SAN DIEGO (KGTV) - Southcrest neighbors banned together to file a lawsuit against the City of San Diego, claiming a city park was not designed to properly drain and therefore floods the neighborhood each time it rains.Last December was the breaking point for neighbors near Southcrest Trails Park, at S. 37th Street and a dirt road behind houses situated on Beta Street. They say feet of water flooded into their homes."This actually becomes a sinkhole, this area," said Greg Montoya, who is leading the charge with his hefty binder full of decades of documentation of the problem. Montoya has pictures of his white pickup truck sunken rims-deep into his yard due to saturation.The lawsuit describes it as "a 66-acre, 1.2-mile corridor in the Southcrest neighborhood of San Diego to construct Highway 252, which would connect Interstate 805 and lnterstates 5 and 15."The project never materialized, Montoya says, because St. Jude, thinking of the school, put up a fight."So then the City of San Diego put dirt berms in to keep people from driving back here, to keep people from throwing trash back here, because it became a dump," Montoya said. The park took shape in 2003, according to the lawsuit.Montoya and other neighbors say there was not enough drainage put in, sending water running down the five-foot berm every time it rains.A storm in December 2018 left many stranded, including Ricky Vasquez, who was trying to pick up his one-year-old son."Other cars were stuck in the middle of the street because the water was so high," said Vasquez.Neighbor Pastor Nicolas Martinez said his home flooded, ultimately costing ,000.Montoya was fed up."San Diego's America's Finest City for some but not for all because I've got documentation for over 30 years for asking for help for this situation that they've created and I'm just ignored," said Montoya.He went to attorney Evan Walker, who said his team found one of the two storm drains at the park "is not connected to any sort of system despite the city's own plans to connect them to the system."Montoya hopes the lawsuit causes the city to step up.10News reached out to the City of San Diego who said they could not comment on ongoing litigation. 2211

SAN DIEGO (KGTV) - Students and staff at the King-Chavez Community High School Freshman academy have had a tumultuous few months.  They were displaced from their classrooms location at 1010 Second Avenue in downtown.The building closed down earlier this year for asbestos treatment, displacing many tenants including the school.RELATED: 550 San Diego city workers relocated due to asbestos“It’s been a nightmare,” Principal Kevin Bradshaw said, saying it was a very abrupt closure. “We left school on a Friday evening, came back on a Monday morning and we were locked out," he said.In a statement, the building manager said this to 10News: “We sent an email notice to all tenants immediately following notification from the regulatory agency."Bradshaw says they were not given time to move their things out of the classroom, in fact, they weren’t even allowed to retrieve their equipment. “We have televisions, computers, student’s work, teacher’s items, anything you would have in any normal campus is still in the building,” Bradshaw said. He says they’ve had to replace all those things in order to continue the education of students. The school also had to move their classes to the Boys and Girls Club in Clairemont. Bradshaw says that means they've had to bus their students to that location every day for more than two months, and the bills are racking up.He’s hoping they will be reimbursed.“The owner and all parties involved are actively evaluating the expenses associated with the shutdown,” building management told 10News in a statement. They went on to say that “the building has undergone extensive testing in accordance with the regulatory requirements for occupancy,” and is completely safe now.Bradshaw says he’s still not ready to bring students back to the building until he’s sure it’s safe and they won’t be displaced again. 1889

  

SAN DIEGO (KGTV) -- San Diego State University says 400 students have confirmed and probable cases of coronavirus.The university said Tuesday that, since August 24, 396 students have tested positive for COVID-19. Four other students have probable cases of the virus.The update comes one day after the school extended its stay-at-home order for on-campus residents through September 14. SAN DIEGO (KGTV) - Smash-and-grab thieves targeted a sushi restaurant in North Park and neighbors worry it may be part of a growing trend.Along 30th street, the mess was discovered Thursday morning in front of Aburi Sushi."It sucked, really sad," said General Manager Alex MikhaA neighbor called him and reported a window broken. Mikha rushed over and found the front door shattered. A look at surveillance video from nearby businesses reveals the culprits. Around 5:15 a.m., a black sedan pulls up and parks in front of the restaurant. Two people emerge. The lookout appears to be a woman, who covers her face. Minutes later, the other person makes a move.
