rupturing her eardrum.Charges of gross vehicular manslaughter while intoxicated and leaving the scene of the Feb. 23, 2017, collision that killed 55-year-old Fred Griffith were dismissed as part of the plea agreement.Griffith's sister, Danelle Ragsdale, said in a letter to the court that her brother -- a single father to three boys -- was "needlessly ripped from all of us."Ragsdale said Griffith and his three sons -- ages 15, 18, and 21 -- were "inseparable.""He (Fred) worked hard for the boys so they would have a good life," the victim's sister said in the letter read in court by Deputy District Attorney Cally Bright. "Fred was a ship in the night who would help you find your way to safety."Griffith's friend, Randall Resch, wrote in a letter that the victim was a "gentle giant" and one of the best heavy-duty tow-truck operators in San Diego County."Fred touched the hearts of everyone who knew him," his friend said. "To me, Fred died a hero's death."Before he was sentenced, Gray apologized to the victim's family and said he took full responsibility for Griffith's death.Witnesses testified during a preliminary hearing last year that they saw Gray's Ford Expedition swerve onto the shoulder of eastbound state Route 52 and narrowly miss a large disabled commercial trash truck before striking Griffith, who was standing outside his tow truck in front of the trash truck.Off-duty sheriff's Detective Mark Palmer testified that he activated his lights and siren in his vehicle and followed Gray's SUV before pulling him over a short distance down the highway.The defendant -- who had a half-empty bottle of vodka in his car -- was still showing signs of intoxication three hours after the crash, said Deputy District Attorney Cally Bright. Authorities said Gray's blood-alcohol content was .27 percent -- more than three times the legal limit -- at the time of the accident. Gray had DUIs in 1999, 2001 and 2013, Bright said.Gray went to prison in 1987 for assault to commit rape and sexual battery convictions and was incarcerated again in 2007 after the domestic violence conviction, according to a probation report. 2592
