SAN DIEGO (CNS) - Two San Diego-based U.S. Navy SEALs have been charged in connection with the 2017 execution of a detainee in Iraq.SEAL officials told the Navy Times that Lt. Jacob "Jake" Portier faces an Article 32 hearing on suspicion of covering up a string of war crimes allegedly committed by Special Operations Chief Edward "Eddie" Gallagher.The Naval Criminal Investigative Service probe involves the death of a wounded Islamic State fighter near Mosul, Iraq in May 2017, the Navy Times reported.Prosecutors allege Gallagher stabbed and killed the wounded man, posed for a photograph next to the body and opted to complete his re-enlistment ceremony next to the corpse, bringing "discredit upon the armed forces."Gallagher is also accused of shooting two non-combatants in separate incidents near Mosul, the Navy Times reported.An MCAS Miramar spokesman could not immediately be reached for comment.Gallagher was arrested on Sept. 11 and is being detained at the Naval Consolidated Brig Miramar at the Marine Corps Air Station Miramar, under Rules for Court-Martial 305, the Navy Times reported.Portier, who is accused of dereliction of duty, was not present at the time of the alleged killing, the Navy Times reported. He was Gallagher's platoon leader during the deployment and told investigators he learned about the alleged war crimes only after he was told about them by a special operator first class."Naval Special Warfare does not comment on specifics of an ongoing investigation in order to preserve its integrity, however all credible allegations of criminal activity are taken extremely seriously and thoroughly investigated," Naval Special Warfare spokeswoman Cmdr. Tamara Lawrence told the Navy Times.Between April and September in and around San Diego, Gallagher allegedly tried to "discourage members of his platoon from reporting his actions while in Iraq during his deployment," according to the publication. 1941

SAN DIEGO (KGTV) - A former North County contractor who pleaded guilty to several charges, including grand theft, received a five-year sentence on Monday.Prosecutors said Marc Morningstar owes thousands of dollars to more than a dozen former customers. Team 10 first exposed Morningstar in early 2017 after several people contacted Team 10 about his questionable business practices. Morningstar pleaded guilty to failure to file a tax return, two counts of grand theft of personal property, and using personal identifying information of another person. He also admitted to two misdemeanors—failure to secure payment of compensation and contracting without a license.The judge sentenced him to local custody. He will receive credit for the time he has already served, which was more than 200 days. He also owes 13 victims nearly ,000, according to deputy district attorney Amy Lafer.During the hearing, Morningstar’s girlfriend Maria Meeuwisse requested to address the court. She said she is a victim of Morningstar as well.“He will not be living with me when he gets out, whenever he does get out. He has used my social security number,” she told the judge. Meeuwisse previously pleaded guilty to her role in the scheme, which included a misdemeanor of contracting without a license and failure to secure payment of compensation.Judge Timothy Walsh said that Morningstar has to “rethink the way he approaches his life.” 1430

SAN DIEGO (KGTV) -- A driver crashed his Mercedes-Benz through an underground parking garage gate, causing the gate to fall onto his car and leaving the vehicle -- and himself -- trapped at the entrance.The incident was reported at around 2:30 a.m. Tuesday at an apartment complex in the 4300 block of Menlo Avenue, according to San Diego police.With the large gate on top of the car, responding officers helped the driver out of his vehicle.ABC 10News learned the man was treated by medics at the scene but was also being evaluated for possible DUI. He did not appear to be seriously hurt.It's unclear why the driver was attempting to enter the parking garage since he reportedly told police he does not live in the apartment complex. 743

  

SAN DIEGO (CNS) - U.S. Navy Secretary Richard Spencer and officials with the San Diego Association of Governments signed a formal agreement Thursday to potentially revamp the Naval Base Point Loma Old Town Complex, which local officials hope to use as a transit hub to connect public rail transit to the San Diego International Airport.SANDAG and local U.S. Navy officials signed a memorandum of understanding on the subject in July that did not require either party to take action on the 70-acre property but allowed both sides to discuss their vision for the complex's future.The agreement with Spencer and the Navy will supersede that document and start a path to San Diego's own "Grand Central Station" while working to modernize the complex for Navy uses as well.RELATED: SPAWAR area could be missing link to San Diego's airport transitIt outlines goals for this year and next year like finding funding for site planning, starting the environmental planning process, potentially drafting legislation and requesting congressional authorization if necessary."San Diego is a city of innovation and exploration that matches the work ethic of every sailor and Marine at sea," Spencer said. SAN DIEGO (KGTV) — A 36-year-old Filipino man was arrested soon after police say he shot a woman twice in the back as she sat in her car outside a Bay Terraces apartment complex.San Diego Police say Emmanuel Ocular walked up to the 20-year-old woman as she was in her car in the 6800 block of Doriana St. at about 9:30 p.m. Thursday. Without warning, Ocular shot the woman twice in the back and fled the scene, police say.The woman was taken to a nearby hospital with non life-threatening injuries.Soon after, police located Ocular in the 4800 block of Eastgate Mall and arrested him.Police did not immediately have a motive for the shooting. SDPD Gang Detectives are investigating the incident. 703
