SAN DIEGO (CNS) - Health officials Wednesday confirmed the first influenza- related death of the 2019/2020 flu season in San Diego County.The county's Health and Human Services Agency reported that a 74-year- old Chula Vista man died Aug. 15 due to complications from Influenza B. The man, whose name was withheld, also had additional medical issues, according to county health officials.The county tracks flu activity year-round during each flu season, which corresponds with the county's fiscal year from July 1 to June 30. At this time in the last two flu seasons, officials had confirmed just 26 cases in 2018 and 114 in 2017. SAN DIEGO (CNS) - A transient who allegedly overpowered a woman in the East Village, dragged her into some bushes and sexually assaulted her before running away pleaded not guilty Tuesday to three felony charges, including assault with intent to commit rape.Gary Ryan Cushinberry, 51, who is on felony probation for robbery and failing to appear in court, was ordered held without bail.Late on the evening of Nov. 5, Cushinberry allegedly grabbed a 26-year-old pedestrian walking by herself in the 400 block of 13th Street, pulled her off the sidewalk and assaulted her before fleeing.Detectives identified Cushinberry -- a recent transplant from Indiana who has been living on the streets of San Diego -- as the alleged perpetrator by means of ``several tips and leads,'' Lt. SAN DIEGO (CNS) - As the Valley Fire burned for a fifth straight day, blackening thousands of acres in rural eastern San Diego County, California Attorney General Xavier Becerra issued a consumer alert today warning that charging excessive prices for goods and services is illegal during a state of emergency.The state's price gouging law holds that it is unlawful to raise the price of items more than 10% after a state of emergency has been declared.Violations of the price gouging statute could carry penalties of up to one year in county jail and/or a ,000 fine. Civil enforcement actions could also include up to ,500 per violation and other monetary penalties.As of midday Wednesday, the Valley Fire had burned more than 17,000 acres and was 11% contained. SAN DIEGO (CNS) - A woman died Monday after being injured Sunday when she was hit by a car in Rancho Penasquitos, police said.The San Diego County Medical Examiner says Nang Arm, 37, died after she was taken off life support Monday. Medics responded to a call at 7:07 a.m. Sunday on Black Mountain Road and Carmel Mountain Road, where they found an unconscious woman with face injuries, San Diego police Sgt. Robert Hawkins said.A gold-colored 2006 Nissan Sentra driven by 20-year-old Uvelyn Nunez- Jaramillo and carrying two passengers, was heading south on the 13700 block of Black Mountain Road when the car veered to the right, SDPD Sgt. Tim Underwood said.The car went onto a sidewalk, damaged a fence, then struck the Nang. She was taken to Scripps La Jolla Hospital, Hawlins said.The car continued a short distance down the street, where it also hit a water line before it came to a stop. Nunez-Jaramillo exited the Nissan and walked away.Several passersby stopped at the scene to render aid to the woman and emergency personnel, Underwood said.Detectives determined that Nunez-Jaramillo caused the crash. SAN DIEGO (CNS) - An Italian restaurant in Encinitas agreed to pay ,800 to settle a pregnancy discrimination lawsuit filed by a former employee who alleged her hours were substantially cut, and she was ultimately fired, after she told her employer she was expecting, the U.S. Equal Employment Opportunity Commission announced Tuesday.After informing the owner in 2015 that she was expecting, the server was told that she "should stay home since she was pregnant, that her pregnancy had caused coverage problems, and that (the owner) would offer a position with less pay for more work so that she would not come back from her pregnancy leave," according to the complaint filed against Maurizio Trattoria Italiana LLC.She was fired in the summer of 2015, while less experienced servers were hired, according to the complaint.RELATED: Lawsuit aims to stop California's AB 5 from taking effect"Women should not be penalized for having children," said Christopher Green, director of the EEOC's San Diego office.
