SAN DIEGO (CNS) - The California Supreme Court ruled this week that a San Diego court must re-examine its decision to allow a criminal defendant to subpoena Facebook to obtain private social media posts and messages he alleged would help him in his defense.The ruling issued Thursday laid out a series of factors for the trial court to consider when weighing whether to allow the defendant to gain access to his alleged victim's restricted posts and private messages.The ruling stems from the criminal case of Lance Touchstone, a Northern California man charged with attempted murder for allegedly shooting his sister's boyfriend in Ocean Beach in 2016.Touchstone sought to obtain information from the victim's Facebook posts that the defendant alleged would show his accuser was a violent person, bolstering a self-defense claim.A San Diego Superior Court judge ruled in Touchstone's favor and ordered Facebook to release the information, leading to subsequent appeals.In an opinion authored by Chief Justice Tani G. Cantil-Sakauye, she wrote that the trial court should consider a list of seven factors to consider when deciding whether good cause has been shown to grant the subpoena.These "Alhambra factors" include whether the defendant has shown a "plausible justification" for acquiring the information and whether acquiring the material violates a third party's confidentiality or privacy rights, among others.While the state Supreme Court declined to make its own determination on the subpoena's viability, it ruled for the trial court to re-examine the subpoena issue in light of these factors.Touchstone's attempted murder trial in San Diego remains pending for a date still to be determined, as courts remain closed to the public and jury trials have been delayed indefinitely due to the COVID-19 pandemic. 1826

SAN DIEGO (CNS) - The San Diego County Health and Human Services Agency announced today a person at Patrick Henry High School was recently diagnosed with tuberculosis and may have exposed students and staff.The dates of exposure are from August 26, 2019, to March 13, 2020. The agency is working with San Diego Unified School District officials to notify those who were potentially exposed and provide TB testing.Patrick Henry High School is currently participating in social distancing protocols and onsite TB screening will not be available at the school. Identified students who may have been exposed to TB can get tested with their primary care provider. Students who do not have a medical provider may contact agency staff to arrange for free testing by appointment only.Identified staff will be provided testing by the San Diego Unified School District.Tuberculosis is transmitted from person to person through indoor air during prolonged contact with an infectious person. Most people who are exposed do not become infected.``Testing is recommended for everyone who was determined to have been exposed to make sure they are not infected, since initial infection typically has no symptoms,'' said Dr. Wilma Wooten, county public health officer. ``Early diagnosis is important so that people can get treatment and prevent them from developing the infectious form of the disease.''Symptoms of infectious tuberculosis include persistent cough, fever, night sweats and unexplained weight loss. SAN DIEGO (CNS) - San Diego County public health officials have reported 283 new COVID-19 cases and no new deaths, raising the region's total number of cases to 26,984, with the death toll remaining at 533.The county reported 7,505 diagnostic tests Saturday, 4% of which returned positive. The 14-day rolling average of positive tests is 5.6%. The target set by California is less than 8%. The seven-day daily average of tests is 9,201. Of the total positive cases, 2,391 -- or 8.9% -- required hospitalization and 614 -- or 2.3% -- were admitted to an intensive care unit.Three new community setting outbreaks were reported Saturday in a restaurant/bar, food processing facility and business. In the past seven days, 11 community outbreaks were confirmed. The number of community outbreaks is above the trigger of seven or more in seven days.
